COTTAGE GROVE CITY COUNCIL December 21 , 2016

REGULAR MEETING - 7:00 P.M.
1. CALL TO ORDER
The City Council of the City of Cottage Grove, Washington County, Minnesota, held a
regular meeting on December 21, 2016 at Cottage Grove City Hall, 12800 Ravine
Parkway. Mayor Bailey called the meeting to order at 7:00 p.m.
2. PLEDGE OF ALLEGIANCE
Boy Scout Troop 5, from St. Ambrose of Woodbury, as a color guard, led the audience,
staff, Mayor, and City Council Members in reciting the Pledge of Allegiance.
3. ROLL CALL
The following were present: Mayor Myron Bailey, Council Member Steve Dennis,
Council Member Olsen, Council Member Jen Peterson, Council Member Dave Thiede.
Also present were: Charlene Stevens, City Administrator; Korine Land, City Attorney-
LeVander, Gillen & Miller, PA; John Burbank, City Planner; Les Burshten, Public Works
Director; Christine Costello, Director of Economic Development; Zac Dockter, Parks and
Recreation Director; Joe Fischbach, HR Manager/City Clerk; Sharon Madsen,
Communications Coordinator; Rick Redenius, Fire Chief; Robin Roland, Finance
Director; Craig Woolery, Director of Public Safety; Neil Belscamper, Deputy City Clerk.
4. OPEN FORUM
Mayor Bailey asked if anyone in the audience wished to address the Council on any
item that was not on the agenda. As no one wished to address the Council, Mayor
Bailey closed the open forum.
5. ADOPTION OF AGENDA
Motion by Council Member Olsen, second by Council Member Thiede, to adopt the
agenda. Motion carried: 5-0.

A. Recognition of Outgoing Council Members and State Legislators
Mayor Bailey invited all Council Members to step forward. Washington County
Commissioner Karla Bigham presented service awards to Council Member Peterson
and Council Member Olsen and thanked each of them for their eight years of service on
the Cottage Grove City Council.
Mayor Bailey stated they also wanted to thank Senator Katie Sieben and State
Representative Dennis McNamara for their years of service; he gave a history of their
accomplishments during their tenures. Mayor Bailey thanked both Council Member
Peterson and Council Member Olsen for their service on the Cottage Grove City Council
and also noted their many accomplishments. He thanked them all for their many hours
away from their homes and thanked their families for allowing them to serve. Mayor
Bailey presented plaques to Senator Katie Sieben, Council Member Peterson, and
Council Member Olsen for their dedicated service to the City of Cottage Grove. He
stated there would be a reception at the River Oaks Golf Course for the outgoing
Council Members and State Legislators following tonight's Council Meeting.
7. CONSENT AGENDA
A. Approve the December 7, 2016 City Council Special Meeting Minutes.
B. Receive and place on file the approved minutes from the Arts Commission
meeting on November 14, 2016.
C. Receive and place on file the approved minutes for the Public Safety
Commission meeting on September 19, 2016.
D. Appoint Ryan Burfeind as Assistant City Engineer, effective December 26,
2016, at Step A in Grade IVA of the Non-Represented Pay Plan.
E. Adopt Resolution 2016-190 amending the Part-time Pay Plan.
F. Accept River Oaks 2016 Annual Report.
G. Name the park and surrounding public land at 7600 Burr Oak Cove
"Camel's Hump Park and Open Space".
H. Authorize service agreement with Webber Recreation to construct a
playground at Arbor Meadows Park for the amount of $41,862.03.
I. Adopt Resolution 2016-191 authorizing renewal of liquor licenses for
2017.
J. Central Fire Station
1. Adopt Resolution 2016-196 approving the Cottage Grove Central Fire
Station preliminary and final plats. 2. Adopt Resolution 2016-197
approving the site plan and building elevation architecture for the 2017
construction of the new Cottage Grove Central Fire Station as designed by
Wold Architects and Engineers.
K. Adopt Resolution 2016-198 supporting the Bus Rapid Transit (BRT)
Implementation Plan completed by Kimley-Horn in 2016 for the Red Rock
Corridor Commission.

L. Authorize placement of River Oaks Eagles Bar & Grill and Banquet
Facilities operation under the direction of the Parks & Recreation
Department.
Council Member Dennis wished to pull Items D and L for further comment and/or
discussion, and Mayor Bailey wished to pull Item I for a separate vote, as there was a
revision that needed to be made.
Council Member Dennis stated he pulled Item D, the appointment of Ryan Burfeind to
Assistant City Engineer, because he felt Ryan deserved recognition for his ability to
work with staff and customers and felt this was a great opportunity for him.
Council Member Dennis stated he had pulled Item L, the River Oaks Golf Course
management update, as the annual report for the River Oaks Golf Course was included
in tonight's Council packet. He stated they'd received great feedback from the
customers of the golf course. He reviewed the path that the golf course and The Eagles
Bar & Grill had taken over the past year, which has been very successful. He stated he
will be stepping down from the General Manager position as of December 31, and that
role will be filled by Parks and Recreation Director Zac Dockter.
Motion by Council Member Peterson to approve the Consent Agenda, except for Item I,
second by Council Member Olsen. Motion carried: 5-0.
Mayor Bailey stated Item I is the 2017 liquor license renewals, but it's been pulled for a
separate vote because there were 17 liquor licenses that needed to be renewed;
however, the Mississippi Dunes Golf Links hasn't yet submitted their renewal
application, so they're looking to approve all but that one. Motion by Council Member
Olsen to approve the remaining liquor licenses, second by Council Member Thiede.
Council Member Dennis asked to recuse himself from the vote because he owns a
business that has a liquor license in the City of Cottage Grove; therefore, he stated he
will abstain from the vote.
Motion carried: 4-0.
8. APPROVE DISBURSEMENTS
A. Approve payment of check numbers 199137 to 199274 in the amount of
$465,701.82 and EFT Payment of $556,021.61.
Motion to approve disbursements by Council Member Dennis, second by Council
Member Olsen. Motion carried: 5-0.
9. PUBLIC HEARINGS
A. Cedarhurst Liquor License

Staff Recommendation: Authorize issuance of on-sa/e intoxicating and
special Sunday liquor licenses to Cedarhurst, Inc. at 6940 Keats Avenue
South, and authorize waiver of the liquor license investigation fee.
City Clerk Fischbach stated they had an application from Cedarhurst to take back their
liquor license; they had a license for a number of years and then subcontracted it out to
a company, A This Little Piggy Catering. In 2017, they're looking to bring the liquor
license back in house, so will therefore do all of the food and liquor operations. Public
Safety conducted a background investigation on the Applicant, and there was nothing
found to disqualify the liquor license.
Mayor Bailey opened the public hearing. As no one wished to speak, Mayor Bailey
closed the public hearing.
Motion by Council Member Olsen to approve issuance of on-sale intoxicating and
special Sunday liquor licenses to Cedarhurst, Inc., second by Council Member Thiede.
Motion carried: 5-0.
10. BID AWARDS — None.
11. REGULAR AGENDA
A. Norris Square Redevelopment
Staff Recommendation: 1) Pass Ordinance 973 approving a zoning
amendment to amend the approved Planned Development Overlay
(PDO). 2) Adopt Resolution 2016-192 approving the preliminary plat and
final plat for PHS Cottage Grove Inc. 3rd Addition. 3) Adopt Resolution
2016-193 approving the site plan and conditional use permit. 4) Adopt
Resolution 2016-194 authorizing the City to enter into a land exchange
agreement, short-term occupancy/ease, license agreement for water
tower maintenance, and all necessary access and utility easements. 5)
Adopt Resolution 2016-195 approving a lot split for PIN
18.027.21.11.0059. 6) Acknowledge, consent to, and approve EDA
Resolution No. 2016-013.
Planner Burbank reviewed the staff recommendations for the Norris Square
Redevelopment project, which includes senior housing and commercial opportunities.
There will be independent living units and a skilled care center. The parking lot will be
reconfigured. There will be underground parking, as well as additional green space. He
reviewed the various resolutions before the Council tonight.
Pamela Belz, 14023-50th Street South, Afton, addressed the Council and stated she's
the Project Manager for Presbyterian Homes for completion of this campus and would
be happy to answer any questions. Mayor Bailey stated he was happy to see they

would be offering transitional care opportunities, which currently is not being offered in
Cottage Grove.
Motion by Council Member Dennis to pass Ordinance 973, approving a zoning
amendment to approve the Planned Development Overlay (PDO), second by Council
Member Peterson. Motion carried: 5-0.
Motion by Council Member Thiede to Adopt Resolution 2016-192, approving the
preliminary plat and final plat for PHS Cottage Grove Inc. 3rd Addition, second by
Council Member Dennis. Motion carried: 5-0.
Motion by Council Member Peterson to Adopt Resolution 2016-193, approving the site
plan and conditional use permit, second by Council Member Olsen. Motion carried:
5-0.
Motion by Council Member Dennis to Adopt Resolution 2016-194, authorizing the City
to enter into a land exchange agreement, short term occupancy lease, license

easements, second by Council Member Thiede. Motion carried: 5-0.
Motion by Council Member Peterson to Adopt Resolution 2016-195, approving a lot split
for PIN 18.027.21.11.0059, second by Council Member Olsen. Motion carried: 5-0.
Motion by Council Member Peterson to acknowledge, consent to, and approve EDA
Resolution No. 2016-013, second by Council Member Dennis. Motion carried: 5-0.
B. Grayson Meadows — Rezoning and Preliminary Plat
Staff Recommendation: 1) Pass Ordinance 974 approving the rezoning of
approximately 20 acres of land from AG-1, Agricultural Preservation
District, to R-3, Single-family Residential District with a Planned
Development Overlay Master Plan. 2) Adopt Resolution 2016-199
approving the revised Grayson Meadows preliminary plat.
Planner Burbank stated this was an application for single-family homes in the upper
ravine district of Cottage Grove in the East Ravine. It's a 45-unit subdivision and
located south of the future Ravine Parkway, which will be installed as part of this project
and 2018 Public Improvement Project to make the connection between Jamaica
Avenue and Keats Avenue. They will be going from a 30-foot front yard setback to 25
feet. The Planning Commission held a public hearing, and there were concerns aired at
that time. The City Engineers have responded to those concerns.
Tim Thone, of Thone Development, 2242 Cottage Grove Alcove, Woodbury, Minnesota,
55129, stated he owns four acres of property, which is south of the Applicant's
proposed planned area. He stated he had an issue with the access, as his road was
not going to line up with the Applicant's road. He stated currently Military Road was a

County road and County supersedes City, as far as access points, but he felt eventually
the City would be taking over the road to the west. He just wanted to know his road was
going to be accessed. He wanted to develop his property this year, and he'd like to see
Ravine Parkway go in, but he understood that's a collector road. If he could access
Military Road, he would do the project in the next year, but he didn't want to learn in 60
days that he didn't have an access.
The Applicant, Mike Sewell, DR Horton Homes, 20860 Cambridge Court, Lakeville,
Minnesota, addressed the Council. He stated there's one update, regarding a
temporary access through the Watershed District's property, and they've agreed to
allow them to build a temporary gravel road. He stated they're not sure what
requirements the County would have for access on Military Road. As Mr. Thone
pointed out, Washington County controls what happens out there. They hope to pull
construction traffic out of the neighborhoods. He stated he'd be happy to answer any
other questions.
Motion by Council Member Thiede to pass Ordinance 974 approving the rezoning of

Motion by Council Member Peterson to Adopt Resolution 2016-199 approving the

Mayor Bailey advised Mr. Thone that they would be reaching out to him regarding his
property concerns.
12. COUNCIL COMMENTS AND REQUESTS
Council Member Dennis wanted to thank Council Member Olsen and Council Member
Peterson for their service on the City Council; in the past 50 years, there have been 41
City Council Members, which is a very small percentage of citizens who have the
privilege to sit on the Council.
Council Member Dennis stated he wanted to review some of the good things that took
place in Cottage Grove in 2016: The City's Strategic Plan; a Certificate of
Achievement for Excellence in Financial Reporting Award for the Finance Department; a
revised budgeting process for the City; three new Firefighter-Paramedic positions for
2017; plans for a new Central Fire Station on 80th Street; two new City parks were
added, other parks had playgrounds renovations; successful fundraising efforts for
the Inclusive Playground at Woodridge Park, which is 73% funded, to be built in 2017;
Public Works used more than 3,000 tons of asphalt to keep roads repaired, and the
shop completed more than 1,000 vehicle service requests; "My Future Cottage Grove,"
the community engagement project; 84.47% of Cottage Grove residents voted in this

year's elections, with La Rae Mills and Wayne Johnson being elected to the City
Council; Facebook Live was used to engage the public's opinions and social media
sites were reformatted; two new monthly video shows, "My Cottage Grove" and "In a
Snap", which is a snapshot of economic development taking place in Cottage Grove;
Hy-Vee is being constructed and slated to open in 2017; additional housing
opportunities for seniors increased and 98 new single-family home permits were issued;
local businesses made improvements to their facilities. Council Member Dennis stated
Cottage Grove's direction and position are very strong with an amazing team including
the City Council, City staff, and a number of outstanding community members who
volunteer their time and serve on various City Commissions.
Council Member Peterson thanked the Cottage Grove community for having elected her
twice as a Council Member; she stated it's been an honor, she's learned a lot, and has
met many great people. She stated she's proud of the work they've done, as they've
made it through some really tough times, and have progressed very well. She stated
she's confident that the progress will continue with the new Council Members. She
thanked her family and stated she's looking forward to spending more time with all of
them.
Council Member Olsen thanked the Boy Scouts, who were present tonight, for the color
guard and leading the Pledge of Allegiance; he congratulated them for a job well done.
Council Member Olsen stated it was very humbling to have such nice things said about
Council Member Peterson and himself by both Mayor Bailey and Washington County
Commissioner Bigham, as he respects them both. He hoped that over the past eight
years people who did so much more for the City, on a daily basis, have felt that they've
been supported by him; he truly felt those were the people who deserved the awards
and recognition. As a City Council Member, he felt he stood on the shoulders of giants
and what they had accomplished was a continuation of what previous Council Members
had done. Council Member Olsen stated he's very proud of the work this Council has
done over the past eight years; his fellow Council Members are tremendous colleagues
who care deeply about this City, as do incoming Council Members Wayne Johnson and
La Rae Mills. He hoped he had left the Council a little better than how he had found it;
he'd learned that serving the community is not a "me" thing, it's a "we" thing. The City
has young people, volunteers, civic group members, and, of course, the staff inembers
of the City of Cottage Grove, who serve the community in many ways. There's a lot of
work that goes into running the City of Cottage Grove, and he's damn proud to live here
and proud that he had an opportunity to work with some of the people who deliver on
their promise every single day, without fail. He encouraged citizens to remember the
hard workers who provide for the citizens every day to keep their roads plowed, their
streets and neighborhoods safe, and perform emergency medical services and fire
services to keep the citizens, their families, and their properties safe. He thanked all of
the people mentioned above; he's gotten to know some of them personally. He felt
they're some of the best people, with the highest degree of character and concern for
Cottage Grove's residents, that he's ever met.

Council Member Olsen stated he began his work with the City on the Public Safety
Commission and thanked Mayor Bailey for encouraging him to run for the City Council,
as he's learned so much about how the City works and meets or exceeds citizens'
expectations.
He thanked Council Member Peterson and stated nobody works harder than she does
to serve this community, South Washington County, and the State of Minnesota in many
different capacities; he referred her to a "change agent" and states she makes things
happen quietly and humbly. He thought it appropriate that they were both leaving the
Council at the same time, as they were elected to the Council together eight years ago.
In closing, he thanked the residents of Cottage Grove for allowing him the opportunity to
serve them as a City Council Member.
Mayor Bailey stated he'd like Council Member Peterson and Council Member Olsen to
make the motion to adjourn the meeting tonight; he invited everyone down to River
Oaks after the meeting to celebrate their many years of service.
