Budget Implication N/A Attachments Council Memo Roundabout Layout Intersection Maintenance Agreement TO: Honorable Mayor and City Council Charlene Stevens, City Administrator FROM: Jennifer Levitt, Community Development Director/City Engineer DATE: July 14, 2016 RE: Intersection Maintenance Agreement with Washington County for 70th Street & Jamaica Roundabout Background/Discussion The City of Cottage Grove and Washington County under a separate agreement agreed to construct a roundabout at CSAH 22 (70th Street) and Jamaica Avenue South. The construction of this improvement is currently underway and will be completed this fall. The next step of the project is to outline the roles and responsibilities for the maintenance of the new improvements. The attached agreement outlines the agency responsibilities for maintenance. The City is responsible for all landscaping, irrigation, and decorative lighting in the center of the roundabout and in the medians. The County is responsible for the roundabout’s concrete, pavement, curbs, storm sewer, pavement markings, and signs. The County will own the street lights and the City will perform minor maintenance on the street lighting. The City can chose to perform snow removal on the sidewalks and trails at the roundabout; the County will be responsible for snow plowing within the roundabout drive lanes. The conditions and maintenance requirements of this agreement are consistent with the maintenance agreement that was executed at CSAH 22 and CSAH 19. DEPT. PUBLIC WORKS AND THE CITY OF COTTAGE GROVE DIVISION TRANSPORTATION FOR MAINTENANCE OF A ROUNDABOUT TERM PERPETUAL AT THE INTERSECTION OF COUNTY STATE AID TH HIGHWAY NO. 22 (70 ST S) AND JAMAICA AVE S THIS AGREEMENT made and entered into by and between the County of Washington, a political subdivision of the State of Minnesota, hereinafter referred to as the "County" and the City of Cottage Grove, Minnesota, a municipal corporation, hereinafter referred to as the "City"; WHEREAS , the County and City have, via separate agreement, agreed to construct a roundabout at th the intersection of County State Aid Highway (CSAH) No. 22 (70 Street South) and Jamaica Ave South in the City of Cottage Grove; WHEREAS , the County and City will share in the maintenance costs of the roundabout intersection as hereinafter set forth; NOW THEREFORE, IT IS AGREED AS FOLLOWS: 1. This agreement shall apply only to roundabout intersection located at the intersection of CSAH th 22 (70 Street South) and Jamaica Avenue South in the City of Cottage Grove. 2. This agreement shall supersede any and all prior agreements between the City and the County related to the maintenance of the roundabout at the intersection of Jamaica Avenue South and CSAH 22 (70th Street South). 3. The County shall, at its sole cost and expense, maintain all signing, pavement markings, and roadway pavement, curbs, and medians at the intersection including the roundabout truck apron and adjacent pedestrian crosswalks, except that the City shall, at its sole cost and expense, maintain all signing, pavement markings, roadway pavement, curbs and medians located beyond the pedestrian crosswalks located on Jamaica Avenue South, and shall furthermore provide for snow, ice, and debris removal for the roadway areas located north and south of the inscribed circle diameter of the roundabout. 4. The City shall, at its sole cost and expense, provide for the minor maintenance of the overhead street lights constructed as part of the roundabout construction project and all their components, including cleaning and relamping the luminaires and painting the lighting facilities, and shall pay all monthly electrical service expenses necessary to operate the overhead street lights. The County shall be the owner of the overhead street lights constructed as part of the roundabout construction project and all their components, and shall, at its sole cost and expense, keep in repair the electrical wiring from the electrical meter to the luminaire heads and provide replacement of the overhead street light support structures if necessary, and shall provide Gopher State One Call System locates for the street lighting underground components. 5. The City shall, at its sole cost and expense, maintain and keep in repair all roundabout landscaping features within the circular central island including the aesthetic accent lighting, except that the County may, at its option and sole discretion, mow the central island to maintain roadway safety in the event that the landscaping becomes neglected by the City to such a degree that vegetation growth creates becomes a safety concern. \\\\cocg-fs1\\groups\\CITYFILES\\13 CITYFILES\\Jamaica Ave (70th to Military Road)\\Public Meetings\\22JamaicaRoundaboutMaintenance 2016 v3.docx Page 1 of 2 6. The County shall own and maintain all storm sewer trunk lines and catch basins and leads constructed as part of the roundabout project construction, to the county right-of-way boundary. The City shall own and maintain laterals and drains constructed under this project which service property outside the County road right of way, including drains servicing any ponding easements. 7. The County shall, at its sole cost and expense, maintain and keep in repair all adjacent trails sidewalks installed as a part of the roundabout project construction, excluding areas located outside of county right-of-way, including but not limited to pavement maintenance and replacement, mowing, and any other maintenance activities necessary to perpetuate the trails and sidewalks in a safe and usable condition, except that the City shall, at its sole cost, expense, and discretion, be responsible for winter snow and ice removal control for all such trails and sidewalks. 8. Any and all persons engaged in the aforesaid work to be performed by the County shall not be considered employees of the City, and any and all claims that may or might arise under the Workmen's Compensation Act of this State on behalf of said employees while so engaged, and any and all claims made by any third party as a consequence of any act or omission on the part of said employees while so engaged on any of the work contemplated herein shall not be the obligation and responsibility of the City. The County shall not be responsible under the Workmen's Compensation Act for any employees of the City. 9. The parties hereby declare that the activities under this agreement are a single joint enterprise for the purposes of Minnesota Statute 471.59 subd. 1a.; and, under this agreement, for purposes of determining total liability for damages, the parties shall be considered a single government unit as specified in Minnesota Statute 466.04 subd. 1. Moreover, each party affirmatively states that it shall only be liable for the acts and omissions of its officers or employees and not for the acts or omissions of the employees or officers of the other.
