The current business includes retail sales, dog day care, over- night pet boarding/kenneling, and indoor and outdoor pet play areas. The expansion project proposes to construct a 4,032 square foot addition on the back of the building. This addition will provide 43 indoor kennels (1,584 square feet), indoor pet play area (2,208 square feet), laundry and feed storage area (240 square feet), and 10 outdoor kennels. No. 2012-139). Planning Staff Report Hound -A -Round — Planning Case CUP12-030 December 17, 2018 Page 2 of 6 Planning Considerations Property Characteristics The Hound Around site is a 1.275 -acre site that has approximately 125 feet of frontage on West Point Douglas Road. The existing building is approximately 3,250 square feet with 36 parking spaces. There is a privacy fence eight feet in height along the southeast side property line that abuts the Allina Medical Center property. The same type of fence encloses the perimeter of the existing outdoor pet play area. The aerial photograph shown below shows a variety of vehicles and trailers in the rear portion of the lot. Apparently, these vehicles and trailers are only occasionally parked at this location and are not affiliated with some other business (e.g. contractor's yard). Existing Site Photo Because the proposed building addition will be located in an area that was previously an impervious surface (fleet parking area for the former Orkin Pest Control), no additional stormwater management is required. Land Use and Zoning The property is guided "commercial" on the Future Vision 2030 Future Land Use map. The proposed 2040 Comprehensive Plan also guides this area along West Point Douglas Road for commercial uses. The current and proposed building expansion for Hound Around is allowed in the PB District as a conditional use. This zoning classification is con- sistent with the approved Comprehensive Plan and the proposed update to the Comprehensive Plan. Based on the proposed use, the site is in excess of city ordinance minimum parking requirements. No existing parking spaces will be displaced for the construction of this proposed building addition. Planning Staff Report Hound -A -Round — Planning Case CUP12-030 December 17, 2018 Page 5 of 6 City Department Review Representatives from various City Departments reviewed the applicant's development plan on December 12, 2018. None of the attending City Department representatives had any comments or recommendations for Hound Around's proposed building expansion. No written comments or recommendations were received from other advisory commissions Conditional Use Standards In addition to meeting the performance standards required in the ordinance, the Planning Commis- sion must review the application for conformance with the following criteria established in City Code Title 11-2-9F: 11-2-9 F. Criteria for Issuance of Permit: 1. The use will be in conformity with the City's Comprehensive Plan and with the purpose, intent and applicable standards of this Title. 2. The use shall be located, designed, maintained and operated to be compatible with the existing or intended character of that zoning district in which it is located. 3. The use shall not depreciate values of surrounding property. 4. The use shall not be hazardous, detrimental or disturbing to present and potential surrounding land uses due to noises, glare, smoke, dust, odor, fumes, water pollution, vibration, general unsightliness or other nuisances. 5. The use shall generate only minimal vehicular traffic on local streets as defined by the trans- portation element of the Comprehensive Plan. The use shall not create traffic congestion, un- safe access or parking needs that will cause inconveniences to the adjoining properties. 6. The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. 7. The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the City. 8. The use shall preserve and incorporate the site's important natural and scenic features into the development design. 9. The use shall cause minimal adverse environmental effects. 10. The use shall not adversely affect the potential development of adjacent vacant land. Based on the information presented, City staff determined that the proposed project and architectural design comply with ordinance standards. Public Hearing Notices A public hearing is scheduled for the Planning Commission meeting on December 17, 2018. The notice announcing this public hearing was published in the South Washington County Bulletin on December 5, 2018 and mailed to 11 property owners within 500 feet of the property on December 6, 2018. The Planning Division has not received any written comments. Planning Staff Report Hound -A -Round — Planning Case CUP12-030 December 17, 2018 Page 6 of 6 Recommendation That the Planning Commission recommends to the City Council that the proposed building addi- tion and amendment to the current conditional use permit for Hound Around at 8607 West Point Douglas Road be approved. This recommendation will allow the construction of 4,032 square foot addition to Hound Around's existing 3,250 square foot building and the continued operations for retail sales, dog day care, pet boarding, and indoor and outdoor play area facilities. This recommen- dation is subject to the following conditions of approval: Drainage from the building addition shall not negatively impact adjacent properties. 2. All applicable permits (i.e.; building, electrical, mechanical) and a commercial plan review packet must be completed, submitted, and approved by the Building Official, Fire Marshal, and Public Works Director prior to the commencement of any construction activities. 3. Exterior lighting for security and illuminating the parking lot shall be deflected downward and away from adjoining properties and public streets. 4. If a trash dumpster is proposed in the future, the dumpster must be constructed with the same exterior materials and color as the principal structure and contain an opaque gate. 5. The existing eight -foot high wooden fence shall be maintained in good condition and re- paired in a timely manner. 6. Resolution No. 2012-139 approving the original conditional use permit and the conditions listed in said resolution shall continue to be effective for this project. 7. Exterior storage yards are a conditional use and not a part of this application. WHEREAS, public hearing notices were mailed to property owners within 500 feet of the property and a public hearing notice was published in the South Washington County Bulletin; and WHEREAS, the Planning Commission held a public hearing on November 26, 2012; and WHEREAS, a planning staff report, which detailed specific information on the property and the application request was prepared and presented; and WHEREAS, the public hearing was open for public testimony. The applicant attended the public hearing. No written or oral testimony was received; and WHEREAS, the Planning Commission unanimously (8 -to -0 vote) recommended approval of the application, subject to certain conditions listed below. NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Cottage Grove, Washington County, Minnesota, hereby approves the conditional use permit to allow a pet business including retail sales, dog day care, overnight pet boarding/kenneling, and indoor and outdoor play areas, located on the property legally described above, subject to the following conditions: 1. All applicable permits (i.e., building, electrical, grading, mechanical) must be completed, submitted, and approved by the City prior to the commencement of any construction activities. Detailed construction plans must be reviewed and approved by the Building Official. 2. All overnight boarding must be indoors. Intermittent supervised outdoor use of the outside area for animal "bathroom" activities at night would be permitted. Resolution No. 2012-139 Page 2 of 2 3. Animals will only be allowed outside between the hours of 6:00 a.m. to 9:00 p.m. in run and play areas. 4. All outdoor and indoor activities must be supervised by employees or a designated responsible adult. 5. A six-foot tall fence of wood or vinyl composite material must be installed along all sides of outside play area. Internal site fence materials must be reviewed and approved by the Planning Division. 6. The indoor areas and runs must be cleaned on a daily basis, and waste removal from the site must be contracted with a commercial refuse hauler. 7. The standard City and State noise rules will be applicable to the site. If the City receives noise complaints, the property owner must bring the noise on the site into compliance upon notification by the City. 8. The standard City and State nuisance ordinance rules will be applicable to the site. If the City receives odor complaints, the property owner must bring the odor on the site into compliance upon notification by the City. 9. Repeat violations related to noise, odor, or permit criteria will require additional review of the conditional use permit by the City Council. 10. Prior to building permit application, the applicant shall submit a detailed landscaping plan that meets the approval of the Community Development Department.
