HomeMy WebLinkAbout11A Minor Subdivision - 8508 Keats Avenue South CITY OF COTTAGE GROVE, MINNESOTA CITY COUNCIL RESOLUTION 2017-XXX A RESOLUTION GRANTING A MINOR SUBDIVISION TO SUBDIVIDE A 5-ACRE PARCEL OF LAND AT 8508 KEATS AVENUE SOUTH INTO TWO 2.5-ACRE PARCELS WHEREAS, Gary Moody applied for a minor subdivision to subdivide a 5-acre parcel of land into two parcels of 2.5 acres each, on the property legally described below: The East 660.00 feet of the North half of the North half of the Northeast Quarter of the Southeast Quarter of Section 15, Township 27 North, Range 21 West, Washington County, Minnesota. Subject to any easements of record. Commonly known as 8508 Keats Avenue South, Cottage Grove, Washington County, State of Minnesota. WHEREAS, the Planning Commission reviewed this application at their meeting on July 24, 2017; and WHEREAS, a planning staff report which detailed specific information about the property and the variance application was prepared and presented; and WHEREAS, public hearing notices were mailed to property owners within 500 feet of the property and a public hearing notice was published in the South Washington County Bulletin; and WHEREAS, the public hearing was open for public testimony and no public testimony was received; and WHEREAS, the Planning Commission unanimously (5-to-0 vote) recommended to the City Council that the minor subdivision subdividing a 5-acre parcel of land in two parcels be granted, subject to the conditions listed in the Planning Staff Report. NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Cottage Grove, Washington County, Minnesota, hereby grants a minor subdivision to subdivide a 5-acre parcel of land into two 2.5-acre parcels, on property legally described above, subject to the following conditions: Direct access onto Keats Avenue from Parcel B is prohibited. 1. A public right-of-way dedication totaling 92 feet from the eastern property line of 2. Parcel B shall be dedicated to the City prior to recording the deeds creating the lots with Washington County. On Parcels A and B, a public right-of-way dedication totaling 33 feet along 85th 3. Street shall be required. City of Cottage Grove, Minnesota City Council Resolution 2017-XXX Page 2 A public drainage and utility easement that is ten feet wide shall be dedicated on 4. the north and south property lines of Parcels A and B. A public drainage and utility easement that is five feet wide shall be dedicated on 5. the east and west property lines of Parcels A and B. A public drainage and utility easement that is 60 feet in width and centered on the 6. bottom of the ravine that dissects the property will be required to be dedicated to the City. The easement documents shall be prepared and recorded with the deeds for the subdivision with Washington County. Area charges for stormwater, sanitary sewer, and water shall be paid to the City of 7. Cottage Grove prior to the release of a building permit for Parcel A. Any future connection of Parcel B to public utilities will require payment sanitary 8. sewer, stormwater, and water area charges at the time of connection. All associated connection fees must be paid prior to construction. The park dedication fee in lieu of land dedication amounting to the annual rate 9. applicable at the time of building permit (currently $3,400.00/unit) shall be paid to the City for Parcel A prior to the release of a building permit. All applicable permits (i.e.; building, electrical, grading, and mechanical) for the 10. construction of houses on the parcels must be completed, submitted, and approved by the City before any construction activities begin. Detailed construction plans must be reviewed and approved by the Building Official and Fire Marshal. The minimum setbacks for the principal structure shall be those found in the R-4 11. zoning criteria. A certificate of survey shall be required with the building permit for Parcel A. 12. An as-built survey shall be required prior to a certificate of occupancy for Parcel A. 13. The property owner shall obtain a right-of-way permit from the City prior the 14. installation of driveway for Parcel A. The driveway location shall be approved by the City Engineer. The private access drive for Parcel A must be hard surfaced with asphalt or 15. concrete between the 85th Street roadway edge to the front property setback line. Grading and erosion control measures meeting City standards shall be utilized 16. during construction on Parcel A. Prior to the issuance of a certificate of occupancy for Parcel A, all disturbed areas 17. shall be sodded or have ground cover established to the satisfaction of the City Engineer.
