ATTACH MENTS: Description Type Upload Date WAG Farms Easement Agreement CC Memo Cover Memo 4/28/2016 WAG Farms Easement Agreement Exhibit 4/28/2016 Cottage J Grove here Pride and PrOSPerity Meet To: Honorable Mayor and City Council Charlene Stevens, City Administrator From: Ryan Burfeind, P.E., Project Engineer Date: April 28, 2016 Re: Approve WAG Farms Easement Agreement Background As part of the Hadley Avenue & 95th Street Improvement project, the City will be installing an 8-inch sanitary sewer pipe to serve future phases of the Summers Landing Development. This sanitary sewer pipe will run along Hadley Avenue, across the Pine Hill Elementary property, and connect to the 18-inch trunk sanitary sewer pipe in Hamlet Park near the Pine Hill water tower. This sanitary sewer pipe will be installed by both open cut and directional drilling methods. Discussion The final segment of the 8-inch sanitary sewer pipe will run across WAG Farms property, just north of the Pine Hill water tower. In order to construct and maintain the sanitary sewer pipe, the City needs to acquire temporary construction and permanent drainage & utility easements from WAG Farms, Inc. As the sanitary sewer pipe will be installed with an open-cut method in this area, a larger 100-foot temporary construction easement is needed. There will also be a permanent 20-foot drainage & utility easement over the pipe. The City has prepared an easement agreement for the WAG Farms, Inc. easements, which is attached. Easements for the sanitary sewer pipe across the Pine Hill Elementary Property were approved as part of the assessment appeal waiver agreement for Pine Hill Elementary at the Hadley Avenue & 95th Street public hearing on April 6, 2016. Easements for the sanitary sewer pipe on the Swanlunds, Inc. property on the west side of Hadley Avenue are included in the Summers Landing development agreement. Recommendation It is recommended that the City Council approve the easement agreement with WAG Farms, Inc. i 1 I ' EASENIENT AGREEMEI'T' F(?R CC3NSTRUCTICIN ANI►DFtANAGE AN1TILIT'SPURI'tJSE '1CHIS EASEMENT AGREEMENT F(JR CtNSTRUC'FICIl ,N.1 UTILITY PURFCISES {Easement) is mde, grantel and cozveyed tlais day of , {?16, by and between WAG Farxas, Inc., a Minnesota corporaticn (hereinafter referred t+ as `<Landovvner"} and te City of Ccitage C"rrcve, a znunicipai corporatiorz organ%zed under the aws Qf fihe State cf Minresota(hereinafter referredo as"it").
