PUBLIC WORKS CORRIDOR ACCESS MANAGEMENT DIVISION TRANSPORTATION TERM aeaaeTun� THIS MEMORANDUM OF UNDERSTANDING, by and between the City of Cottage Grove, a municipal corporation, herein after referred to as the "City", and Washington County, a political subdivision of the State of Minnesota, hereinafter referred to as the "County." WITNESSETH: WHEREAS, the City and the County have collaboratively identified existing and future access locations along: • County State Aid Highway (CSAH) 19 (Keats Ave) from TH 61 to one mile north of 70'n Street • CSAH 13 (Hinton Avenue) • County Road 74 (65'h St) • CSAH 22 (70'h Street) • Jamaica Avenue • CSAH 39 (Hadley Avenue) north of 80'h St as shown on the attached maps dated March 1, 2018; and, WHEREAS, access locations are generally defined as those intersections where a public, city street will be constructed to connect to the county roads identified above; and, WHEREAS, the City of Cottage Grove is responsible for establishing local land use and local roadway system planning within the community; and WHEREAS, Washington County Public Works Department is responsible for the planning and engineering of the County's roadway system; and WHEREAS, the identified access locations generally follow Washington County's established guidelines for access spacing; and WHEREAS, faced with development proposals along the corridors and the realistic expectation that the corridors will continue to develop, the City and the County have partnered to develop a concept plan that will guide future access locations and work towards accommodating a future expansion to multi- lane divided roadways for these multi-modal corridors. NOW THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: A. PURPOSE Representatives of the City and the County's Public Works Department have met on several occasions to consider the corridor issues in the City. In consideration of those issues, concept Corridor Access Management Plans dated April 24, 2018 have been developed for each corridor (Exhibit A). These concept plans were developed to guide future development and land use decisions and minimize disruptions to access points when the roadways are expanded to multi-lane Page 1 of 3 divided roadways in the future.. B. IMPLEMENTATION Implementation of these Corridor Access Management Plans shall occur over time. 1. Short Term: a. The City will reference this MOU regarding the Corridor Access Management Plans in the City's 2040 Comprehensive Plan. b. The County will reference this MOU regarding the Corridor Access Management Plans in the County's 2040 Comprehensive Plan. 2. Onqoinq: a. The City and County will review development, redevelopment or expansion proposals for conformance with these Corridor Access Management Plans. The City will, through its development approval and land use authority, ensure substantial conformance with these Corridor Access Management Plans. The County will, through its highway right-of-way permitting authority, ensure substantial conformance with these Corridor Access Management Plans. b. This agreement could be amended in the future by mutual agreement between the City and County. Future amendments will be expected to remain in accord with the County's access spacing guidelines. c. Private Access (Residential and Commercial): • The County agrees that existing private access would remain in use however the access may be subject to modification or closure at the time of development, redevelopment or a highway improvement project. • The County discourages new direct private access to these corridors. Access to private property should be provided by the local road network wherever possible. Only when reasonably convenient and suitable access cannot be provided from the local road network should direct access onto these corridors be considered, and in these cases adjoining commercial properties may be required to share a common access in order to minimize access and provide adequate separation of conflicts between access points. d. The City will, through its land use authority, preserve adequate right-of-way, easements, outlots and/or setbacks to allow construction of the ultimate roadway improvements to county and city standards. The amount of right-of-way required at specific locations will be dependent on anticipated intersection traffic control, lane geometry, and city and county standards. Actual preservation will be addressed on a case by case basis. Nothing in this agreement shall be construed to override the County's Policy #8001, "Cost Participation between Washington County and Other Agencies for Cooperative Highway Improvement Projects", revised August 25, 2015, or its successors, with respect to cost sharing responsibility for right-of-way acquisition or other items. e. When appropriate, the City will conduct Mn/DOT Intersection Control Evaluation (ICE) studies for proposed improvements to intersections along the highways included in this agreement to determine the appropriate traffic control. f. The County will continue to review the needs of these corridors as part of the agency's long range planning process. When funding and priority needs are met, the county will review the proposed project and make a determination about its inclusion in the 5-year Capital Improvement Program (CIP). Page 2 of 3 g. As the City develops, additional restricted access points may be considered on a case basis and in accordance with the County's Comprehensive Plan, Right-of-Way Ordinance, and access spacing guidelines. h. Future restricted access points as referenced in the exhibits will be evaluated and monitored for traffic volume increases causing safety concerns and inefficient traffic movements at the intersection. Action to restrict the access points will have justifiable safety factors or other transportation warrants.
