The full name of the HERO Center is the East Metro Public Training Facility for Health and Emer- gency Response Occupations. This project has been in the planning stage since 2011 and is moving from design and planning towards approval to be shovel ready in advance of securing full funding options. On June 13, 2015, the Minnesota State Legislature and Governor approved a $1.46 bonding appropriation for the project for pre -design and design activities for the facility. These applications are a cumulation of those activities. HERO Center Entrance Rendering Planning Considerations Land Use The property is currently guided for Parks and Private Open Space. Public buildings and facili- ties are permitted within this land use classification. The East Ravine Master Plan identified the area as a component of a civic campus. No changes in land use classification are proposed with this development. Zoning The property is currently R-1, Rural Residential District. Habitable or non -habitable structures for local, county, state, or federal government purposes are permitted within this zoning classifica- tion. No changes in zoning classification are proposed with this development. Conditional Use Permit Given the proper land use and zoning, the first application approval needed for the proposed use is a conditional use permit. The City ordinance requires a conditional use permit for all pub- lic buildings and institutions located within a residential district. The planned public safety train- Planning Staff Report — Planning Case No. SP2018-027 HERO Center Development April 19, 2018 Page 4 of 18 ing uses on the site would be conducted indoors and outdoors and include simulation rooms, classrooms, supporting ancillary rooms, an indoor gun range, a future indoor gun range addi- tion, an outdoor multi-purpose training field, outdoor patio, dog training obstacle course, SWAT tactical training, crowd control, vehicle extraction, helicopter landings and take offs, and other uses relevant to the specific scenario -based training activities occurring on the site. A component of the site plan and conditional use is the ability to construct a future indoor gun range addition. This section states that in granting a CUP, the City Council shall find that: 1. The use will be in conformity with the City's Comprehensive Plan and with the purpose, intent and applicable standards of this Title. 2. The use shall be located, designed, maintained and operated to be compatible with the existing or intended character of that zoning district in which it is located. 3. The use shall not depreciate values of surrounding property. 4. The use shall not be hazardous, detrimental or disturbing to present and potential surrounding land uses due to noises, glare, smoke, dust, odor, fumes, water pollution, vibration, general unsightliness or other nuisances. 5. The use shall generate only minimal vehicular traffic on local streets as defined by the trans- portation element of the Comprehensive Plan. The use shall not create traffic congestion, unsafe access or parking needs that will cause inconveniences to the adjoining properties. 6. The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. 7. The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the City. 8. The use shall preserve and incorporate the site's important natural and scenic features into the development design. 9. The use shall cause minimal adverse environmental effects. 10. The use shall not adversely affect the potential development of adjacent vacant land. The City's Technical Review Committee reviewed this application under those criteria. The Committee found that the CUP criteria could be met, and the CUP for HERO Center could be approved subject to conditions. The applicant's response to the ordinance criteria is attached. The recommended conditions found at the end of the report address hours of operation, noise, parking, and other common site development requirements. Site Plan The second application is for a site plan review of the proposed facility. Strategic design ele- ments such as access, screening, safety, and noise were all factored into the site design that is being presented. All outside training will be conducted within the activities courtyard located to the west of the principal building. This area will be fenced and secured by a gate at all times. Density This project is not subject to density requirements. Public Utilities The property is currently located in the Metropolitan Urban Service Area (MUSA) and has exist- ing service connections to public utilities. The engineering memo dated April 17, 2018, ad- dresses the utility comments for the project. Sewer Availability Charges (SAC) will be required to be paid with the building permit for any new SAC units identified through the development process. The current SAC rate is $2,485. Parking The 145 standard and 6 handicap parking spaces provided onsite meet the requirements based on the mixed uses of the building. HERO Parking Detail As a component of the approval for this development, shared parking opportunities are being proposed on the City Hall/Public Safety site for special occasions or when overlapping training sessions may occur. There are in excess of 26 parking stalls at the City Hall parking lot that are immediately adjacent to the sidewalk connecting the two sites. The final easements and agree- ments should be memorialized with the Washington County Recorder. " ` r � d i + Cross Parking Detail Transportation Ravine Parkway and 85th Street are identified in the Comprehensive Plan as Major Collectors, which are designed to accommodate the traffic anticipated to be generated by the proposed use. The existing access drive locations to the site that were constructed in 2012 will be main- tained. Grading The grading and landscaping plans were coordinated in relation to the creation of bermed land- scaping areas to serve as screening of the outdoor training facility. The preliminary grading plan was reviewed by Engineering and included in the review comments from April 17, 2018. Addi- tional grading review will be required upon submittal of final grading and utility plans for the site. Surface Water Management On-site stormwater management is proposed as required. The Engineering Memo dated April 17, 2018, addresses the stormwater comments for the project. Additional stormwater manage- ment review will be required upon submittal of final grading and utility plans for the site. Based on the inclusion of extra water quality treatment measures included in the surface water management plan for the site, the project was awarded a $152,500 grant from the South Wash- ington Watershed District (SWWD). Lighting The review plan set did not include the required light metric study for the site. Final construction documents shall include the photometric study. The ordinance requirement is a maximum inten- sity of one-half foot candle at the property line. All lighting on the site shall be shielded and downward directed. Fire Department Access The Fire Department requires Knox box access to the site. All new fire safety equipment required per the building and fire codes will need to be in place prior to the issuance of a Certifi- cate of Occupancy. Sidewalks The new plan identifies a sidewalk link from the site to the Cottage Grove City Hall site as well as to the existing trailway and sidewalk network around the Ravine Parkway Civic Campus. New sidewalks on the site plan and connections to the public trailway shall meet accessibility requirements. Signage Wall and monument signage is proposed to be consistent with the signage that was installed at the City Hall site. Recommendation That the Planning Commission recommend that the Council approve the following, subject to conditions: 1. A site plan for the HERO Center, which is an integrated public safety training facility to be located on 9.1 acres at the southeast corner of 85th Street and Keats Avenue (CSAH 19); 2. A conditional use permit to allow a public building in a residential zoning district; 3. A preliminary plat creating one lot to be called HERO Center Addition. Conditions of Approval General Development 1. The applicant must comply with all City ordinances and policies except as may be modi- fied by agreement of the applicant and City staff. 2. All grading, drainage, erosion control, and utilities must conform to the final plans approved by the City Engineer. 3. The applicant receives appropriate building permits from the City, and permits or approv- als from other regulatory agencies including, but not limited to, the South Washington Watershed District, Minnesota Department of Health, and Minnesota Pollution Control Agency. 4. All signage dimensions and locations on the site must conform to the City Ordinance. 5. A separate building permit shall be obtained for all sign installation. 6. The applicant shall incorporate the recommendations, requirements, and evaluations noted in the Bolton and Menk memorandum dated April 17, 2018, into the final con- struction drawings subject to modifications that are agreed to by the applicant and City Engineer. 7. The exterior elevations shall meet the City ordinance criteria in relation to the quantity of required class one construction material. 8. All wall elevations greater than 100 feet in length shall include vertical banding designs and construction material variation. All drainage and utility easements required by the City Engineer shall be dedicated to the City and recorded on the final plat. Construction and Grading 10. Prior to the submission of the building permit application to the City, the applicant must submit for staff review and approval a final construction management plan that includes erosion control measures, project phasing for grading work, areas designated for preser- vation, a crushed -rock construction entrance, and construction -related vehicle parking. All emergency overflow swales must be identified on the grading and erosion control plan. 11. A pre -construction meeting with City staff and the contractor must be held before site work begins. The contractor will provide the City with a project schedule for the various phases of construction. 12. Erosion control devices must be installed prior to commencement of any grading activity. Erosion control shall be performed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Control Planning Handbook" and the conditions stipulated in Title 10-5-8, Erosion Control During Construction of the City's Subdivision Ordinance. 13. Upon completing site grading, four copies of an "As -Built" survey for the site grade eleva- tions must be submitted to the City. An electronic file of the "As -Built" survey must be submitted to the City Engineer. 14. All rooftop mechanical equipment shall be screened from public view as reviewed and ap- proved by the Community Development Department. 15. All at grade mechanical equipment shall be screened from public with Berming and land- scape vegetation as approved by the Community Development Department. 16. Any fencing on the site shall meet the City's architectural fencing standard of Ameristar Montage. I ltilitia.c 17. The applicant is responsible to provide for the necessary easements and costs associ- ated with road and utility improvements serving the site. All drainage and utility ease- ments as recommended by the City Engineer must be shown on the final construction drawings and be dedicated to the City for public purposes. 18. All stormwater designs shall meet the intent of the City's Surface Water Management Plan and the South Washington Watershed District water management plan. Streets 19. Right of -way permits are required for all construction activity within the public right-of-way of 85th Street or Ravine Parkway. The existing entrance drive pavement located at 85th Street shall be protected during con- struction or, if damaged, replaced per City detail plates. 21. The City's curb and sidewalk replacement policy must be complied with during construc- tion. Identified damages shall be the responsibility of the applicant. Li htin 22. All lighting on the site shall be downward directed. Construction drawings shall include a photometric lighting study. Sidewalks and Trails 23. All internal sidewalks and connections to public trailways shall meet accessibility re- quirements and city detail plates RAMP 1-6. Landscaping and Irrigation 24. Irrigation systems installed within City right-of-way are solely the responsibility and risk of the Applicant. The City is not responsible or liable for any damage or costs related to in- stallation, damage, or replacement of lawn irrigation systems placed in the boulevard as a result of City use of or future changes in the right of way. 25. The final landscape plan shall include native prairie grass plantings in areas identified for low mow fescue. The tree species and planting locations on the final Landscape plan shall be coordinated with the City Forester. 26. At the time of building permits, a letter of credit amounting to 150 percent of the land- scaping and irrigation installation estimate shall be submitted to and approved by the City. Upon completion of the landscaping improvements, the owner shall, in writing, in- form the City that said improvements have been completed. The City shall retain the fi- nancial guarantee covering the landscape improvements for a period of one year from the date of notice to ensure survival of the plants. No building permit shall be issued until the required financial guarantee has been received and accepted by the City. 27. The landscaping shall be installed per the approved landscape plan and continually main- tained in a live vegetative state, kept trimmed and free of refuse and debris, and replaced with live plantings when necessary. 28. The landscaping shall be maintained to the back of curb of 85th Street and Ravine Parkway. Surface Water Management 29. The lowest opening ground elevations of all structures shall be a minimum of two feet above the emergency overflow elevation. 30. All emergency overflow swales must be identified on the grading and erosion control plan. Prior to final grading, emergency overflow elevations shall be surveyed to ensure the emergency overflows are properly graded and maintained. The applicant will be required to conduct all major activities to construct the im- provements during the following hours of operation: Monday through Friday Saturday Sunday 7:00 A.M. to 7:00 P.M. 9:00 A.M. to 5:00 P.M. Not Allowed This does not apply to activities that are required on a 24-hour basis such as dewatering, etc. Any deviations from the above hours are subject to approval of the City Engineer. Violations of the working hours will result in a $500 fine per occurrence. 32. The applicant shall weekly, or more often if required by the City Engineer, clear from the public streets and property any soil, earth, or debris resulting from construction work by the applicant or its agents or assigns. All debris, including brush, vegetation, trees, and demolition materials, shall be properly disposed of off-site; burying construction debris, trees, and other vegetation is prohibited. Burning of trees and structures is prohibited, except for fire training only. 33. The applicant grants the City, its agents, employees, officers, and contractors permission to enter the site to perform all necessary work and/or inspections during grading and the installation of public improvements by the applicant. 34. Upon completion of the project construction work, the applicant shall provide the City with a full set of as -built plans for City records and transmitted to the City in a DWG Autocad format and pdf format. Applicant must also furnish the City with a pdf format of the final plat and four prints of the recorded plat. If the applicant does not provide as-builts, the City will produce them at the applicant's expense. 35. Adequate dumpsters must be on site during construction of the project. When the dump- sters are full, they must be emptied immediately or replaced with an empty dumpster to prevent debris from being blown off-site. 36. Adequate portable toilets must be on-site at all times during construction on the site. Toilets must be regularly emptied. 37. All areas disturbed by the excavation and back -filling operations shall be fertilized, mulched, and disc anchored as necessary for seed retention. Time is of the essence in controlling erosion. If the applicant does not comply with the erosion control plan and schedule, or supplementary instructions received from the City, or in an emergency de- termined at the sole discretion of the City, the City may take such action as it deems ap- propriate to control erosion immediately. The City will notify the applicant in advance of any proposed action, but failure of the City to do so will not affect the applicant's and the City's rights or obligations. If the applicant does not reimburse the City for any costs the City incurred for such work within thirty (30) days, the City may draw down the letter of credit to pay such costs. If the applicant does not reimburse the City for the costs the City incurred for such work within thirty (30) days, the City may draw down the letter of credit to pay such costs. 39. Dust control measures must be in place to prevent dust and erosion, including, but not limited to, daily watering, silt fences, and seeding. The City Engineer may impose rea- sonable measures to reduce dust at the site. Conditional Use 40. The future expansion of the gun range as detailed on the approved site plan is permitted with this conditional use permit and shall require an administrative site plan review prior to construction. The addition construction materials shall meet the existing facility in design and materials and be consistent with ordinance criteria. 41. The HERO Center Event coordinator shall notify the Washington County Dispatch Center for all planned outdoor training activities that may be of public concern. 42. Planned outdoor activities involving loud noises are exempt from the City's Noise Ordi- nance. 43. Upon any repeat noise complaints on the use of the site, the HERO Center event coordi- nator shall work with the Community Development Department to resolve identified issues. 44. Outdoor training activities involving loud noises shall be limited to a maximum of three scheduled events per week. 45. The use of sirens during training activities shall be permitted on a limited basis. 46. Cross parking easements and agreements for overflow parking on the City Hall Public Safety property is permitted and shall be memorialized with the Washington County Recorder. 47. All outdoor training activities shall end by 10:00 p.m. unless arranged in advance with the Cottage Grove Director of Public Safety. 48. The accessory training buildings shall be constructed with materials and design similar to the principal structure. Sheet CN001: 1. The typical pavement section for concrete sidewalk should match the City's standard detail plate STR-9. 2. General Note #2: Delete the phrase "on public right-of-way" in the note. All work on site should conform to the City Standard Specification. 3. Erosion Control Note #20 & #29: Cottage Grove does not publish the documents listed. Conform to the requirements in the City Standard Specification. 4. Specify the proposed bituminous mix to be placed. A C -oil should be provided as a minimum. chAAt rnnni 1. Borrow pits 2 & 3 appear to be under the stormwater basins and parking lot. Limit depth of borrow areas such that poor materials are not being placed below the proposed pavement section. If additional material is needed, the vicinity of ST -03 could be considered. SheetCS001: 2. Extend the proposed concrete sidewalk beyond on the west side of the entrance drive to the existing sidewalk along 85th Street. All sidewalk shall be 6' wide. Sheet C0001: 3. Site storm sewer shall be RCP, minimum diameter shall be 12 -inch. Storm sewer shall be designed for a 5 -year design frequency, with a minimum velocity of 3 fps in the pipe. Submit rational method calculations for storm sewer including a drainage area map. 4. Create a storm sewer schedule that depicts the structure number, type of structure, the City standard plate that should be referenced, casting, diameter of structure, and sump depth (where applicable). 5. Pipe to pipe connections of storm sewer will require manhole structures, no tees will be allowed. 8. The proposed storm sewer connections to the structures on 85th Street will require removal and replacement of existing sidewalk. 9. There are trench drains called out on the west side of the building that do not appear to connect to storm sewer. Please clarify how the drains will function. 10. Water main shall be ductile iron pipe. 11. The northeast stormwater basin calls out 200 LF of 6" PVC, but no pipe is depicted. 12. It appears the storm sewer across the drive entrance has minimal cover. Storm sewers under pavement should have 3' minimum cover, and 2' is preferred in greenspace. 13. The connection to the existing sanitary sewer stub is unclear as there is a 20 vertical foot change in invert elevations with a 1% pipe grade. It appears a drop structure should be provided in accordance with city standard detail plate SAN -4. The inside of a drop structure should be lined with a Zebron 300 series liner. 14. Clarify the intent of the parallel water main feeding the three hydrants in the rear of the building. 15. There is an existing 8" watermain stub provided on the south side of the property adjacent to the City Hall drive entrance. Consider connecting to the existing 8" stub versus a wet tap of the existing 18" main as currently shown. 16. There is already a gate valve in 85th street on the service line, there is no need to connect with another gate valve. Sheet CG001: 17. Identify pedestrian ramp locations/ADA access from parking stalls. 18. On the west side of the entrance drive, there is a 3% grade across the sidewalk gutter (and presumably pedestrian ramp). The maximum cross slope of sidewalks shall be 2%. Sheet CK001-CK003: 19. Utilize City standard detail plates where appropriate. 20. Identify where is the post indicator valve located on the site plan. Sheet L-160: 21. Avoid planting trees over storm sewer pipes and water main, verify landscaping plan complies. Sheet E-101: 22. Label parking lot lighting wire and conduit sizes. All wire shall be in conduit. Include light pole, luminaire, and base, details in the plans. A hand hole is required at each new pole location. The HydroCAD model includes existing conditions pervious area curve numbers (based on HSG C) that are higher than the proposed conditions pervious area curve numbers (based on HSG B). The South Washington Watershed District Standards Manual specifies: "For predevelopment conditions, the allowable range for a CN to reflect undeveloped conditions should fall within values of 52-62 and must not exceed a value of 62." Please either revise the HydroCAD model existing and proposed conditions pervious area curve numbers or explain why the values used are appropriate. 24. The proposed conditions HydroCAD model includes a small drainage area "4aS." This area is not routed in the HydroCAD model. A note on Sheet DM02 states: "4a left out of calcs, runoff is accepted by vegetation bed rock trap. no freeboard issue." This area needs to be routed downstream in the HydroCAD model. 25. The City requires runoff volume control for new development equal to 1 -inch of runoff from new impervious surfaces. New impervious surfaces of 3.65 acres are proposed. Four infiltration basins will treat a combined area of new impervious surface of 3.53 acres, leaving 0.12 acres of new impervious surface untreated. Please treat all areas of new impervious surfaces or explain why areas are not being treated. 26. The bioretention soil media composition is listed as 20% compost, 30% topsoil and 50% sand. We advise using one of the bioretention soil mixes listed in the Minnesota Stormwater Manual, particularly mixes with low silt and clay contents that will not restrict the infiltration capacity of the basins. 27. A P8 summary for the proposed condition was submitted, however, the P8 model summary appears to include errors in runoff volumes, flow and pollutant loadings. Please check the summary and also submit data showing the watershed area served by each treatment device, pervious curve numbers, etc. and indicate whether the P8 model includes the areas that do not flow to the infiltration basins or swale in the proposed conditions. 28. The City requires adequate pretreatment of stormwater runoff from development and redevelopment activities prior to discharge into all waterbodies. Pretreatment for the infiltration basins 1P and 2P is partially provided by curb cut Rain Guardian devices, but the storm drains outletting to basins 1P, 3P and 4P should also include a sump manhole or other pretreatment device.
