Proposal
The Planning Commission is requested to consider an amendment to Zoning Ordinance regu-
lations that pertain to retailers of air conditioning, heating, electrical and plumbing, tattoo and
body piercing. The purpose of this proposed amendment is to eliminate the duplication of these
business uses and clarify how these businesses are allowed within a particular commercial
zoning district.
Background
On May 16, 2012, the City Council adopted Ordinance No. 904, a zoning ordinance amendment
that included a table of business uses allowed as permitted, conditional, interim, or accessory
uses within certain commercial zoning districts. Since that time, several business uses were
listed more than once with differing ordinance requirements. For this reason, the proposed
zoning ordinance text amendment is intended to rectify these discrepancies.
Planning Considerations
Plumbing, Heating/Cooling, Electrical Businesses
The current Zoning Ordinance lists plumbing, heating/cooling sales and service in three areas of
the "uses table" for the commercial zoning districts. Because of the differing zoning districts and
whether it is allowed as a permitted or conditional use within a particular commercial district, the
text of the ordinance must be changed to correct the discrepancies.
Title 11, Chapter 1013, Section 1(c), Use Table, currently allows electrical, plumbing, heating/
cooling, appliance, electronics sales and services in the following commercial zoning districts:

As retail uses, allowing electrical, heating/cooling, plumbing as a permitted use in the B-3 or P -B
Districts is not a problem. The question now is what if an electrical, heating/cooling, plumbing
business does more service and repair than retail. In some cases, they might not even have
merchandise displayed for retail sales. The latter use might have sub -contractors and/or em-
ployees that use the business's vehicles that are parked outside or have outdoor storage of new

and used merchandise. Other installation and/or repair services could be painting, roofing,
remodeling, and landscaping activities.
For the Planning Commission's consideration, the draft ordinance amendment proposes to allow
installation and/or repair services as a permitted use as long as there is no outdoor storage of
merchandise or equipment and the number of service vehicles is four or less. If there is outdoor
storage or the number of service vehicles parked at the site are five or more, then the use must
obtain a conditional use permit from the City.
Body Art, Tattoo, Body Piercing
Another discrepancy found in the ordinance pertains to body art, tattoo, and body piercing.
These uses are also regulated in the City's Business Licensing section (Title 3, Chapter 12) of
the City Code whereby licensing requirements and minimum setbacks are required from the
property line, other body art establishments, adult uses, and educational institutions.

The proposed ordinance amendment deletes the "body art" reference since the City Code refer-
ences tattoo and body piercing. Because the performance standard in the zoning code requires
tattoo and body piercing business to obtain a license, it is reasonable to allow this type of
service in the B-2, B-3, and P -B zoning districts.

Recommendation
That the Planning Commission recommends approval to the City Council for the proposed
Zoning Ordinance text amendment that corrects the duplication of certain business uses in Title
11, Chapter 10B, Section 1(c ), Uses Table, for commercial zoning districts.

SECTION 2. SUMMARY PUBLICATION. Pursuant to Minnesota Statutes
Section 412.191, in the case of a lengthy ordinance, a summary may be published.
While a copy of the entire ordinance is available without cost at the office of the City
Clerk, the following summary is approved by the City Council and shall be published in
lieu of publishing the entire ordinance: Combine the air conditioning, heating, plumbing
appliances, upholstery and electrical sales and service uses into two categories. The
first category are businesses with four or less commercial vehicles with storage of
equipment, supplies or materials inside a building as permitted uses and other similar

SECTION 2. SUMMARY PUBLICATION. Pursuant to Minnesota Statutes
Section 412.191, in the case of a lengthy ordinance, a summary may be published.
While a copy of the entire ordinance is available without cost at the office of the City
Clerk, the following summary is approved by the City Council and shall be published in
lieu of publishing the entire ordinance: Combine the air conditioning, heating, plumbing
appliances, upholstery and electrical sales and service uses into two categories. The
first category are businesses with four or less commercial vehicles with storage of
equipment, supplies or materials inside a building as permitted uses and other similar
businesses with more than five commercial vehicles parked outside or store equipment,
supplies or materials stored outside a building as a conditional use. Delete the Body art
establishments since tattoo and body piercing businesses are already listed in the Title
11, Chapter 10B, Section 1(c ) Use Table.
