TAM Google Street View of Site Background and Site Conditions The property is developed as a commercial fast food restaurant with a drive-through window and has remained in operation within the community since its initial construction in 1973. The applicant has indicated a desire to continue their tenure in the community with a total redevel- opment of the site to include a new building and infrastructure to support the new structure. The new building demonstrates the McDonald's branding design as seen around other new or re- developed buildings in the region. Over the years, there have been several modifications to the physical portions of the site and the permitted and conditional uses allowed on the site. Public Utilities The property is currently located in the Metropolitan Urban Service Area (MUSA) and has exist- ing service connections to public utilities. The site revisions include the relocation of some public utility lines and easements. The engineering memo dated February 15, 2018, addresses the util- ity comments for the project. Sewer Availability Charges (SAC) will be required to be paid with the building permit for any new SAC units identified through the redevelopment process. The current SAC rate is $2,485. Transportation The existing access drives are not being relocated as a component of the re -development. The adjacent roadway and network were designed to accommodate existing and future commercial use of the site. Parking The parking on the site is being reduced from the existing count of 74 stalls to 51 stalls. This ac- tion is permitted due to language in Resolution 2004-224, which granted a variance for parking on the site to be one stall required for every three seats. The seating for the new building is 129, which equates to 43 stalls. Staff is comfortable with the proposed parking for the site based on the following facts: • The applicant is providing eight additional stalls above the permitted requirements. • Staff observations of parking needs on the site. • The applicant has stated that over 75 percent of the business conducted at the site is via the drive through. Parking Detail Surface Water Management The Engineering memo dated February 21, 2018, addresses the stormwater comments for the project. Based on the lack of surface water management ponds on the existing and proposed site plan, an offsite ponding fee in the amount of $42,464.65 will be required at the time of build- ing permit. Additional grading review will be required upon submittal of final grading and utility plans for the site. (0.0004) 28 NA 28 Planning Staff Report — Planning Case No. SP2018-013 McDonald's Redevelopment February 26, 2018 Page 10 of 17 Based on the ordinance criteria for building perimeter landscaping, it is recommended that land- scaped planting beds or planter boxes containing perennials, annuals, and grasses be included in the revised landscaping plan. Tree Preservation The review plan set identifies 20 significant trees on the site of which 6 (30 percent) will be re- moved. The tree preservation ordinance does allow for 30 percent of trees to be removed with commercial development. Site plans are unique in that a certain quantity of landscape material is required in conjunction with development, and the removal of the significant trees and other existing vegetation can compromise those requirements. The applicant's project narrative (page 3) in relation to the removal and establishment of new landscaping meets the intent of both the tree preservation and the landscaping ordinance requirements. The plan sets contain additional quantitative information and location details. Lighting The review plan set included the required light metric study for the site. As submitted, the plan does not exceed the ordinance requirement, which is a maximum intensity of one foot candle at the property line. All lighting on the site shall be shielded and downward directed. rnuwnIUL[IU OLuuy veUan Fire Department Access The Fire Department requires Knox box access to the site. All new fire safety equipment required per the building and fire codes will need to be in place prior to the issuance of a Certifi- cate of Occupancy. The new plan identifies a sidewalk link from the site to the existing transportation trail on East Point Douglas Road at the north entrance drive. It is recommended that the existing bituminous trail adjacent to the site be reconstructed as a concrete sidewalk with exposed aggregate between the sidewalk and the curb, per City Detail Sheet STR10. Sidewalk Detail Architecture The new building meets the City's architectural design criteria for Class 1 materials and will be a welcomed refreshment of the site. The City's Technical Review Committee recommended that, based on the ordinance criteria related to building walls greater than 100 feet in length, the exterior design of the building include an increased variety of vertical design accent material to break up the linear facade of the building into more segments or points of articulation/deviation. It has been determined that a component of the approval of this site plan will be the inclusion of a comprehensive sign package for the site. Deviations from the submitted sign- age will require approval by the Community Development Department. Area Charges The area charge requirements have been previously satisfied for this site. Public Hearing Notices The public hearing notice was published in the South Washington County Bulletin on February 14, 2018, and mailed to the 14 property owners who are within 500 feet of the property on February 15, 2018. Neighborhood Meeting Since this is a commercial re -development project, no neighborhood meeting was held for this project. Summary 1) There is no change in use of the property. 2) The property is guided for Commercial. 3) The site design fits within the parameters of the required development performance stand- ards of the zoning district. 4) The property is within the MUSA and is properly served by public utilities. 5) The traffic generated from the project will not have negative impacts on the adjacent road- ways. Recommendation That the Planning Commission recommend that the Council approve the site plan review appli- cation for the demolition and redevelopment of the Cottage Grove McDonald's restaurant located at 7355 East Point Douglas Road South, subject to the conditions stipulated below:. General Development 1. The applicant and builders must comply with all City ordinances and policies except as may be modified by agreement of the applicant and City staff. 2. All grading, drainage, erosion control, and utilities must conform to the final plans approved by the City Engineer. 3. The applicant receive appropriate demolition and building permits from the City, and permits or approvals from other regulatory agencies including, but not limited to, the South Washington Watershed District, Minnesota Department of Health, Minnesota De- partment of Natural Resources, Minnesota Department of Transportation, and Minnesota Pollution Control Agency. All signage dimensions and locations on the site must conform to the comprehensive sign package included with this review and approval. 5. A separate building permit shall be obtained for all sign installation. 6. The applicant shall incorporate the recommendations, requirements, and evaluations noted in the Bolton and Menk memorandum dated February 21, 2018, into the final con- struction drawings subject to modifications that are agreed to by the applicant and City Engineer. Fa.camant_c 7. The existing drainage and utility easements identified in the review plan set for aban- donment shall vacated by the City Council after a public hearing. 8. New drainage and utility easements as identified in the plan set shall be dedicated to the City and recorded with Washington County upon acceptance by the City Council. The applicant will be required to prepare the required easement documents. Construction and Grading 9. Prior to the submission of the building permit application to the City, the applicant must submit for staff review and approval a final construction management plan that includes erosion control measures, project phasing for grading work, areas designated for preser- vation, a crushed -rock construction entrance, and construction -related vehicle parking. All emergency overflow swales must be identified on the grading and erosion control plan. 10. A pre -construction meeting with City staff and the contractor must be held before site work begins. The contractor will provide the City with a project schedule for the various phases of construction. 11. The applicant shall prepare a detailed detour plan for the utility work that will be required within East Point Douglas Road. The cost of the detour signage and all associated traffic control is the responsibility of the applicant. 12. Erosion control devices must be installed prior to commencement of any grading activity. Erosion control shall be performed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Control Planning Handbook" and the conditions stipulated in Title 10-5-8, Erosion Control During Construction of the City's Subdivision Ordinance. 13. Upon completing site grading, four copies of an "As -Built" survey for the site grade eleva- tions must be submitted to the City. An electronic file of the "As -Built" survey must be submitted to the City Engineer. 14. All mechanical equipment shall be screened from public view as reviewed and approved by the Community Development Department. 15. Any fencing on the site shall meet the City's architectural fencing detail. The exterior design of the building shall include an increased variety of material accents so as to break up the linear fagade of the building into more segments or points of articu- lation/deviation. I Itilitia_c 18. The applicant is responsible to provide for the necessary easements and costs associ- ated with road and utility improvements serving the site. All drainage and utility ease- ments as recommended by the City Engineer must be shown on the final construction drawings and be dedicated to the City for public purposes. 19. All stormwater designs shall meet the intent of the City's Surface Water Management Plan and the South Washington Watershed District water management plan. Streets 20. Right of -way permits are required for all construction activity within the public right-of-way of East Point Douglas Road. 21. The entrance drive pavement at both access points to East Point Douglas road shall be replaced per City detail plates. 22. The City's curb and sidewalk replacement policy must be complied with during construc- tion. Identified damages shall be the responsibility of the applicant. Li htin 23. All lighting on the site shall be downward directed. Sidewalks and Trails 24. All internal sidewalks and connections to public trailways shall meet accessibility re- quirements. 25. The existing bituminous trail adjacent to the site shall be replaced with a concrete side- walk with exposed aggregate between the sidewalk and the curb per City Detail Sheet STR10. Landscaping and Irrigation 26. Irrigation systems installed within City right-of-way are solely the responsibility and risk of the Applicant. The City is not responsible or liable for any damage or costs related to in- stallation, damage, or replacement of lawn irrigation systems placed in the boulevard as a result of City use of or future changes in the right of way. 27. Landscaping planting beds or planter boxes containing perennials, annuals, and grasses shall be included in the revised landscaping plan. 28. At the time of building permits, a letter of credit amounting to 150 percent of the land- scaping and irrigation installation estimate shall be submitted to and approved by the City. Upon completion of the landscaping improvements, the owner shall, in writing, in- form the City that said improvements have been completed. The City shall retain the fi- nancial guarantee covering the landscape improvements for a period of one year from the date of notice to ensure survival of the plants. No building permit shall be issued until the required financial guarantee has been received and accepted by the City. 30. The landscaping shall be installed per the approved landscape plan and continually main- tained in a live vegetative state, kept trimmed and free of refuse and debris, and replaced with live plantings when necessary. 31. The landscaping shall be maintained to the back of curb. Surface Water Management 32. An offsite ponding fee in the amount of $42,464.65 will be required at the time of building permit. 33. The lowest opening ground elevations of all structures shall be a minimum of two feet above the emergency overflow elevation. 34. All emergency overflow swales must be identified on the grading and erosion control plan. Prior to final grading, emergency overflow elevations shall be surveyed to ensure the emergency overflows are properly graded and maintained. 35. A permit shall be obtained from the Minnesota Department of Transportation for any stormwater infrastructure construction or modifications within the State right-of-way. Onsite Infrastructure Improvements 36. The applicant will be required to conduct all major activities to construct the im- provements during the following hours of operation: Monday through Friday Saturday Sunday 7:00 A.M. to 7:00 P.M. 9:00 A.M. to 5:00 P.M. Not Allowed This does not apply to activities that are required on a 24-hour basis such as dewatering, etc. Any deviations from the above hours are subject to approval of the City Engineer. Violations of the working hours will result in a $500 fine per occurrence. 37. The applicant shall weekly, or more often if required by the City Engineer, clear from the public streets and property any soil, earth, or debris resulting from construction work by the applicant or its agents or assigns. All debris, including brush, vegetation, trees, and demolition materials, shall be properly disposed of off-site; burying construction debris, trees, and other vegetation is prohibited. The applicant grants the City, its agents, employees, officers, and contractors permission to enter the site to perform all necessary work and/or inspections during grading and the installation of public improvements by the applicant. 39. Upon completion of the project construction work, the applicant shall provide the City with a full set of as -built plans for City records and transmitted to the City in a DWG Autocad format and pdf format. Applicant must also furnish the City with a pdf format of the final plat and four prints of the recorded plat. If the applicant does not provide as-builts, the City will produce them at the applicant's expense. 40. Adequate dumpsters must be on site during construction of the project. When the dump- sters are full, they must be emptied immediately or replaced with an empty dumpster to prevent debris from being blown off-site. 41. Adequate portable toilets must be on-site at all times during construction on the site. Toilets must be regularly emptied. 42. All areas disturbed by the excavation and back -filling operations shall be fertilized, mulched, and disc anchored as necessary for seed retention. Time is of the essence in controlling erosion. If the applicant does not comply with the erosion control plan and schedule, or supplementary instructions received from the City, or in an emergency de- termined at the sole discretion of the City, the City may take such action as it deems ap- propriate to control erosion immediately. The City will notify the applicant in advance of any proposed action, but failure of the City to do so will not affect the applicant's and the City's rights or obligations. If the applicant does not reimburse the City for any costs the City incurred for such work within thirty (30) days, the City may draw down the letter of credit to pay such costs. 43. The applicant is responsible for erosion control inspection fees at the current rates. If the applicant does not reimburse the City for the costs the City incurred for such work within thirty (30) days, the City may draw down the letter of credit to pay such costs. 44. Dust control measures must be in place to prevent dust and erosion, including, but not limited to, daily watering, silt fences, and seeding. Point Douglas Road. The site is a 1.68 -acre parcel with an existing McDonalds. Our redevelopment plan includes reconstruction of the restaurant building, modifications to the parking lot layout, construction of new utility services, adding landscape plantings, replacement of the signage on site and replacing the parking lot lighting. We are excited about the improvements proposed for this site. Site Plan The site plan complies with the Cottage Grove Zoning Ordinance standards as outlined below: 1. Setbacks The principal structure meets the 30 -foot setback from the front lot line, the 35 -foot setback from the rear lot line and the 10 -foot setback from the side lot line as required by Section 11- 10C -1(B) of the Cottage Grove Zoning Ordinance. The site plan shows compliance with the 20 - foot parking setback for the front lot line and the 10 -foot parking setback from the rear and side lot lines as required by Section 1 1-3-9(D)(6)(d) of the Zoning Ordinance. 2. Parking and Stacking The current McDonalds restaurant received a variance for parking that calculates parking using one space required per three seats. Using this calculation for the new building with 129 seats will require 43 parking spaces to be provided. The site plan shows 51 parking spaces being provided, which exceeds the required amount required by the variance standard. Section 11-3-9(E)(8) of the Zoning Ordinance requires 12 stacking spaces be provided for the double lane drive -up facility. The site plan shows 21 stacking spaces being provided, which exceeds the 19 stacking spaces on the existing site and the required amount by code. The reason for the increase from the existing conditions and code requirements for the stacking spaces provided is that the existing McDonalds serves approximately 73% of its customers through the drive -up facility. Assuming the use of the drive -up facility remains the same for the new building, the proposed stacking is necessary for the drive -up facility. 3. Landscaping The proposed improvements will cause six trees to be removed. City Code requires each mature tree removed to be replaced at a ratio of two new trees per mature tree removed. We are proposing to meet this requirement by placing 12 new trees on site. Section 11-6-5 of the Zoning Ordinance requires additional landscaping based on the size of the site being redeveloped. Using the code calculation, the site is required to have 25 new trees (13 deciduous overstory, 12 coniferous) in addition to the 12 replacement trees and 56 new shrubs placed on site. We are saving trees on site equivalent to a credit of 15 trees and planting all 56 shrubs on site. The remaining 10 trees needed cannot be feasibly placed on site. Therefore, we would like to use the alternative option to pay a cash in lieu payment for the 10 trees we are MCD17362 I_ A, J D F 0 R M January 31, 2018 Project Narrative 2 unable to fit on site. We request that the cash in lieu payment to the landscape initiative fund be used to plant trees in adjacent boulevards, parks near the site or on the adjacent cemetery. Additionally, we are proposing 25 perennials and 19 ornamental grasses to re-establish the lush plantings that exist onsite. We are proposing to relocate all the decorative boulders onsite to maintain the visual variety that exists now. 4. Screening A trash enclosure is required to be screened from any adjoining property according to Section 1 1-6-3(B) of the Zoning Ordinance. The required screening must be a wall at least six feet in height and made of materials similar to the principal structure. The site plan shows the trash enclosure attached to the principal structure and completely enclosed with the same materials used to construct the principal structure. Additionally, Section 1 1-6-4(B) of the Zoning Ordinance requires any mechanical equipment, ground -mounted or rooftop, to be screened. The rooftop mechanical equipment will be screened by a parapet on the building that is three feet two inches tall. The site plan shows landscape screening of the ground mechanical equipment located Southeast of the principal structure. 5. Lighting Lighting is subject to the standards stated in Section 11-6-8 of the Zoning Ordinance. The requirements in the section are that the lights have a maximum glare of one -foot candle when measured at the property line. All exterior lighting fixtures will be installed to meet the Zoning Ordinance standards by using elements on the light fixtures that limit glare and light spillage. 6. Signage The proposed signage for the site includes wall signs, directional signs, menu boards and additional signs associated with the drive through area. The existing freestanding pylon sign will not be changed. The proposed directional and wall signage outside of the drive-through area comply with standards outlined in Section 9-8 of the City Code. City staff requested that proposed signage be submitted as part of a comprehensive sign package as many of the elements of the drive through area are not defined in the current City Code. Therefore, we have included details of the signs associated with the drive-through area on the plans. • The proposed menu boards are 29.4 sq. ft., which are smaller than the existing menu boards on site. They have a digital display, but do not cycle images. • The proposed presell board is a smaller menu board placed prior to the larger menu board and ordering location. It is used to let customers know the promotions that are currently being offered. The presell board has a digital display that cycles through the McDonald's promotion items every eight seconds. The size of the proposed presell board is 16.4 sq. ft. • The gateway element is 10 ft. 8 in. and is used to inform drivers with large vehicles of the nine -foot clearance height for the drive through. • The order canopies used to identify the place for customers to order food in the drive through are 11 ft. 10 in. • The proposed locations of all the drive through sign elements can be seen on the plan set. MCD17362 L F. i J D F O R M January 31, 2018 Project Narrative 3 Vacation of Easement As part of the redevelopment of the McDonalds restaurant, the sanitary sewer line to the West of the property is being reconstructed with a modified depth and location. The sanitary sewer is located in a utility easement that needs to be vacated and a new utility easement dedicated in the appropriate location for the new sanitary sewer line. An exhibit is attached to show the existing and proposed utility easement. Summary We respectfully request approval of the Site Plan and Easement Vacation to allow demolition of the existing McDonalds at 7355 E. Sheet C1.2: 1. The existing 2" water service should be removed to the main. Instead of wet -tapping a new 6" connection further down East Point Douglas Rd, cut in a new tee at the location of the existing corporation stop so the existing service is completely removed and the road is cut open in one location. Sheet C4.1 will need to be updated accordingly. This work will likely impact the adjacent concrete apron and should be replaced per City Detail Plate STR-18. 2. By-pass pumping will be required to maintain sewer service to the adjacent parcel. Sheet C2.1: The existing bituminous trail along East Point Douglas Road should be removed due to its poor condition. A concrete sidewalk with exposed aggregate between sidewalk and curb should be constructed to match the sidewalk on the north side of the site. The sidewalk typical section should be referenced per City detail STR-10. Pedestrian ramps should also be replaced per the current MnDOT details. Trail closure signage and barricades will be required. 4. The westerly access does not appear to show a new driveway apron. Sheet C4.1: 5. Realign and straighten the existing sanitary sewer from the manhole near FES -100 to the manhole near FES -200. A new 20' easement will be required over the sanitary sewer. Sheet C1.2 will need to be updated accordingly. 6. Watermain shall be ductile iron pipe. Add an additional hydrant onsite for flushing. 7. The proposed watermain work will require a closure of East Point Douglas Road, which will require a traffic control and detour plan to be submitted to the City for review and approval. 8. Adjust and grade the existing sanitary sewer manhole so it's above the adjacent FES -200. Or could the FES be extended past the sanitary pipe like FES -100? 9. Point Douglas Road. The site is a 1.68 -acre parcel with an existing McDonalds. Our redevelopment plan includes reconstruction of the restaurant building, modifications to the parking lot layout, construction of new utility services, adding landscape plantings, replacement of the signage on site and replacing the parking lot lighting. We are excited about the improvements proposed for this site. Site Plan The site plan complies with the Cottage Grove Zoning Ordinance standards as outlined below: 1. Setbacks The principal structure meets the 30 -foot setback from the front lot line, the 35 -foot setback from the rear lot line and the 10 -foot setback from the side lot line as required by Section 11- 10C -1(B) of the Cottage Grove Zoning Ordinance. The site plan shows compliance with the 20 - foot parking setback for the front lot line and the 10 -foot parking setback from the rear and side lot lines as required by Section 1 1-3-9(D)(6)(d) of the Zoning Ordinance. 2. Parking and Stacking The current McDonalds restaurant received a variance for parking that calculates parking using one space required per three seats. Using this calculation for the new building with 129 seats will require 43 parking spaces to be provided. The site plan shows 51 parking spaces being provided, which exceeds the required amount required by the variance standard. Section 11-3-9(E)(8) of the Zoning Ordinance requires 12 stacking spaces be provided for the double lane drive -up facility. The site plan shows 21 stacking spaces being provided, which exceeds the 19 stacking spaces on the existing site and the required amount by code. The reason for the increase from the existing conditions and code requirements for the stacking spaces provided is that the existing McDonalds serves approximately 73% of its customers through the drive -up facility. Assuming the use of the drive -up facility remains the same for the new building, the proposed stacking is necessary for the drive -up facility. 3. Landscaping The proposed improvements will cause six trees to be removed. City Code requires each mature tree removed to be replaced at a ratio of two new trees per mature tree removed. We are proposing to meet this requirement by placing 12 new trees on site. Section 11-6-5 of the Zoning Ordinance requires additional landscaping based on the size of the site being redeveloped. Using the code calculation, the site is required to have 25 new trees (13 deciduous overstory, 12 coniferous) in addition to the 12 replacement trees and 56 new shrubs placed on site. We are saving trees on site equivalent to a credit of 15 trees and planting all 56 shrubs on site. The remaining 10 trees needed cannot be feasibly placed on site. We request that the cash in lieu payment to the landscape initiative fund be used to plant trees in adjacent boulevards, parks near the site or on the adjacent cemetery. Additionally, we are proposing 25 perennials and 19 ornamental grasses to re-establish the lush plantings that exist onsite. We are proposing to relocate all the decorative boulders onsite to maintain the visual variety that exists now. 4. Screening A trash enclosure is required to be screened from any adjoining property according to Section 1 1-6-3(B) of the Zoning Ordinance. The required screening must be a wall at least six feet in height and made of materials similar to the principal structure. The site plan shows the trash enclosure attached to the principal structure and completely enclosed with the same materials used to construct the principal structure. Additionally, Section 1 1-6-4(B) of the Zoning Ordinance requires any mechanical equipment, ground -mounted or rooftop, to be screened. The rooftop mechanical equipment will be screened by a parapet on the building that is three feet two inches tall. The site plan shows landscape screening of the ground mechanical equipment located Southeast of the principal structure. 5. Lighting Lighting is subject to the standards stated in Section 11-6-8 of the Zoning Ordinance. The requirements in the section are that the lights have a maximum glare of one -foot candle when measured at the property line. All exterior lighting fixtures will be installed to meet the Zoning Ordinance standards by using elements on the light fixtures that limit glare and light spillage. 6. Signage The proposed signage for the site includes wall signs, directional signs, menu boards and additional signs associated with the drive through area. The existing freestanding pylon sign will not be changed. The proposed directional and wall signage outside of the drive-through area comply with standards outlined in Section 9-8 of the City Code. City staff requested that proposed signage be submitted as part of a comprehensive sign package as many of the elements of the drive through area are not defined in the current City Code. Therefore, we have included details of the signs associated with the drive-through area on the plans. • The proposed menu boards are 29.4 sq. ft., which are smaller than the existing menu boards on site. They have a digital display, but do not cycle images. • The proposed presell board is a smaller menu board placed prior to the larger menu board and ordering location. It is used to let customers know the promotions that are currently being offered. The presell board has a digital display that cycles through the McDonald's promotion items every eight seconds. The size of the proposed presell board is 16.4 sq. ft. • The gateway element is 10 ft. 8 in. and is used to inform drivers with large vehicles of the nine -foot clearance height for the drive through. • The order canopies used to identify the place for customers to order food in the drive through are 11 ft. 10 in. • The proposed locations of all the drive through sign elements can be seen on the plan set. The sanitary sewer is located in a utility easement that needs to be vacated and a new utility easement dedicated in the appropriate location for the new sanitary sewer line. An exhibit is attached to show the existing and proposed utility easement.
