A; Site Location Map Review Process Application Received: March 28, 2018 Acceptance of Completed Application: April 11, 2018 60 -Day Review Deadline: June 10, 2018 Tentative City Council Date: May 16, 2018 Planning Staff Report Modern Automotive Site Plan April 23, 2018 Page 2 of 12 Planning/Economic Development Considerations Economic Development Background Modern Automotive Performance is an automotive aftermarket distributer, which manufacturers and remanufacturers vehicle parts, equipment, and accessories after the vehicle is sold through the dealership. Modern Automotive Performance is currently located at 9800 Hemingway Ave- nue in a 20,000 square foot building and has 45 employees. In the spring of 2017, Modern Automotive Performance presented at an entrepreneurial confer- ence that they were looking to expand operations due to the continual growth of the company. Modern Automotive searched throughout the Midwest for a list of interested communities and their associated options (land/facility, incentives, why their company would be a good fit, etc.). In June 2017, the City of Cottage Grove, GreaterMSP, and the Department of Employment of Economic Development (DEED) met with Modern Automotive Performance to determine what they were looking for in a new site. Modern Automotive Performance was looking to expand by an additional 25,000 square feet that would include loading dock doors and overhead doors for the distribution aspect of their business. As part of the expansion, they plan to add 20+ jobs. Modern Automotive Performance has been transparent that they were considering sites that could help them lower costs through business subsides during the construction process and a site that made geographical sense to ship their products around the United States. Modern Automotive Performance decided that since they qualified for the Job Creation Fund (JCF) through DEED and the potential for tax increment financing through the City of Cottage Grove's Business Subsidy Policy, expanding at their current location was the best option. For the DEED and proposed tax increment financing, Modern Automotive Performance will pur- sue approvals of those processes through the City's Economic Development Authority and City Council. Planning Background The facility at 9800 Hemingway Avenue was originally built by Kappa Industries in 2006. Kappa Industries came before the Planning Commission in 2006 for site plan approval that included the current 24,000 square foot building that Modern Automotive Performance operates out of. The site was also to have a second building to the west of the existing building to be built later. The original business located in the building by Kappa Industries went out of business and Modern Automotive Performance purchased the site in 2012. Planning Staff Report Modern Automotive Site Plan April 23, 2018 Page 3 of 12 ' Future Building Constructed Building Original Site Plan Approved in 2006 Due to the nature of Modern Automotive Performance's business operations, the original site plan approval from 2006 was not conducive to their operations; Modern Automotive Perfor- mance needed their expansion to be attached to their existing building. In order for Modern Automotive Performance to expand on their site and move the loading docks to be on the north side of the building to be separated from employee parking, Modern Automotive requested to purchase a 50 -foot wide parcel (21,104 square feet) of land at 9700 Hemingway Avenue located on the north side of their site. The parcel at 9700 Hemingway Ave- nue is 3.5 acres and is currently owned by the City of Cottage Grove Economic Development Authority (EDA). The purchase of the 50 -foot wide parcel would leave the City of Cottage Grove EDA a remaining parcel at 9700 Hemingway Avenue of 3.03 acres for future development. This would allow for a building up to 59,394 square feet to be developed according to our 1-2 zoning code at maximum building coverage. Ordinance Criteria Site plan approval is required by the City because this project abuts a residential neighborhood and differs in layout and operations form the original approval in 2006. The purpose of reviewing a site plan is to ensure new development conforms to city development standards and ordi- Planning Staff Report Modern Automotive Site Plan April 23, 2018 Page 4 of 12 nances and provides an appropriate development plan for the area. Modern Automotive Perfor- mance's business is a permitted use in the 1-2, General Industry District. The proposed development plan meets all the performance standards within the 1-2 District. Ap- proval of this application is subject to the provisions of the Zoning Ordinance and the conditions required by the City. Land Use Modern Automotive Performance is in Cottage Grove's Business Park and is consistent with the approved Comprehensive Plan 2030. The Comprehensive Plan guides industrial land use des- ignations as industrial development including research, manufacturing, distribution, assembly, and office uses. The City is currently in the process of updating their Comprehensive Plan for land uses guided through 2040. Per the Draft Comprehensive Plan 2040, Modern Automotive Performance's use as industrial continues to be in conformance with the proposed comprehen- sive plan. Zoning Modern Automotive Performance's property is zoned 1-2, General Industry. This zoning classifi- cation is consistent with the adopted Future Vision 2030 Comprehensive Plan and the proposed 2040 Comprehensive Plan update. Modern Automotive Performance is an allowed land use within the 1-2 zoning district. An excerpt from the Official Zoning Map for Modern Automotive Performance property (outlined in yellow) is shown below. The engineering review memorandum related to these site plans is dated April 17, 2018, and is attached to this report. The overall height of the new panels will extend approximately 2.5 feet above the exiting building. The majority of the construction will focus on the proposed ware- house addition, but some of the existing warehouse space will be converted to office and fitness space. Per the City's Zoning Ordinance, industrial and warehouse buildings must use at least two different classes of materials on the structure. The Zoning Ordinance also requires for every 100 feet of wall expanse that vertical variation is provided to break up the building massing. On the north elevation of the proposed warehouse addition there will be several high windows to break up the massing of the building. On the west elevation of the warehouse addition there will be no windows or doors facing the residential neighborhood. Elevations 0 auc eFv�Tba A4 Outdoor Lighting A schematic lighting plan has been submitted for the site. There are three additional lighting fix- tures proposed: two will be pole mounted lights near the south property line and an additional wall mounted fixture on the north side of the new addition near the proposed loading docks. Per current City requirements, all outdoor lighting must be downward directed with cut-offs and can- not exceed one-half foot-candle at the property line adjacent to residential areas. A lighting plan must be submitted to the Planning Division before a building permit is issued. Parking The minimum number of parking spaces required for the property at 9800 Hemingway Avenue in 2006 was 108 spaces. Currently, there are approximately 47 parking spaces on the site, but it is important to remember that the second building was never constructed to complete the park- ing requirement from 2006. The proposed 24,080 square foot addition along with the existing 20,000 square foot building requires a minimum number of 85 parking spaces. Modern Automo- tive Performance is proposing 112 parking stalls. Parking along Hemingway Avenue is currently posted as "No Parking Anytime." Utilities All city utilities are near the vicinity of the site and can provide the necessary capacities to serve the proposed addition. As part of the proposed 24,080 square foot addition, an existing Xcel En- ergy transformer will need to be relocated as well as the electrical service to the transformer. This is coordinated between the applicant and Xcel Energy. A public hearing will be held at the City Council on May 16 to vacate an existing drainage and utility easement along the north Planning Staff Report Modern Automotive Site Plan April 23, 2018 Page 7 of 12 property line for Modern Automotive Performance. The action is required because the new loca- tion of the drive aisle and parking lot on the north side would put these easement areas over impervious surface. The existing massing of trees and shrubs along the west property line was not to be disturbed in 2006, and that is to be maintained. This area was not used in calculating the minimum landscaping requirements. Trees and shrubs were to be planted along the front and side of the first building. Originally the landscape plan required additional landscaping in front of Building #2, but since that was not constructed, there is no landscaping in this area. Also, the west property line was to include a total of 26 evergreen and maple trees to be planted. The applicant will be constructing two berms as well as place ten spruce trees and five white pines on the berms. This will provide screening of the new parking area and the drive aisle area on the north side of the of the site as well as noise mitigation for the residential neigh- borhood. The City's Zoning Ordinance allows for security fencing as long as the barbed wire security extension posts to not exceed six feet in height above grade level. The security extension posts also must not exceed three feet in length and be angled in such a manner that does not extend over the owner's property boundary line. Security fencing is also prohibited within a required front yard or within 50 feet of a residential district. The proposed security fencing is approxi- mately 107 feet from the front yard setback and is 100 feet from the residential neighborhood to the west of the site. Noise Ordinance Public Safety and the Code Enforcement Division have received complaints about business op- erations from the applicant for several years. Below is a table of the total number of complaints received. Year Number of Complaints 2013 29 2014 12 2015 14 2016 24 2017 26 2018 (to date) 4 The majority of the calls Public Safety received were for excessive loud noise, but upon arrival at the location, most officers noted that no noise violation was heard. The noise ordinance states that between the hours of 10:00 p.m. and 7:00 a.m. no person shall congregate or partic- ipate in any party or gathering of people from which noise emanates of sufficient volume to unreasonably disturb the peace and quiet of other persons. A police officer can order persons present at the gathering to disperse and if the disturbance continues the owner shall take reasonable steps to abate such disturbance. The noise complaints for Modern Automotive Performance are mostly based around a piece of equipment known as a dynamometer (dyno) machine that measures horsepower. The owner has taken actions to mitigate the noise by installing baffling on the overhead door and exit where the machine is located within the existing building. Per the City's Zoning Ordinance Performance Standards for industrial uses, the noise levels in- side and outside of all the buildings must meet federal, state, and local requirements. At this time the applicant has complied with any Public Safety request when a noise complaint has been made. Planning Staff Report Modern Automotive Site Plan April 23, 2018 Page 10 of 12 Noise Abatement in Dyno Room Public Hearing Notices The public hearing notice for the April 23, 2018, Planning Commission meeting was published in the South Washington County Bulletin and mailed to 64 adjacent property owners within 500 feet of the proposed project on April 11, 2018. To date, a written comment was received from an adjacent property owner, which is attached. City Department and Advisory Commission Comments The City's Technical Review Committee met on April 11. At this meeting, no comments or rec- ommendations were made. The Public Safety Department reported that their department has received numerous calls regarding noise coming from the business. Public Safety will attend the Planning Commission meeting to address the noise complaints they have received. Ryan Burfeind, City Project Engineer, provided a memorandum from Bolton & Menk dated April 17, 2018, which includes a variety of requirements on grading, drainage, erosion control, and stormwater pollution prevention. A copy of the Bolton & Menk memorandum is attached. Recommendation That the Planning Commission recommend that the City Council approve the site plan review ap- plication for the 24,080 square foot addition Modern Automotive Performance located at 9800 Hemingway Avenue South, subject to the conditions stipulated below: Site Plan Review 1. The applicant and builders must comply with all City ordinances and policies except as may be modified by agreement of the applicant and City staff. All grading, drainage, erosion control, and utilities must conform to the final plans approved by the City Engineer. 3. The applicant shall incorporate the recommendations, requirements, and evaluations noted in the Bolton & Menk memorandum dated April 17, 2018, into the final construction drawings subject to modifications that are agreed to by the applicant and City Engineer. 4. The concrete aprons for the proposed new access drives shall be constructed per City requirements, and the removal of abandoned access drives shall comply with the re- quirements of the Public Works Department and the right-of-way permit. 5. All outdoor lighting must meet City Code requirements and must be downward directed with cut-offs. The specifications and analysis of all light fixtures must be provided with the application for a building permit. 6. All fencing must meet City Code requirements. 7. The applicant must provide the City with an electronic as -built survey of all private utilities prior to issuance of certificate of occupancy. 8. All mechanical equipment screening and trash enclosures must be constructed of mate- rials that are consistent with the principal building's exterior materials and comply with City ordinance regulations. 9. The applicant is responsible for removing debris from Hemingway Avenue South during their construction process. This street shall be swept clean daily or as needed. Parking along Hemingway Avenue South is prohibited. 10. Installation of landscaping shall occur in a timely fashion and be consistent with an approved plan dated March 27, 2018. 11. Rubbish, garbage, and recycling containers must be stored within an enclosed structure compliant with the screening requirements and shall be maintained at all times so as not cause odors or other public nuisances. No exterior storage is allowed. 12. The fire suppression plan must be submitted to and approved by the Fire Marshal and Chief Building Official before a Certificate of Occupancy can be issued. The property owner is responsible to maintain their private watermains, hydrants, and fire suppression systems. 13. A pre -construction meeting with City staff and the contractor must be held before site work begins. The contractor will provide the City with a project schedule for the various phases of construction. 14. Erosion control devices must be installed prior to commencement of any grading activity. Erosion control shall be performed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Control Planning Handbook" and the Planning Staff Report Modern Automotive Site Plan April 23, 2018 Page 12 of 12 conditions stipulated in Title 10-5-8, Erosion Control During Construction of the City's Subdivision Ordinance. 15. All rooftop mechanical equipment shall be screened from public view as reviewed and approved by the Community Development Department. 16. At the time of building permits, a letter of credit amounting to 150 percent of the land- scaping and irrigation installation estimate shall be submitted to and approved by the City. Upon completion of the landscaping improvements, the owner shall, in writing, in- form the City that said improvements have been completed. The City shall retain the financial guarantee covering the landscape improvements for a period of one year from the date of notice to ensure survival of the plants. No building permit shall be issued until the required financial guarantee has been received and accepted by the City. 17. The landscaping shall be installed per the approved landscape plan and continually main- tained in a live vegetative state, kept trimmed and free of refuse and debris, and replaced with live plantings when necessary. 18. The applicant will be required to conduct all major activities to construct the improve- ments during the following hours of operation: i. Monday through Friday 7:00 A.M. to 7:00 P.M. ii. Saturday 9:00 A.M. to 5:00 P.M. iii. Sunday Not Allowed 19. Upon completion of the project construction work, the applicant shall provide the City with a full set of as -built plans for City records and transmitted to the City in a DWG Autocad format and pdf format. Applicant must also furnish the City with a pdf format of the final plat and four prints of the recorded plat. If the applicant does not provide as-builts, the City will produce them at the applicant's expense. 20. The applicant is responsible for erosion control inspection fees at the current rates. If the applicant does not reimburse the City for the costs the City incurred for such work within thirty (30) days, the City may draw down the letter of credit to pay such costs. 21. Dust control measures must be in place to prevent dust and erosion, including, but not limited to, daily watering, silt fences, and seeding. The City Engineer may impose reasonable measures to reduce dust at the site.
