Schroeder CC: Mayor and City Council Date: 10/03/02 Re: Gateway North Redevelopment District There were several actions recently taken by the City Council that move several Gateway projects forward. A number of issues continue to be facing the City in order to continue to make progress on redevelopment of the Gateway North Redevelopment District. In order to facilitate the discussion we have enclosed a number exhibits (denoted on upper right hand corner). These are: 1. Overview of that portion of the district north of 80th Street and east of Highway 61 showing Hardwood Avenue, Hardwood Court, and the reroute of East Point Douglas Road in addition to the connection to Hardwood of Harkness Avenue. 2 — 11. Exhibits detailing the location and design of the proposed Oak Park Commons retail/office project at 7420 80th Street. Council rezoned this project on October 2, 2002. The site plan was also given Council approval at that same meeting. 12 — 13. Gateway North First Addition Preliminary Plat as approved by Council on September 18 and Oakwood commercial parcel which was reguided and rezoned on October 2, 2002. The final plat is scheduled for October 16, 2002. While the site is not developable until mid 2003 at the earliest there is a great deal of interest in this site from the development community. 14-15. The Bruhn/Stoltz site. This parcel was purchased by the EDA and resold to Gene Stoltz for future commercial development. The City Council reguided it on October 2, 2002. It would be expected that it will be remarketed as a commercial site • once Hardwood Avenue is completed. We believe this parcel creates the northern rage I border of the Gateway commercial district. The primary access for this parcel is expected to line up with the future access to Oakwood Park (there could be a loading access at the northern portion of the site as well). Harkness Avenue will be improved at this time just north of the "retail" access to this site. 16. Lane configurations on Hardwood Avenue. 17. Proposed joint access for Kohl's and US Bank. 18. Property to be acquired from the 1501 Partnership (owners of the Bumet property for Hardwood Avenue. 19. Hardwood Court showing the remnant property proposed to be deeded to the 1501 Partnership in partial exchange for the Hardwood Avenue right of way. 20. One option (rejected by staff) of providing a Hardwood Avenue access to Burnet Realty off Hardwood Avenue. 21. Proposed access for Burnet Realty off Hardwood Court. This exhibit also shows the existing East Point Douglas Road access for Burnet, which is constructed at a 10% grade (below usual design standards). 22. Grove Plaza Entry Renovation Plan. The City Council and the EDA reviewed this plan some time ago. This plan is in substantial conformance with the earlier approvals. The developer is expecting to initiate construction on this plan either • yet this fall or spring, 2003. Many of the above exhibits are intended as background information without the need for further action at this time. Some discussion and decisions are necessary as we continue to lack control of all of the property required to complete this project. Even so, Council awarded the bids for completion of the infrastructure and grading at their October 2 meeting (along with some earlier approvals for some utility work and demolition/relocation of three residential structures). The bulk of the property that we ultimately need to acquire we do control. The contractor awarded the bid can work within the limits of the property we control at this time. However, we need to continue to move forward of the remaining acquisitions. Status of remaining parcels is as follows: 1. US Bank. We are conducting a land exchange with the bank in which we acquire property they own north of East Point Douglas Road and a small sliver west of that same roadway where it intersects with 80th Street. We will return to them land that for the most part is currently East Point Douglas Road. We also will provide an access easement to them through the Kohl's entry (exhibit 17). We are confident that we will have signatures on these agreements shortly. • •Page 2 1111 2. Office Condominium at 7121 East Point Douglas Road. We own two of the six office bays and are currently continuing to lease those bays to three American Family Insurance agents as well as the Great Clips. The other four units are owned by individuals that have been working jointly with Roger Jensen (one of those owners) in an attempt to relocate to the new Oak Park Commons Project (exhibits 2 — 11). While these relocations may or may not be successful we have delayed completion of negotiations toward acquisition of these units (and a vacant piece of land owned by .Roger Jensen on the same parcel) until consideration by Council of Oak Park Commons and receipt of an independent appraisal by these owners. As noted above, Council approved the Oak Park Commons project on October 2, 2002. According to Mr. Jensen he expects to receive their appraisal by October 11. 3. Victory Church property at 7162 East Point Douglas Road. We have made a purchase offer to the owner of this property that is within the parameters of acquisitions made to date within the district. We also have identified a relocation parcel for the Church in northern Cottage Grove off County Road 19. We are currently acting as an intermediary between buyer and seller on acquisition of that parcel. That acquisition is integral to the success of our purchase of 7162. We are expecting to receive a written sales offer from the seller shortly, after which we can conclude our negotiations with the Victory Church. The Church as conducted a self-move to temporary quarters, which will facilitate acquisition and demolition of this structure. • 4. 1501 Partnership (Bumet Realty Building). This property is owned by a partnership, which then leases the property to the Realty office. The partnership is not associated with the Realty office other than as a landlord. Acquisition of right of way for Hardwood Avenue is straightforward and negotiations toward that acquisition have moved forward positively. Included is the concept that we would acquire 20,668 square feet of property on the western portion of the property and deed back 17,403 square feet of property on the north side of the parcel, plus cash to represent the differing sizes of the traded property. We would also grade in the access to Hardwood Court as shown on exhibit 21 in order to improve the access from the existing condition. Negotiations have stumbled, however, as it relates to the future of the existing access onto East Point Douglas Road. The owner has represented that it is important that that access remain to complete a purchase agreement. Engineering has not been successful in designing that access with the new roadway at a reasonable grade. The current grade is at 10%, which we believe provides a potentially hazardous condition under slippery conditions at least for two-way and outbound traffic. New access concepts have not been successful in improving on the existing condition. Thus, at present we appear to be close to a stalemate. We have forwarded all of the infrastructure designs to the Partnership attorneys and architects for their review. While we are of the opinion that the East Point 11/ Douglas Road access value is no greater than a single access off Hardwood •Page 3 Court (due to it's vastly improved grades, thus safety, and due to the fact that • Hardwood Court shares an access to Hardwood Avenue with Kohl's and US Bank), that opinion is apparently not shared by the owner. Absent improvements from access designs we have seen to date, we may be in a position of closing that access. We would need to proceed with an eminent domain action if we proceed down that path. At the October 2, 2002, meeting members of Council raised two additional issues that perhaps should be discussed by the EDA. First was the premise that the 3.5- acre Oakwood commercial lots created for resale by the City perhaps should not be burdened by development costs. We have previously represented that we expect net proceeds from this property to be in the neighborhood of $750,000. Net proceeds would result from gross sales revenue minus costs necessary to create the site including grading, tree mitigation, and Oakwood Park impact mitigation such as costs to relocate three holes of the Frisbee Disc Course and the playground. Council has asked that that position be reconsidered for discussion at their table on October 16. I believe the intent is to remove development costs from the sales proceeds in order to increase the cash return that could be expected to be delivered to the Park Trust Fund. We will be prepared to discuss this in detail at your meeting. The second issue is the suggestion that development of the Gateway North development district has happened in a relatively rapid fashion and that Council should visit with staff to ensure that current and future development direction is aligned with Council goals, directives and vision of the Gateway area. While momentum and synergy are important, certainly staff is not interested in pursuing project development outside of the collective vision of Council, the EDA, and the community. That having been said, however, we believe that additional area improvements may be forthcoming in the not-to-distant future. First, we have previously noted that the Fratalone parcel is under independent development review. It would not be unexpected that a rezoning/site plan for a project on that parcel be proposed as early as the next construction season. Second, we are receiving increasing expressions of interest for purchase, rehabilitation, or redevelopment of parcels in other locations within the Gateway District. At this time, however, we do not have a concrete development proposal for the EDA and Council to consider. In any case, if you have any comments to add to the upcoming Council discussion that should be helpful. EDA action: 1. The EDA and Council had previously adopted an eminent domain resolution. We have not filed that resolution with the court due to the expectation that • •Page 4 • acquisition on the various parcels would proceed, which they have. That having been said the EDA should acknowledge that we should now file that earlier resolution for all properties not yet under contract or acquired. Our expectation is that even with that filing we would continue negotiations. 2. In the earlier resolution, the property owned by the 1501 Partnership was not included as at the time we were not certain of the description of the property that would be necessary for acquisition. The EDA should either amend the earlier resolution or create a new one with the addition of that property. The appropriate resolution will be presented at your meeting. 3. We have enclosed the façade plan for the Grove Plaza Center. Absent any comments on that design, we will direct the applicant to proceed (subject to Council direction). 4. We have enclosed the infrastructure bids for the Gateway North project awarded by Council on October 2, 2002. We would ask that you acknowledge and affirm your approval of that action. 5. Upon discussion, it would be desired that the EDA provide a recommendation to Council regarding funding of development costs of the Oakwood commercial lots. 6. We would ask for recommendations regarding the development of the Gateway and how that relates to your vision of the Gateway. There are two resolutions included in the packet for Council action. The first resolution is for the base bid, and the second is for the alternate 1, again, the Hardwood Court portion of the public improvement project. • • RESOLUTION NO. 02-XXX • RESOLUTION AWARDING THE BASE BID FOR THE HARDWOOD AVENUE UTILITY, STREET, AND STREET LIGHTING IMPROVEMENT PROJECT WHEREAS, the City Council of the City of Cottage Grove on August 28, 2002, approved the construction plans and specifications for the Hardwood Avenue Utility, Street, and Street Lighting Project and set a bid date of October 2, 2002, at City Hall; and WHEREAS, an advertisement for bids for the improvement was published in the "Washington County Bulletin" and "Construction Bulletin," and WHEREAS, pursuant to an advertisement for bids for the improvement, bids were received, opened, and tabulated according to law; and WHEREAS, it appears that Arcon Construction Co., Inc. is the lowest responsible bidder; and WHEREAS, the City Engineer recommends that the contract be awarded to Arcon Construction Co., Inc. The two subcommittees would discuss two different aspects of development in Cottage Grove — industrial and commercial. He said he would like to have Authority Members Luden, Wennen, and EDA Vice President Shiely • sit on the industrial subcommittee; and Authority members Pederson, Kleven, and Weingartner sit on the commercial subcommittee. Authority Members Luden and Pederson would head their respective subcommittees. Subsequent to that action, legal counsel for the South Washington County Bulletin submitted the enclosed opinion regarding the open meeting law as it relates to committees or subcommittees of the EDA. This opinion is cautioning that any subcommittees would be subject to the open meeting law requirements. It is not the staffs understanding that anything other than a public process was or is intended by Mr. Wolcott's recommendation. It is our belief that Mr. Wolcott is following the lead of the Cottage Grove Area Chamber of Commerce, which has also discussed similar task forces, be created to further discussion of retail and industrial needs of the community. This Chamber initiative has been addressed by each of the past two, and the current Chamber President. Perhaps, however, we need to clarify the tasks and roles of these subcommittees. Further, it would be helpful to discuss the opportunities that may exist in collaborative efforts with the Chamber and perhaps others that have similar missions of furthering the economic and community development of the City. Under the terms of the Minnesota Open Meeting Law (Minn. Stat. Ch. 13D), as interpreted by the Minnesota Supreme Court, the "quorum rule" applies separately to committees and subcommit- tees. According to the Court in Moberg v. Independent School District No. 281, 336 N.W.2d 510 (Minn. 1983), "[Meetings" subject to the requirements of the Open Meeting Law are those gather- ings of a quorum or more members of the governing body, or a quorum of a committee, subcommittee, board, department, or commission thereof, at which members discuss, decide, or receive information as a group on issues relating to the official business of that governing body. Id. at 518 (emphasis added). Thus, if a committee consists of three persons, the quorum is two, and the requirements of the Open Meeting Law are triggered when two committee members get together to discuss official business, regardless of what a quorum of the full body might be. In August and September the Committee began discussing banner designs, placement, • etc. The Committee was especially interested in creating a city banner that would blend with the new signs associated with the Gateway Development District, and incorporate colors and designs that would complement these other signs. Associate Planner John Burbank took on the responsibility of creating a draft banner design. On Thursday, September 26 the Marketing Committee agreed to send two design drafts to City officials for formal consideration. These two drafts are included with this packet item. In addition to the discussion relating to banners, the Committee also discussed the City's logo and whether changes should be made. If so, the banner designs should reflect such changes. The Committee considered using the existing CG and incorporating the ribbon design seen in the banners. A draft logo design is also included in this packet item. With the EDA's assent, one or both banner designs will be presented to the City Council on Wednesday, October 16 for final approval. In that year we had construction with a total building permit value of$104,841,009 of which $59,313,232 was designated commercial added to 182 new housing units built during the year. With the advent of 2002, and a softening of the national economy beginning during 2001, new industrial starts have slowed from the prior year. In exchange, however, the local retail sector is experiencing a renaissance of sorts. On February 12, 2002 the Economic Development Authority(EDA) identified six primary goals for the next four years. These goals were reflected upon by the City Council, which in turn identified five primary goal areas for 2002 on March 10, 2002. Both the Council and the EDA are continuing an emphasis on commercial and industrial development, transportation and transit, housing development, and maintenance and enhancement of public facilities. A new Council priority for the year, added to the other five, is additional operational strategic and fiscal planning. Facilitation and attraction of quality development within all sectors continues, therefore, to receive a high level of priority by both the EDA and City Council. Following is a brief description of projects and project areas currently under development within the community. Gateway North Redevelopment District The Gateway North Redevelopment District is a 365-acre area located at the interchange of Highway 61 and 80th Street. Originally proposed by the City Council on February 13, 2001 it was formally designated in a joint meeting of the City Council and Economic Development Authority on March 28, 2001, and followed by creation of a redevelopment tax increment district on July 26, 2001. The redevelopment district includes all four quadrants of the Highway 61/80th Street interchange and includes 506,674 square feet of retail and office buildings in addition to public properties and a small amount of residential property. Creation of the Redevelopment District was intended to signal to property owners, and others, the City's intent to pursue redevelopment activities within the district as opportunities arise. Further, creation of the smaller tax increment district is intended to provide a financing mechanism for GROWTH PARTNERS City of Cottage Grove• 7516 80th Street South •Cottage Grove, Minnesota 55016 (651)458-2882•econdev@cottage-grove.org • public expenditures associated with infrastructure construction or land acquisition within the project area. Development activities have occurred quite rapidly following designation of the district. The City entered into a development agreement with Kohl's Department Stores in July 2001, which will result in a construction start of July 2003. During the interim period the City is packaging the property required for the project site in addition to construction of a new roadway corridor for Hardwood Avenue that will connect the 80th Street commercial area to the residential development area at 70th Street. Infrastructure construction is underway as of the fourth quarter of 2002. The 170,000 square foot Grove Plaza Shopping Center is currently being reconstructed following an April 2002 development approval. Included is removal of approximately 60,000 square feet of the existing shopping center in exchange for a 116,000 square foot Home Depot store under construction and scheduled to open March 13, 2003. The remaining 42,000 square feet of small tenant space will be renovated and a 28,255 square foot outlot remains available for future development. The City provided enhancements to the properties storm water system as part of this redevelopment and will provide partial funding toward rehabilitation of the small tenant spaces. Sandwiched in between the Kohl's and Grove Plaza developments is a 5.1-acre site that up until November 2001 was home to the Rose of Sharon Church. The church has since moved to 70th Street and Jamaica Avenue. In its' place is a new 15,120 square foot Walgreen's store that opened in July, 2002, a 12,700 square foot retail center and a 4,500 square foot TCF banking . facility, both currently under construction. As a result of these three developments, taxable market values within the tax increment district will at least double to$26,324,300. Additionally, the City is currently working on two more redevelopment phases, the first of which is expected to add over$11,000,000 in taxable market value within the next two to three years. Included in the next phase are four new development parcels adjacent to the Kohl's project, two of which are under the control of the City. Development review of three additional parcels is currently underway within the same quadrant. A third phase, should the opportunity present itself, would be redevelopment or rehabilitation within the southwestern quadrant of the District. Scattered Site Commercial Projects Another commercial hub of the City is located at the Highway 61 interchange with Jamaica Avenue, one mile south of 80th Street. Up until 2002 there was 561,779 square feet of retail and office users in this area. At the periphery of this area is a new 76 room Country Inn and Suites Hotel with a 4974 square foot, which opened in July 2002. Additionally an Applebee's Restaurant was approved in front of the Hotel; both located on a 3.1 acre parcel on East Point Douglas Road. The City brokered the initial real estate transaction that provided the opportunity for these two developments. 2 GROWTH PARTNERS • 111)011 City of Cottage Grove•7516 80th Street South •Cottage Grove, Minnesota 55016 (651)458-2882• econdev@cottage-grove.org • Within the same district is the Pine Grove development, which contains five commercial parcels. Two of these parcels were developed in 2001 with a total of 23,047 square feet of office/showroom space. A third parcel has been purchased by Wells Fargo Bank with construction of a new facility scheduled for 2003. The other two pads are developed with a future office use and a restaurant user in mind. At present those development opportunities remain available. With the adoption of a new Comprehensive Plan in 2000 the City Council created a new Neighborhood Commercial land use designation. As a result, in 2001 and 2002 two Planned Unit Developments including approvals for just under 30,000 square feet of commercial square footage were made available at 70th Street and County Road 19 and again at 70th Street and Hinton Avenue. Both developments are in preleasing, with pad purchase also an available option. Industrial Park While the City has designated the land south of Highway 61 and west of the 1750 acre 3M campus as the Cottage Grove Industrial Park for decades, development of the Park did not move forward until 1998 after the City had optioned 40 acres in the prior year. As a result of that land option the 227,000 square foot Renewal by Andersen facility opened in 1999 on 30 acres at Jamaica Avenue and 100th Street. The Renewal project won the 1998 Business Retention Project of the Year from the Economic Development Association of Minnesota (EDAM). This project was followed by the 11,000 square foot United States Postal Service Annex on 2.206 • acres and the 15,200 square foot CCE Technologies manufacturing facility on 2.468 acres on 95th Street. This past year(2001-2002)three more projects were completed including the 70,000 square foot distribution/office facility for Tradehome Shoes on 4.59 acres, the 42,000 square foot Advance Corporation on 6.6 acres and the 80,000 square foot American AgCo facility on 5.97 acres. These three projects, all located along 97th Street,jointly won the EDAM Best Business Attraction Award for 2002. Currently under construction is an 187,000 square foot expansion of the Up North Plastics facility, located north of 95th Street and west of Jamaica Avenue. Further the City has prepared for additional opportunities by grading twenty acres for future development along both 95th Street, east of CCE Technologies, and along 97th Street, west of American AgCo. As a result we have several lot configurations available ranging in lot depth from just over 300 feet to just under 700 feet. For larger projects the City can make parcels available off of 100th Street ranging up to 100 acres in size. Roadway / Infrastructure Projects The two major projects impacting Cottage Grove over the next few years are the$252 million MnDot Wakota Bridge/Highway 61 improvement and the Washington County Hinton/Tower project. Additionally, among municipal improvements the City is in the midst of the next phase of our local pavement rehabilitation project in 2002-2003. Construction on the Wakota Bridge/Highway 61 project began in May 2002. The project includes reconstruction of Trunk Highway 61 from Carver Avenue in St. Paul to St. Paul Park Road in St. Paul Park. All three of the signalized intersections within the City of Newport will be removed in favor of a new interchange near Glen Road. North of 1-494 the existing signal at Highway 61 and Carver Avenue will be replaced with a right-out to northbound 61 with a new interchange at a new Maxwell Avenue/Bailey road connection. All of this will upgrade Highway 61 to freeway standards within the entire project area by the end of 2003. The St. Paul Park interchange will be completed one year later. The entire project, which includes doubling the size of 1-494, will be complete by 2007. The Washington County Hinton/Tower project includes construction of a north-south highway n north of MilitaryRoad in Woodbury. With connection between 65 Street in Cottage Grove to o ry reconstruction of Hinton Avenue between 65th and 70th the result will be a 4-lane roadway from 80th Street in Cottage Grove to 1-94 providing an enhancement to area commuters desiring an alternative to Highway 61. The project is scheduled for completion during 2003-2004. The$9.5 million Cottage Grove Thompson Grove pavement rehabilitation project completes a multi-year pavement reconstruction program within the community. Included will be complete reconstruction of every municipal roadway within the southwest portion of the community. Underground infrastructure will be replaced as necessary throughout the project as well. • Construction will be complete by the end of 2003, as will that of Hardwood Drive. Hardwood Drive is being facilitated by the Gateway North redevelopment, providing a conduit for residents on the north side of the community to access retail opportunities within the central business district of town. Also transportation related is the creation of an approximate 500 stall permanent park and ride. The park and ride will be located along West Point Douglas Road, near the Highway 61/80th Street intersection. This improvement, coupled with the expansion of express bus service to downtown Minneapolis is projected to further increase ridership from the community. Sanitary Sewer Interceptor / Wastewater Treatment The Metropolitan Council Environmental Services Division (MCES) provides wastewater treatment for the entire Minneapolis/St. Paul metropolitan area. Cne of the nine metro treatment plants is located in Cottage Grove within the perimeter of the 3M Cottage Grove campus at the east end of 110th Street, east of Ideal Avenue (two miles south of the industrial park). This 2.5 million-gallon per day(mgd) plant is currently under reconstruction which will result in a 10 mgd capacity by 2003 with an ultimate capacity in the 15-20 mgd range upon completion of the project. ,5111 4 GROWTH PARTNERS SfiVirA City of Cottage Grove•7516 80th Street South • Cottage Grove, Minnesota 55016 (651)458-2882• econdev@cottage-grove.org • Concurrent with that development is a new MCES wastewater interceptor to be completed along County Road 19 by mid 2004. As a result of this project the City is preplanning for development opportunities and phasing,the completion of which is timed with availability of the interceptor. Subdivision Development Residential construction of 2002 is projected to slightly increase over that experienced in 2001, which was 182 new residential units. In both years the split between new townhome versus single family homes has been almost even. Although new townhome projects such as the 38 unit Almar Village, located at County Road 19 and 7Oth Street,and the 124 unit Pine Grove at Cottage Grove project by D. R. Horton, north of East Point Douglas are almost complete, there have been new attached housing projects approved. Orrin Thompson will be finishing up their 138 unit Lodges at Pine Summit most likely in 2003, but will continue providing attached doubles, townhomes and lodges in their new 290 unit project located at the corner of 70th Street and Hinton Avenue. The West Draw area of the community has also seen an increase in new single family development approvals as Pulte Homes received approval for a 116 lot-3rd phase of their Timber Ridge project. The 1st and 2nd phases are under construction and contain 49 units at the corner of Harkness Avenue and 70th Street. Newland Communities received approval for 175 urban and 9 rural lots within the Highland Hills project, located north of 65th Street. This project, as well as the Pulte project will have sites graded and infrastructure installed to permit home construction in early spring 2003. Orrin Thompson continues to construct within their 205 unit, 177 acre, single family development, Pine Summit. They are in their 5th phase of construction with approximately 54 home sites still available. Two local builders, Custom One Homes and Kingsborough Homes • have sites available in their two projects, Hidden Valley and Kingsborough Woods. The City is developing plans for the next MUSA expansion within the community, which will be located in the eastern portion of the community. The East Ravine will open up approximately 3,500 acres for future development opportunities, primarily residential. Timing for completion of the planning exercise is scheduled to coordinate with the expansion of the regional treatment plant and interceptor construction.
