Burbank, Senior Planner DATE: July 8, 2016 RE: Cottage Grove Local Historic Register Procedure Review — Part II Introduction At the last ACHP meeting the subject of the registration process for the City's Local Register of Historic Sites and Landmarks (RHSL) was discussed. The following is a follow up and summary of that discussion. Discussion At the May 10, 2016, meeting, the ACHP held discussions on the RHSL registration procedures (listed below) and did not identify any glaring deficiencies. The ACHP did note that considerations of the Future Land Use of the site should be a factor in the registration process. It was also noted that with the RHSL program currently being a volunteer program, establishing a financial incentive program that would encourage owners of registered properties to maintain the historic character of registered properties could be a sound action to pursue. Registered properties is a key point in that discussion as the ACHP felt that if incentive programs were avail- able, and registration was a participation requirement, it could have a positive effect on the health of the historic housing stock in the community. Deed restrictions and other sureties were dis- cussed as necessary tools to ensure program success. The group was also concerned that too onerous criteria could have a detrimental effect on a program. Historic reserve funds, tax breaks, and revolving load funds were all items that were suggested. Logistics and funding sources of this type of program would take some time to research and implement if found to be feasible and practical. Ordinance Criteria The existing ordinance criteria is listed below. 9-9-4: DESIGNAWN OF HISTORIC SITES AND LANDMARKS: A. Procedures: The city council, upon the request of the advisory committee on historic preserva- tion, may by resolution designate a historic site, landmark, or historic district. Prior to such des- ignation, the city council shall hold a public hearing, notice of which shall have been published in a newspaper of general circulation at least ten (10) days prior to the date of the hearing; notice of the hearing shall also be mailed to all owners of property which is proposed to be designated as a historic site, landmark or historic district and to all property owners within one hundred meters (100 m) of the boundary of the area to be designated. B. Eligibility Criteria: In considering the designation of any area, site, place, district, building or structure in the city as a historic site or landmark, the advisory committee on historic preserva- tion shall consider the following factors with respect to eligibility: 1. Its character, interest, or value as part of the history or cultural heritage of the city, the state or the United States; 2. Its association with persons or events that have made a significant contribution to the cultural heritage of the city; 3. Its potential to yield information important in history or prehistory; 4. Its embodiment of distinguishing characteristics of architectural type or style, or elements of design, detail materials or craftsmanship; and 5. Its unique location or singular physical appearance representing an established or familiar visual feature of a neighborhood or community of the City. (1971 Code § 13A-4) Based on recent RHSL reviews and the ACHP discussion, the following language changes to the existing ordinance criteria are suggested - 9 -9-4: DESIGNATION OF HISTORIC SITES AND LANDMARKS: A. Procedures: The city council, upon the request of the advisory committee on historic preservation, may by resolution designate a historic site, landmark, or historic district. Eligibility Criteria: In considering the designation of any area, site, place, district, build- ing or structure in the city as a historic site or landmark, the advisory committee on historic preservation shall consider the following factors with respect to eligibility: 1. Its character, interest, or value as part of the history or cultural heritage of the city, the state or the United States; 2. Its documented association with persons or events that have made a significant contribution to the cultural heritage of the city, Advisory Committee on Historic Preservation Historic Registration Guidelines and Procedures July 8, 2016 Page 3 of 3 3. Its potential to yield information important in history or prehistory and for that infor- mation to be readily evident, available and accessible to the general public, 4. Its state of condition being in good repair and having been completed in a good workmanship manner; 5. Its potential to be negatively impacted by the future land use of the site as adopted in the current approved City Comprehensive-plan- 6. omprehensiveplan: 6. The structure property having a positive tax value: 4. 7 Its embodiment of distinguishing characteristics of architectural type or style, or elements of design, detail materials or craftsmanship; and 5-. f, Its unique location or singular physical appearance representing an established or familiar visual feature of a neighborhood or community of the City. (1971 Code § 13A-4) 9. Its ability to continue as a viable component of the existing_ and future landscape of the community. Recommendation That the ACHP continue the discussion process on the nomination process to the Local Register of Historic Sites and Landmarks and make a recommendation to the City Council.
