This area along Kimbro Avenue is zoned as R-1, Rural Residential. State Statute 169.011 Subd. 69a defines a rural residential district as a territory contiguous to and including any city street or town road that is built up with visible dwellings situated at intervals of 300 feet or less for a distance of a quarter of a mile or more. The distance between the proposed 30 MPH and 50 MPH zones is approximately 2,500 feet with an average driveway spacing of 277 feet. Due to this, the placement of a 35 MPH speed limit zone in this area was proposed. Upon review Figure 2 of the proposed speed limits for Kimbro Avenue, the Public Services Commission was concerned with the possible confusion drivers may have with the speed limit reducing from 50 MPH to 35 MPH, and finally to 30 MPH in Old Cottage Grove. The recommendation of the Commission was to have the speed limit reduce to 30 MPH instead of 35 MPH, eliminating the 35 MPH zone. It was discussed at the meeting that the State Statute on speed limits would need to be reviewed to ensure the 30 MPH zone would be allowed. There was one resident who lives on Lamar Avenue in Old Cottage Grove that spoke at the meeting on this subject. They were in support of the reduced speed limit on Kimbro Avenue south Honorable Mayor, City Council and Charlene Stevens Kimbro Avenue & Lamar Avenue Speed Limits May 11, 2016 Page3of3 of Old Cottage Grove, citing concerns of increased traffic on Kimbro Avenue and Lamar Avenue, along with children waiting for the bus on Kimbro Avenue. The resident was also in support of a continuous 30 MPH zone, rather than the intermediate 35 MPH zone on Kimbro Avenue. The Public Services Commission unanimously (10-to-0 vote) recommended to the City Council to approve the proposed changes to the speed limit on Kimbro Avenue and Lamar Avenue, with the change of the proposed 35 MPH zone to a 30 MPH zone. Minnesota Statute 169 has been reviewed regarding the Public Services Commission recommen- dation to post the speed limit on Kimbro Avenue at 30 MPH instead of the proposed 35 MPH. State Statute 169.14 Subd. 2 (1) allows the posting of a 30 MPH zone in an "urban district." Section 169.011 subd. 90 defines an "urban district" as territory contiguous to and including any city street or town road that is built up with structures devoted to business, industry, or dwelling houses situated at intervals of less than 100 feet for a distance of a quarter of a mile or more. Based on this requirement, there would be insufficient driveway spacing to support the recommended 30 MPH zone on Kimbro Avenue south of Old Cottage Grove. Due to this, the 35 MPH zone is still recommended as shown in Figure 2.
