No public hearing was held, as it was scheduled for the August 10 City Council meeting. The Planning Commission had a general discussion on the topic, which is detailed in the attached minutes excerpt. After the discussion, the Planning Commission, on a 6-to-1 vote, recommended that the City Council adopt the proposed ordinance amendment. The reasoning for the nay vote was because one of the fastest growing housing sectors is for the 65-plus generation. This type of housing is one of the options for affordable long-term care. It was also noted that the dwellings would be temporary. Review Period This application was initiated by the City, so the required 60-day review period is not applicable. Background During the spring of 2016, the State Legislature passed a law (Minn. Stat. § 46.3593) requiring cities to allow "temporary health care dwellings," which are an accessory dwelling unit (ADU) but for the purposes of caring for mentally or physically impaired relatives or their caregivers on a temporary basis. The law also defines family members. An informational packet on the topic was created by the League of Minnesota Cities (LMC) and is attached for reference. The new law only applies to housing that is used solely to care for a family member who is im- paired in some way. The law also permits cities to opt out of the law if they do not want to allow these health care dwellings. The deadline for cities to opt out is September 1, 2016. Discussion The Planning Commission is requested to discuss this topic and determine if the City should per- mit the temporary health care dwellings or adopt the proposed ordinance approving a zoning text amendment to prohibit temporary health care dwellings and to clarify that the City of Cottage Grove is opting out of the requirements of Minnesota Statutes, Section 462.3593 The City Council will hold the public hearing at their August 10, 2016, meeting in order to comply with the established deadline. Comprehensive Plan— Future Land Use Designation The law requires that the temporary family health care must be located on the property in which the caregiver or relative lives, thus delegating it to land use districts that permit residential uses. Zoning The proposed zoning text amendment would prohibit temporary family health care dwellings within all zoning districts in the City. Existing Site Conditions Not applicable with this application. Public Hearing Notices The public hearing notice was published in the South Washington County Bulletin on July 13, 2016. Summary The logistics of regulating temporary family health care dwellings in Cottage Grove was discussed by the City's Technical Review Committee and it was determined to be burdensome and not in the best interest of the community as a whole. Findings The established findings for approving the ordinance prohibiting temporary health care family dwellings in any zoning district and opting out of the requirements of Minnesota Statutes, Section 462.3593 are as follows: 1. The logistics of regulating temporary family health care dwellings in Cottage Grove would be burdensome. 2. The establishment of unmonitored temporary power and utility connections would be hazardous and dangerous, and could compromise health and safety. 3. The current ordinance prohibits structures in the front of a principle structure on properties less than five acres. 4. The loss of required on-site parking if units are parked in the driveway. 5. The negative visual impact on adjacent properties. 6. Most of the existing residences constructed in Cottage Grove have sufficient square footage and bedroom space to accommodate temporary family health care within the principal structure. 7. The potential burden on Public Safety services for unsupervised ailing people within the temporary health care dwellings. Recommendation 1) Hold a public hearing. 2) The Planning Commission recommends that the City Council adopt an ordinance for the City of Cottage Grove opting out of the requirements of Minnesota Statutes, Section 462.3593 and prohibiting temporary health care family dwellings in any zoning district. XXX AN ORDINANCE FOR THE CITY OF COTTAGE GROVE, MINNESOTA, OPTING OUT OF THE REQUIREMENTS OF MINNESOTA STATUTES, SECTION 462.3593, TEMPORARY FAMILY HEALTH CARE DWELLINGS The City Council of the City of Cottage Grove, Washington County, Minnesota, does hereby ordain as follows: WHEREAS, on May 12, 2016, Governor Dayton signed into law the creation and regulation of temporary family health care dwellings, codified at Minn. Stat. § 46.3593, which permit and regulate temporary family health care dwellings; and WHEREAS, subdivision 9 of Minn. Stat. § 46.3593 allows cities to “opt out” of those regulations. NOW THEREFORE BE IT RESOLVED, the City Council of the City of Cottage Grove, Washington County, Minnesota, hereby ordains as follows: SECTION 1. AMENDMENT . Pursuant to authority granted by Minnesota Statutes, Section 462.3593, subdivision 9, the City of Cottage Grove opts out of the requirements of Minn. Stat. § 46.3593, which defines and regulates Temporary Family Health Care Dwellings. SECTION 2. AMENDMENT . “The Code of the City of Cottage Grove, County of Washington, State of Minnesota,” shall be amended by amending Title 11-1-3, Rules of Word Construction; Definitions, to read as follows: Title 11-1-3: Rules of Word Construction; Definitions. TEMPORARY FAMILY HEALTH CARE DWELLINGS: Transitional housing on a relative’s or caregiver’s property for those with mental or physical impairments and aging family members who need short-term care. SECTION 3. AMENDMENT . “The Code of the City of Cottage Grove, County of Washington, State of Minnesota,” shall be amended by amending Title 11-3-3, Accessory Structures, to read as follows: Title 11-3-3E: Miscellaneous Requirements. 9. Temporary Family Health Care Dwellings are prohibited in all zoning districts. SECTION 4. SUMMARY PUBLICATION . Pursuant to Minnesota Statutes Section 412.191, in the case of a lengthy ordinance, a summary may be published. (The Public Hearing will be held by the City Council on August 10, 2016.) Burbank summarized the staff report and recommended approval. Haagsman asked if other cities have been opting out. Burbank responded that staff will have more information on that prior to this proposed ordinance going to the City Council. He noted that there is a deadline of September 1, 2016, to opt out per State Statute. Graff made a mofion to approve the zoning text amendment. Rostad seconded. Graf stated that in his profession as a real estate broker in the State of Minnesota, he had an opportunity to take continuing education that discussed these facilities, and one of the fastest growing sectors for housing, including these, are the 65-plus generation. One of the things discussed is the afFordability of long-term care for those individuals and these were presented as an option. He is a little discouraged that we are looking at curtailing them completely. He understands that there may some difficulty in allowing them but they are temporary facilities and afFordable for people looking to take care of their loved ones' end of life needs.
