1. CALL TO ORDER
The City Council of the City of Cottage Grove, Washington County, Minnesota, held a
regular meeting on May 4, 2016 at Cottage Grove City Hall, 12800 Ravine Parkway.
Mayor Bailey called the meeting to order at 7:00 p.m.
2. PLEDGE OF ALLEGIANCE
The audience, staff, and Mayor and City Council Members recited the Pledge of
Allegiance.
3. ROLL CALL
The following were present: Mayor Myron Bailey, Council Member Steve Dennis,
Council Member Justin Olsen, Council Member Jen Peterson, Council Member Dave
Thiede.
Also present were: Charlene Stevens, City Administrator; Korine Land, City Attorney-
LeVander, Gillen & Miller, PA; Les Burshten, Public Works Director; Joe Fischbach, HR
Manager/City Clerk; Jennifer Levitt, Community Development Director/City Engineer;
Sharon Madsen, Communications Coordinator; John McCool, Senior City Planner;

4. OPEN FORUM
Mayor Bailey asked if anyone in the audience wished to address the Council on any
item that was not on the agenda. As no one wished to address the Council, Mayor
Bailey closed the Open Forum.
5. ADOPTION OF AGENDA
Motion by Council Member Olsen, second by Council Member Thiede, to adopt the
agenda. Motion carried: 5-0.

A. Presentation by Area High Schools' Robotics Teams
Engineer Levitt stated the City of Cottage Grove has sponsored the Robotics
Teams and provided them with practice space. Bradley Cho, from Team 3130 of
East Ridge High School, stated his school along with Park High School,
Woodbury High School, and the Math & Science Academy are involved in
robotics competitions, sponsored by the program FIRST (For the Inspiration and
Recognition of Science & Technology), whose aim is to inspire young minds to
pursue careers in engineering, science, technology, and math. Students work
side by side with adult mentors to create a 120-pound robot in six weeks. There
is then a seven-week competition season; some competitions take place in the
United States, others take place in various parts of the world. Doug Jensen, a
mentor for the Robotics Teams, addressed the Council and thanked them for the
practice space provided. Team 3130 then provided a robotics demonstration for
the Council. Photographs were taken with the Council Members and the
Robotics Teams after the Council Members were presented with shirts.

A. Approve the 4/06/2016 City Council Special Meeting Minutes.
B. Approve the 4/06/2016 City Council Regular Meeting Minutes.
C. Receive and Place on File the approved minutes for the Public Service
Commission Meeting on 3/21/2016.
D. Approve the 3/28/2016 Planning Commission Regular Meeting Minutes.
E. Adopt Resolution 2016-083 proclaiming May 15 - 21, 2016 as National
Public Works Week.
F. Adopt Resolution 2016-084 proclaiming May 2 - 6, 2016 as National
Teacher Appreciation Week.
G. Adopt Resolution 2016-085 proclaiming Sunday, May 15, 2016, as
Police Officers' Memorial Day and the week of May 15 - May 21, 2016 as
National Police Week.
H. Adopt Resolution 2016-086 proclaiming May 15 - 21, 2016 as National

I. Approve the second amendment to Gardenworld's purchase agreement.

L. Adopt Resolution 2016-088 approving a variance to allow a 540 square
Foot detachable accessory structure on a residential property less than
five acres to be located closer to the front property line than the principal

P. 1) Adopt the Resolution 2016-090 approving the final plat for Summers
Landing 1 st Addition; and 2) Approve the Development Agreement for
Summers Landing.
Q. Adopt Resolution 2016-091 approving the plans & specifications and
establishing a bid date for the Hadley Avenue & 95th Street
Improvements.
R. Appoint Scott Merkel and James Warrington to the position of Executive

Council Member Olsen wished to pull Item E, Council Member Peterson wished to pull

wished to pull Item H for further comments and/or discussion.
Council Member Thiede read the proclamation for National EMS Week, from May 15 to
21, 2016, in the City of Cottage Grove.
Council Member Dennis read the proclamation for National Police Week, from May 15
to 21, 2016, in the City of Cottage Grove, and Sunday, May 15, 2016 as Police Officers'
Memorial Day in the City of Cottage Grove.
Council Member Olsen read the proclamation for National Public Works Week, from
May 15 to May 21, 2016, in the City of Cottage Grove.
Council Member Peterson read the proclamation for National Teacher Appreciation
Week, from May 2 to 6, 2016, in the City of Cottage Grove.
Motion by Council Member Dennis to approve the Consent Agenda, second by Council
Member Thiede. Motion carried: 5-0.
8. APPROVE DISBURSEMENTS
A. Approve payment of check numbers 195919 to 196109 in the amount of
$546,741.88 and EFT Payments of $174,879.87.
Motion to approve disbursements by Council Member Olsen, second by Council
Member Thiede. Motion carried: 5-0.

1) Hold a public hearing to vacate and discontinue existing public utility and
drainage easements located within Lots 1 and 2, Block 2, Frattalone's Southpoint
Ridge Addition; 2) Adopt Resolution 2016-092 approving the vacation and
discontinuance of all drainage and utility easements within Lots 1 and 2, Block 2,
Frattalone's Southpoint Ridge Addition and authorize the City Clerk to prepare a
notice of completion; 3) Pass Ordinance 961 rezoning 1.633 acres of land at
7007 East Point Douglas Road from B-2 to B1 with a Planned Development
Overlay (PDO) and amending Res. No. 07-032, to change the approved
Southpoint Ridge PDO Master Plan by replacing office buildings with a senior
housing development; 4) Adopt Resolution 2016-093 approving the Atkinson
Corner preliminary plat; 5) Adopt Resolution 2016-094 approving the Atkinson
Corner final plat; 6) Adopt Resolution 2016-095 approving the site plan review
and conditional use permit for an affordable senior housing rental apartment
project.
Planner John McCool stated the property is located to the southwest of East
Point Douglas Road and lies northeast of the northbound entrance ramp of
Highway 61, and to the north of 80th Street. The Hill-Gibson House is located on
the 1.6 acres of land that is being rezoned. He reviewed the easements that
were going to be vacated and discontinued as well as the new easements for
drainage and utility. Planner McCool reviewed the 184-unit building structure;
proposed as 73 one-bedroom units, 79 two-bedroom units, and 32 three-
bedroom units. Also included are a lounge, offices, library, club room, a social
kitchen room area, a fitness area, a TV theater room, and a salon. There are
132 parking spaces in the lower level of the structure. There are nine parking
spaces along East Point Douglas Road. There will be a retaining wall, ranging
from 1-to-2 feet to 10-to-11 feet in height, along Highway 61. Planner McCool
reviewed the building materials, color schemes, and landscaping plans.
Council Member Thiede asked about the status of the Hill-Gibson house;
Engineer Levitt stated the Preservation Alliance of Minnesota is currently working
on relocation plans, looking at other vacant lots to relocate the house. Dominium
has also been working with them, so the elements are being worked on.
The Applicant, Patrick Ostrom with Dominium, 2905 Northwest Boulevard,
Plymouth, MN, asked if the Council had any questions. Mayor Bailey asked
about the construction start date and when people would be able to move in; Mr.
Ostrom stated they'd be submitting plans for a building permit approval in mid-
June, financing would be secured in early August, so construction would start in
late August, early September, with a projected 14-month construction schedule;
therefore, the building should be completed in October, 2017.
Mayor Bailey asked him to elaborate on the Hill-Gibson House. Mr. Ostrom
stated they were looking to salvage some pieces of the house and incorporate

those into their new development. Council Member Olsen asked Mr. Ostrom to
give specifics on the affordable housing and who citizens could contact if they
were interested. Mr. Ostrom stated the units are restricted to people 55+ years in
age; there are also income limitations determined by HUD. For a single person
the maximum income limit is $36,000, and the rent is also limited; a one-bedroom
is approximately $900. He believed their buildings were high quality, and if there
were no rent restrictions, the rent would be substantially more. It is independent
living only, so there are no assisted-living or memory-care services available. If
people want more information, they should go to the website
www.dominiumapartments.com, and click on Minnesota, to see other recently-
completed projects. They're not yet accepting applications, but people could be
put on an interested waiting list. Council Member Peterson asked if Dominium
would be eligible to apply for any CDBG Funds. Mr. Ostrom stated they had not
applied for the CDBG Funds, as they had spoken with Washington County early
on and there wasn't much money available. The uses of those funds are also
somewhat restrictive, so it just didn't fit for the project. Mayor Bailey stated that
Council and staff were able to tour some of Dominium's properties and they were
very excited with what they saw.
Mayor Bailey opened the public hearing; as no one wished to speak, Mayor
Bailey closed the public hearing.
Motion by Council Member Dennis to adopt Resolution 2016-092 to approve the
vacation and discontinuance of all drainage and utility easements within Lots 1
and 2, Block 2, Frattalone's Southpoint Ridge Addition, and authorize the City
Clerk to prepare a notice of completion; Pass Ordinance 961, rezoning 1.633
acres of land at 7007 East Point Douglas Road from B-2 to B1, with a Planned
Development Overlay and amending Resolution No. 07-032, to change the

B. City of Cottage Grove Multifamily Housing Revenue Note Series 2016
Adopt Resolution 2016-096 regarding issuance of Revenue Obligations to
finance a Multifamily Housing Development in the City and related actions.
Finance Director Robyn Roland stated, under State Statute Chapter 62C, the
City of Cottage Grove is allowed to provide for the issuance of revenue bonds to
fund multifamily housing developments located within the City. The City of
Cottage Grove acts as the sponsor of the multifamily housing notes; however,
the City is not responsible for the repayment of the debit. The City can have the

bond series issued as taxable or tax exempt obligations in an aggregate principal
amount not to exceed $25,000,000 for the benefit of the borrower for the
purposes of financing the acquisition, construction, and equipping of an
approximately 184-unit senior housing facility and functionally related facilities, to
be located at 7007 East Point Douglas Road. As a condition of the proposal, the
City Council must adopt a housing program under the State Statute. The City
Council called for the public hearing and an appropriate notice was published.
The City Council will take testimony regarding this program and then vote to
possibly approve. The revenue funding will come back from Dominium after all
of the funding is effectively in place. Council will see this matter again before it is
finalized. The action requested after the public hearing is to grant the preliminary
approval. Sofia Lykke of Kennedy & Graven is acting as the City's bond counsel
regarding this program. There is effectively no cost to the City; there is a fee that
the City will charge for these bonds regarding the issuance of the debt. All costs
will be reimbursed by the party for whom the Council is issuing the debt.
Mayor Bailey opened the public hearing; as no one wished to address the
Council on this matter, Mayor Bailey closed the public hearing.
Motion by Council Member Olsen to approve Resolution 2016-096 regarding
issuance of Revenue Obligations to finance a Multifamily Housing Development
in the City and related actions, second by Council Member Peterson. Motion
carried: 5-0.
C. Eastridge Woods 5th Addition
1) Hold a public hearing to vacate and discontinue existing public utility and
drainage easements located within Lot 1, Block 1 in Eastridge Woods 4th
Addition; 2) Adopt Resolution 2016-097 approving the drainage and utility
easement vacations; 3) Pass Ordinance 961 rezoning 1,633 acres of land at
7007 East Point Douglas Road from B-2 to B-1 with a Planned Development
Overlay (PDO) and amending Res. No. 07-032, to change the approved
Southpoint Ridge PDO Master Plan by replacing office buildings with a senior
housing development; 4) Adopt Resolution 2016-093 approving the Atkinson
Corner preliminary plat; 5) Adopt Resolution 2016-094 approving the Atkinson
Corner final plat; and 6) Adopt Resolution 2016-095 approving the site plan

Planner McCool stated this project will add eight new detached single-family lots
to a development known as Eastridge Woods, and that is being developed by
D.R. Horton.

Motion by Council Member Thiede to Adopt Resolution 2016-097 approving the
drainage and utility easement vacations; Pass Ordinance 962 changing the
zoning classification of 3 acres of land at 9905 Military Road from AG-1 to R-
3/PDO; Pass Ordinance 963 amending Ordinance No. 913, which approved the
Eastridge Woods Planned Development Overlay Master Plan, to add eight
detached single-family lots to the Eastridge Woods subdivision; Adopt Resolution
2016-098 approving the Eastridge Woods 5th Addition preliminary plat; Adopt
Resolution 2016-099 approving the Eastridge Addition 5th Addition final plat;
Approve the Eastridge Woods 5th Addition development agreement; and Adopt
Resolution 2016-100 approving the Eastridge Woods 5th Addition final
construction plans & specifications; second by Council Member Peterson.
Motion carried: 5-0.
10. BID AWARDS
A. Summers Landing 1 st Street, Utility, and Lighting Improvements Bid Award
Adopt Resolution 2016-101 awarding the bid for the Summers Landing 1 st
Street, Utility, and Lighting Improvements Project to Friedges Contracting, Inc. in
the amount of $1,035,602.70.
Engineer Levitt stated grading is underway and the developer is very anxious for
this project to start. The bids are for the utilities and streets in that subdivision.
The costs for the bid that will be awarded are borne by the developer and not the
City of Cottage Grove. All of the expenses will be assessed against the property.
There were 12 contractors who bid on the project; Friedges Contracting, Inc. had
the low base bid of $1,035,602.70, which compares favorably against the
engineer's estimate for the project.
Council Member Thiede asked Engineer Levitt to explain a bit more about the
process; she explained the developer has petitioned the City of Cottage Grove to
construct the utilities. They have waived all of their objections to those
assessments and have agreed that the incurred project costs (engineering, legal,
and administrative) will be put into the assessment against those properties. The
City of Cottage Grove is not expending dollars to facilitate this construction.
Motion by Council Member Olsen to adopt Resolution 2016-101 awarding the bid
for the Summers Landing 1 st Street, Utility, and Lighting Improvements Project to
Friedges Contracting, Inc. in the amount of $1,035,602.70, second by Council
Member Thiede. Motion carried: 5-0.

Council Member Dennis stated he had received positive feedback from a
juvenile, Caleb, who was eating lunch, as were some Cottage Grove Firefighters,
at Carbone's. Caleb had received a card from the Firefighters that contained a
photo of one of the fire trucks; that gesture made his day. Another one of
Council Member Dennis' neighbors spoke to him how great the walking paths are
in Cottage Grove.
Council Member Olsen stated Saturday, May 7, is the annual Spring Clean Up
Day event at Cottage Grove Public Works, 8635 West Point Douglas Road
South. Hazardous waste, appliances, car batteries, etc. will be accepted; there is
a nominal fee for some items. Questions can be directed to 651-458-2808.
Council Member Olsen stated the Arbor Day Event at Arbor Meadows Park took
place last Saturday; it was very well attended. He thanked the Girl Scouts for
providing snacks for the event. Administrator Stevens and her family were also
there, as well as other City staff inembers; he thanked Public Works for putting
the event together and thanked the public who attended.
Council Member Olsen stated the City had closed on the sale of the Home Depot
building; he wanted the public to know how much work the City staff and Mayor
Bailey had done over the last seven years to make that happen. He thanked
them for all of their work.
Council Member Olsen stated there are a lot of new projects going on in the City
of Cottage Grove; he knew many people were putting in long hours to get things
done. Engineer Levitt stated in addition to the individuals mentioned by Council
Member Olsen, she felt a big thank you to the City' legal team was in order. She
said it was a team effort getting all of the new projects accomplished. Mayor
Bailey stated Finance Director Roland also deserved a lot of credit for her work
on keeping track of the money for these projects and where it could be obtained.
Attorney Land was also recognized for her work to make sure closings took place
on time on various projects. Administrator Stevens was acknowledged for her
work to help get all of the projects completed. Council Member Olsen stated
Director Woolery had also functioned as Interim City Administrator and had done
well in that position. Council Member Olsen stated it's wonderful to see all of the
things happening in the City and gave credit to all involved for their hard work.
Council Member Thiede stated there was an article in the Minneapolis-St. Paul
Business Journal today that said the next Hy-Vee was going into Shakopee;
Cottage Grove wasn't even listed, so he e-mailed the author of the article
regarding that. The author stated he would be printing a correction.
Council Member Peterson stated Fare For All, a nonprofit organization, will host
a discount meat and fresh produce event in Cottage Grove on Thursday, May 12,

at All Saints Church. All proceeds benefit The Food Group, a nonprofit
organization.
Council Member Peterson stated on May 21 the fourth annual Standing Strong
5K Run/Walk will take place at Hamlet Park. It's a fundraiser to help raise
awareness of bullying; it will benefit Middle Schools in South Washington County.
The Cottage Grove Lions are very involved in that event as well.
Council Member Peterson stated on May 30, the third annual Memorial Day
ceremony will take place right outside City Hall, at the Veterans Memorial. She
encouraged everyone to attend.
Council Member Peterson stated they're doing some fundraising for the Inclusive
Playground at Woodridge Park. If you go to the City's website, www.cottaqe-
qrove.orq, under departments, click on Park & Rec, go to that page, and it's the
first link there that says, "Donate Today to the Inclusive Playground." She
encouraged people to donate whatever they can, donate often, or donate in
memory of or in honor of somebody.
Council Member Thiede stated the Strawberry Fest will take place on June 16
through June 18, Thursday through Saturday. More information can be found at
www.cottaqeqrovestrawberryfest.com regarding events, contests, the parade,
and entertainment. More craft booths will be added. He encouraged everyone to
attend.
Mayor Bailey stated on Mother's Day, May 8, at River Oaks Golf Course, moms
play free with a paid green fee. Tee times can be booked at
www.riveroaksmuniqolf.com or call 651-438-2121, Extension 3. All of that
information is also on the web page and Facebook or contact any Council
Member.
Mayor Bailey stated on May 13, at the River Oaks Golf Course there will be two
Improv Comedy shows, admission is $10; the 7:00 p.m. show is for families and
the 9:00 p.m. show is an adult show. He encouraged the public to attend.
Mayor Bailey stated on May 15, at the River Oaks Golf Course, the Riverbend
Auto Club's 8th Annual Car Show will take place; he encouraged people to
attend.
Mayor Bailey stated on May 19, the Rivertown Cakes Bakery Boutique will have
a ribbon-cutting ceremony. He encouraged citizens to support that local
business.

Mayor Bailey stated on the evening of May 19 the Night to Unite informational
Picnic, hosted by the Public Safety Department, will take place at Woodridge
Park.
Mayor Bailey stated a new event will take place on May 22; a 22 a Day is Too
Many Run/Walk, to raise awareness of veteran suicides. That will take place at
the Cottage Grove Armory, 8180 Belden Boulevard. All proceeds will help raise
awareness of veteran suicides.
