COUNCIL ACTION REQUEST:
1. The City Council hold the public hearing that vacates and discontinues all existing drainage
and utility easements located within the City-owned parcel (legally described by metes and
bounds), Outlot A in Glengrove Industrial Park 3rd Addition, and both of AGCO's parcels
(legally described by metes and bounds); and
2. Adopt the resolution approving the vacation and discontinuance of the drainage and utility
easement described above, and authorize the City Clerk to prepare a notice to be
presented to the Washington County Auditor regarding the completion of the proceedings
herein.
3. Adopt the resolution approving the Glengrove Industrial Park 5th Addition, subject to the
conditions listed in the resolution.

RE: Proposed Vacation and Discontinuance of Utility and Drainage Easements and
Approval of the Glengrove Industrial Park 5th Addition Final Plat
Introduction
The City Council is requested to hold a public hearing to vacate and discontinue existing public
utility and drainage easements that are located on properties that will be subdivided as Glengrove
Industrial Park 5th Addition. In conjunction with vacating the above described easements, you are
also requested to approve the proposed Glengrove Industrial Park 5th Addition final plat. Approval
of this subdivision plat will dedicate new drainage and utility easements on the three platted lots
and one outlot shown on the final plat.
The boundary area for the proposed Glengrove Industrial Park 5th Addition is shown on the loca-
tion map below.

Background �
The City Council unanimously approved the Glengrove Industrial Park 5th Addition preliminary I
plat at the May 6, 2015 Council meeting. As reported at that time, the proposed Glengrove
Industrial Park 5th Addition re-subdivides four existing parcels (PINs 20.027.21.41.0009, ,
20.027.21.41.0017, 20.027.21.43.0006, and 20.027.21.42.0008) into three lots and one outlot. j
The Cottage Grove Economic Development Authority will continue to own the 3.5-acre parcel ,
located in the southwest corner of the proposed plat. No changes were made to the size of this I
parcel. Approval of this final plat will legally described the EDA parcel as Lot 1, Block 1, Glengrove ,
Industrial Park 5th Addition. � '

American Logistics (AGCO) is purchasing approximately 9.51 acres of land west of their existing
two properties at 7800 and 7900 97th Street. Their proposed 96,000 square foot building addition i
will extend west of the building at 7800 97th Street. The 9.51-acre parcel and AGCO's property
at 7800 97th Street will be combined together and platted as Lot 1, Block 2 on the proposed ,
Glengrove Industrial Park 5th Addition. The existing AGCO site at 7900 97th Street will be platted �
as Lot 2, Block 2.
Discussion j
The City Engineer is reviewing AGCO's stormwater management plan. It may be necessary that ,
additional drainage and utility easements will be required or modified on the proposed final plat. '
For this reason, the recommended approval of the Glengrove Industrial Park 5th Addition is con- I
tingent on dedicafing all the drainage and utility easements as recommended by the City Engineer
to be shown on the final plat before it is released to the developer for recording. '
A copy of the draft resolution approving the Glengrove Industrial Park 5th Addition final plat is
attached. Approval of the final plat will dedicate new utility and drainage easements on each of
the four parcels and the underlying older easements will no longer needed.
Recommendation

A RESOLUTION VACATING AND DISCONTINUING ALL PUBLIC DRAINAGE AND
UTILITY EASEMENTS ON PROPERTIES AT 7800 AND 7900 97TH STREET SOUTH, '
OUTLOT A OF GLENGROVE INDUSTRIAL PARK 3RD ADDITION, AND '
9700 HEMINGWAY AVENUE SOUTH
WHEREAS, the City of Cottage Grove has applied to vacate and discontinue all public ',
drainage and utility easements on properties at 7800 and 7900 97th Street, Outlot A of
Glengrove Industrial Park 3rd Addition and 9700 Hemingway Avenue South. Utility and drainage
easements proposed to be vacated and discontinued are located upon the following legally ;

That part of the Southeast Quarter of Section 20, Township 27, Range 21,
Washington County, Minnesota described as beginning at a point on the East line of '
said Southeast Quarter distant 768.98 feet South from the Northeast corner of said ';

WHEREAS, a notice of public hearing was published in the South Washington County ,
Bulletin on May 6, 2015, and May 13, 2015; and '
WHEREAS, on May 20, 2015, the City Council held the public hearing on the proposed �
vacation of all public drainage and utility easements on properties at 7800 and 7900 97th Street, ,
Outlot A of Glengrove Industrial Park 3rd Addition and 9700 Hemingway Avenue South; and '
WHEREAS, written or oral testimony was not received from the general public opposing �
said easement vacations.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Cottage Grove,
Washington County, Minnesota, that the drainage and utility easements on the properties
described above are now vacated and discontinued.
BE IT FURTHER RESOLVED, that the City Clerk shall prepare a notice to be presented �
to the Washington County Auditor reflecting the completion of the proceedings herein. �

preliminary plat named Glengrove Industrial Park 5th Addition on April 27, 2015; and ,
WHEREAS, the Planning Commission unanimously (8-to-0 vote) recommended approval
of the preliminary plat on April 27, 2015, subject to certain conditions; and
WHEREAS, the City Council subsequently accepted the Planning Commission's recom- '
mendations and approved the preliminary plat (Resolution No. 2015-059) on May 6, 2015; and

WHEREAS, City staff found the final plat substantially consistent with the approved prelimi- '
nary plat.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Cottage '
Grove, Washington County, Minnesota, hereby approves the final plat application filed by the '
South St. Paul Agri-Properties, LLC for an industrial subdivision plat named Glengrove Industrial ,
Park 5th Addition, subject to the following conditions: (

1. The conditions stipulated in Resolution No. 2015-059, a resolution approving the '
