Instead of platting a portion of the Grove Plaza Shop- ping Center Shopping into two lots as originally proposed in October 2015, the developer now proposes to subdivide the combined 20.548-acre site into three lots and one outlot. The Merchants National Bank site (0.31 acres) is still not part of the revised Grove Plaza 3rd Addi- tion final plat and additional real estate from the ISD #833 District Service Center at 7352 East Point Douglas Road will be added to the redevelopment project. The subdivision plat involves properties generally located at 7210 East Point Douglas Road (former Home Depot) and 7280 East Point Douglas Road (former Rainbow Foods and the retail tenant spaces between the two former anchor retailers). All previously approved findings of i fact and conditions of approval cited in Resolution No. 2015-105 will not change. The purpose in , amending Resolution No. 2015-105 is to acknowledge that the proposed Grove Plaza 3rd Addi- i tion is to replat Lots 1 and 2, Block 1 in the Grove Plaza 2nd Addition into three parcels and one j outlot. Background On October 7, 2015, the City Council unanimously adopted City Resolution No. 2015-105, which � approved five planning applications for the proposed redevelopment of the Grove Plaza Shop- ', ping Center. The site plan review, conditional use permit, interim conditional use permit, and � variance applications referenced in Resolution No. 2015-105 pertain to Hy-Vee's redevelopment plan to demolish a portion of the retail center and former Rainbow Foods building to construct a '; new 92,800 square foot grocery retail store and a 3,100 square foot motor fuel station/convenience store. Hy-Vee is now proposing to acquire the Merchants Bank property and the City is still in the ' process of purchasing approximately 0.69 acres of land from ISD #833's adjoining 7.2-acre site. � This strip of land from Merchants Bank and ISD #833 will be required to be combined Hy-Vee's ' parcel described as Lot 1, Block 1 in the Grove Plaza 3rd Addition. With the completion of these land acquisitions, Hy-Vee will revise their development plan and submit new planning ' applications to the City. I Hy-Vee's development plan is the first phase to redevelop the Grove Plaza Shopping Center. The vacant Rainbow store, vacant American Motor Sports Bar & Grill and former Bingo Hall will ' be razed. The portion of the retail building occupied by Sports Clips and formerly occupied by � Borgstrom's Hallmark and MGM Liquor will remain. � Planning Considerations Property Characteristics The Grove Plaza Shopping Center was initially developed in the early 1970s and has had vari- ( ous commercial uses and development changes since that time. Existing businesses within the Shopping Center share various public and private utilities, parking, signage, ingress/egress drives, landscaping, and stormwater ponding. Residential properties abut the Phase 2 portion of the project. The Turbo Nails/Starbucks and Noodles & Company/AT&T/Chipotle sites will not be impacted by the redevelopment project, with the exception to shared access drives, off-street ' parking, and landscaping. I Final Plat j The project site was previously platted as Grove Plaza 2nd Addition in 2002. With the proposed redevelopment for this site, certain existing utilities and easements on the former Rainbow Foods and former Home Depot parcels were vacated and discontinued with City Council's ap- � proval on October 7, 2015. The revised final plat now proposes a blanket easement over the en- tire area for Lot 1, Block 1 (proposed HyVee site), except for the area where HyVee is proposing to construct their grocery store. As a condition approving the final plat, it will be required that Outlot A in Grove Plaza 3rd Addi- tion and the sliver of land acquired from ISD #833 be combined with the adjoining parcels having the same ownership. This is also required if the Merchants Bank property (PIN '� 17.027.21.21.0047) is acquired by Hy-Vee and incorporated into their redevelopment plans. � The revised final plat for Grove Plaza 3rd Addition is shown below. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Cottage Grove, Washington County, Minnesota, hereby approves the Grove Plaza 3rd Addition final plat filed by Hy-Vee, Inc. and amends City Resolution No. 2015-105 to recognize that said final plat now consists of three platted lots and one outlot for property legally described above and that all the conditions in Resolution No. 2015-105 will continue to remain in effect, subject to the following conditions: 1. The Community Development Director is authorized to approve the proposed lot split from the ISD #833 District Service Center’s property (PIN 17.027.21.24.0004). 2. Outlot A in Grove Plaza 3rd Addition shall be combined with Hy-Vee’s adjoining property before the City of Cottage Grove will issue a Certificate of Occupancy for any building constructed on Lot 1, Block 1, Grove Plaza 3rd Addition. Resolution No. 2016-XXX Page 2 of 2 3. If Hy-Vee, Inc. purchases the Merchant Bank property (PIN 17.027.21.21.0047) to incorporate said parcel into Hy-Vee’s overall development plan, Hy-Vee, Inc. must combine said parcel with their adjoining property before the City of Cottage Grove will issue a Certificate of Occupancy for any building constructed on Lot 1, Block 1, Grove Plaza 3rd Addition. 4. Hy-Vee, Inc. files a new site plan review and conditional use permit applications with the City if their development plan as originally approved by the City on October 7, 2015, is modified. 5. A public hearing must be held by the City to vacate a portion of the drainage and utility easement proposed on Lot 1, Block 1, Grove Plaza 3rd Addition where HyVee’s pro- posed motor fuel station and convenience retail store would be constructed.
