A site plan review for the development of an industrial processing facility (air separation plant), which will be approximately 17,000 square feet, and related processing equipment, parking, and utilities. 2. A conditional use permit to allow for the construction of 130 -foot high and 160 -foot high cold box towers related to the proposed manufacturing use when 60 feet is the maximum building height in that zoning district. 3. A variance to the City's architectural requirements for exterior building materials. In order to facilitate this development, the City of Cottage Grove applied for a preliminary plat for a subdivision to be called Lake Flora Addition, which will be located on 43.71 acres of land north of 100th Street and east of Jamaica Avenue. Location Map Planning Staff Report Airgas Site Development February 22, 2019 Page 2 of 17 Site Plan Background In 2017, the City of Cottage Grove Economic Development Authority (EDA) worked to certify over 50 acres of land through Xcel Energy's Shovel Ready Certification Program for potential industrial businesses. In August 2018, Airgas USA contacted Xcel Energy for potential sites to expand their opera- tions in the Midwest market. Specifi- cally, Airgas USA was looking to build an Air Separation Plant to produce liquid oxygen, nitrogen, and argon that are used in many industrial and medical facilities. Figure 1 shows an example of an air separation plant y f�as they currently operate in Kentucky. Through the manufacturing process, no water is polluted nor are noticeable fumes, dust, vibrations, or disturbing noise created. Existing Property Characteristics The 43.71 -acre parent parcel is encumbered by a portion of historic Lake Flora, the 14 -acre dog park, and two utility easements. The site also contains a wetland area and varied topography. The site is currently leased out for small crop farm production. Site Orthophoto Detail Zoning The proposed use of the site for an Air Separation Plant (ASU), which is the process of taking air from the atmosphere and through the process of cooling and pressurizing that air, separates the air into liquid oxygen, nitrogen, and argon which is then used in various industrial and medical uses. Currently the site is zoned, 1-3, Heavy Industrial, but the use does require a conditional use permit (CUP) per the City's zoning ordinance (City Code 11-11-2). Additionally, the process of separating the air and turning the various elements into liquid requires the construction of a 160 - and 130 -foot cold boxes. This height exceeds our current ordinance requirements (City Code 11- 11-4) and will be a condition of approval. Conditional Use Ordinance Criteria The conditional review permit request is to allow per ordinance height exception criteria for two structures on the site to exceed the maximum structure height of 60 feet. They are respectively 20 and 30 feet in height. There are two proposed cold box towers that are required for the air sepa- ration process that are 130 feet and 160 feet in height. When reviewing CUP applications, the Planning Commission must review the application for con- formance with the following criteria established by City code: Title 11-2-9F. Title 11-2-9F Criteria for Issuance Of Permit: 1. The use will be in conformity with the City's Comprehensive Plan and with the purpose, intent and applicable standards of this Title. 2. The use shall be located, designed, maintained and operated to be compatible with the existing or intended character of that zoning district in which it is located. 3. The use shall not depreciate values of surrounding property. 4. The use shall not be hazardous, detrimental or disturbing to present and potential surrounding land uses due to noises, glare, smoke, dust, odor, fumes, water pollution, vibration, general unsightliness or other nuisances. 5. The use shall generate only minimal vehicular traffic on local streets as defined by the transpor- tation element of the Comprehensive Plan. The use shall not create traffic congestion, unsafe access or parking needs that will cause inconveniences to the adjoining properties. 6. The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. 7. The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the City. 8. The use shall preserve and incorporate the site's important natural and scenic features into the development design. 9. The use shall cause minimal adverse environmental effects. 10. The use shall not adversely affect the potential development of adjacent vacant land. The City's Technical Review Committee reviewed the application based on the above. None of the attending City Department representatives had any adverse comments or recommendations for the application. Site Plan The proposed improvements to the site include the construction of a 6,075 square foot single story, 20 -foot tall building with office (2,560 square feet) and a vehicle maintenance area (3,515 square feet). A larger unoccupied 32 -foot tall compressor building sized at 10,736 square feet is also planned. This building contains an air compressor and related equipment for air separation production. The two proposed cold box towers on the site would be 130 feet and 160 feet in height. The CUP for this application is related to the structure height of the proposed cold box towers that Planning Staff Report Airgas Site Development February 22, 2019 Page 5 of 17 are above ordinance criteria. The heights of the proposed cold box towers are unique in that they are related to the requirements of the manufacturing process and have a valid function in the process. Airgas would need an approval of the height of these cold box towers in any community in which they would operate, since the height is related to the production and not for aesthetic reasons. A water trunk extension will be required from the intersection of Jamaica Avenue and 100th Street that will be extended by the City of Cottage Grove. Access and Traffic Access to the site is via 100th Street. An additional secondary emergency access is proposed on the north of the site onto the unimproved Glendenning Road. The roadways, both Jamaica Ave- nue and 100th Street adjacent to the project, were designed to accommodate the anticipated traffic generated from the proposed project. Parking A total of 17 parking spaces are proposed for the project. The applicant's narrative explains the parking needs of the site. A recommendation to this report is that the comments found in the memorandum be met prior to the building permit application. Wetland The South Washington Watershed District requires a wetland buffer averaging 100 feet in width. The established wetland buffer shall be protected from negative impacts and encroachments at all times. Tree Mitigation The tree removal on the site does not exceed the tree mitigation requirements per the City Code. This allows for the essential operation of the air separation plant. The second building consists of a few offices and the maintenance shop where minor repairs will take place at the plant. With both buildings located to the north end of the site, only portions of the office/maintenance shop will potentially be visible from eastbound 100th Street. Airgas has incorporated approximately 20 per- cent of Class 1/2 materials on the east and south facing sides of the building which would poten- tially be visible from 100th Street. Findings of fact in support of the variance include that the public view of the exterior of the build- ings is minimal due to the setback from 100th Street, the extensive landscaping and surrounding fencing of the site so that the majority of the site will not be visible, and the site is not located near any residential development nor will be in the future. The Applicant has provided illustrations on the structure heights from several surrounding perspectives. Right -of -Way The proposed plat includes a segment of platted right-of-way encompassing 100th Street that will be dedicated to the City. Final Plat A final plat application has also been filed with the City and will be reviewed by the City Council in March. Recommendation That the Planning Commission recommend that the City Council approve the following subject to conditions; 1. A preliminary plat for a subdivision to be called Lake Flora Addition, which will be located on 43.71 acres of land north of 100th Street and east of Jamaica Avenue. This plat will create two industrial lots and two outlots. 2. A site plan review for the development of an industrial processing facility, which will be approx- imately 17,000 square feet, and related processing equipment, parking, and utilities. 3. A conditional use permit to allow for the construction of 130 -foot high and 160 -foot high cold box towers related to the proposed manufacturing use when 60 feet is the maximum building height in the zoning district. 4. A variance to the City's architectural requirements for exterior building materials based on the following findings: Public view of the exteriors of the compressor and office/maintenance buildings is limited from Jamaica Avenue and 100th Street. Conditions of Approval Site Plan Conditions 1. Final architectural plans, lighting, and exterior construction materials and colors must be re- viewed and approved by the Planning Department prior to the issuance of a building permit. 2. All applicable permits (i.e.; building, electrical, grading, mechanical, right-of-way) must be completed, submitted, and approved by the City prior to the commencement of any construc- tion activities. Detailed construction plans must be reviewed and approved by the Chief Building Official or City Engineer. 3. Prior to submittal of the building permit application, all comments related to the civil, site, utility, landscaping, grading, and building construction plans must be addressed and plans revised accordingly. Prior to the issuance of a certificate of occupancy, the applicant shall submit as -built survey plans in electronic format (pdf and dwq) for the site grading and all public and private utilities. 5. The engineering comments identified in the attached memorandum from Bolten & Menk dated 2/15/2019 shall be complied with prior to issuance of building permits. 6. Water main, sanitary sewer, and storm sewer improvements shall be constructed per City of Cottage Grove detail plates. 7. Any modifications to City utilities located on-site shall be at the full cost of the applicant. 8. Prior to the issuance of a building permit, public drainage and utility easements shall be ded- icated over all surface water storage areas, cross site conveyance routes and underground water utility infrastructure. 9. The final grading and erosion plan shall be approved by the City engineer. The grading and erosion control plan for the site must comply with NPDES II Permit requirements. Erosion control devices must be installed prior to commencement of any grading activity. Erosion control must be performed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Control Planning Handbook" and the conditions stipulated. 10. The grading plan and site grading of the property shall be consistent with the approved surface water management plan. 11. Temporary easements and restoration shall be required for planned grading on Outlot A. 12. All concrete and bituminous surfaces on the site must be maintained in good workmanship like condition at all times. 13. All fencing on the site shall be constructed with materials meeting the ordinance criteria related to commercial fencing. 14. Irrigation shall be provided for all sodded and landscaped areas including the curbed land- scaped islands interior to the parking lot. The irrigation system shall consist of an underground sprinkling system that is designed by a professional irrigation installer to meet the water requirements of the site's specific vegetation. The design build system shall cover all the disturbed green spaces and extend to the street curbs. 15. Landscaping on the site must be maintained in good health at all times, and dead plantings shall be replaced in a timely manner. 16. A light matrix study shall be completed and submitted with the building permit application. All outdoor lighting must meet City Code requirements. All light fixtures must be downward di- rected with cut-offs. The specifications of all light fixtures must be provided with the application for a building permit. Fire hydrants shall be placed as per the approval of the City's Fire Marshal, City Engineer, and Public Works Department. In addition to granting public drainage and utility easements over the water pipe infrastructure, the applicant shall guarantee the City's ability to access the fire hydrants to flush the water system. 18. Parking related to the use on the property on Glendenning Road, and 100th Street is pro- hibited. 19. The applicant has provided demonstrated parking on site. If parking is not adequately pro- vided on site to meet the user needs, then the proof of parking shall be constructed upon written notification from the City. 20. Trash and recycling containers must be stored indoors or in enclosures meeting City ordi- nance criteria. 21. All rooftop and at -grade mechanical equipment shall be screened from public view as reviewed and approved by the Community Development Department. 22. As a component of the site plan review, a comprehensive sign package shall be submitted for review and approval by the City. Signage is prohibited on all towers and tanks that occur on site. 23. The applicant shall obtain a right-of-way permit from the City for any grading activity com- pleted on public right-of-way. 24. The applicant shall obtain a temporary construction easement from the City for any grading activity completed on public right-of-way. 25. The restoration plan for all public right-of-way disturbed by grading activity shall be at the direction of and meet the approval of the City Engineer. 26. The established wetland buffer shall be protected from negative impacts and encroach- ments at all times. Platting Conditions 27. All drainage and utility easements required by the City Engineer shall be dedicated to the City and recorded on the final plat. 28. Outlot B shall be dedicated to the City via Warranty Deed. Variance Conditions 29. The building exteriors shall meet the plan requirements detailed on the building elevation plan from Edward Farr Architects, Inc. dated 1/29/2019. Conditional Use Conditions 30. The site shall be in compliance with all required Federal Flight Agency regulations in rela- tion to the structure heights. This facility will manufacture and distribute oxygen, nitrogen and argon gases; and operate 24 hrs a day, 7 days a week. Facility Description and Design: The facility includes multiple elements and structures: 1. Main Office / Vehicle Maintenance Building — a 6,075 sq ft x 20 ft tall single story building containing 2,560 sq ft of office area and 3,515 sq ft of vehicle maintenance area. This building will have 'Cool Solar White' color prefinished metal siding (Class 4) and reddish -brown simulated face brick wainscoting (Class 1 / 2) wall finishes with a 'Cool Shell Grey' color prefinished standing seam metal roof. Compressor Equipment Building — a 10,736 sq ft x 32 ft tall single story building, unoccupied; containing a 12,000 hp motor for a nitrogen compressor, a 4,000 hp motor for an air compressor and related equipment. Five (5) Gas Batching Tanks — each approx. 110 ft long x 12 ft diameter, on concrete saddle supports with tank tops approx. 24 ft above grade, painted white color. 8. Cooling Tower and Water Treatment Enclosure —The Water Treatment Enclosure is a 150 sq ft x loft high, neutral toned, premanufactured structure containing the water treatment chemicals for the adjacent Cooling Tower. The Cooling Tower is approx. 24 ft tall. 9. Truck Scale Control Enclosure — a 300 sq ft x 10 ft high, neutral toned, premanufactured structure containing electronic control equipment adjacent to the nearby truck scale. 10. Miscellaneous Process Piping, Tanks, Valves and Control Units — Connecting equipment to support the manufacturing and distribution processes, field painted various tones; some white and some specially colored to identify their product. The Case for Variance of Wall Materials: Both of our primary buildings (Compressor Bldg and Office / Vehicle Maintenance Bldg) are located behind exterior equipment, process piping and large tanks in the front and side yards, so the exterior wall materials are neither dominant, nor prominent, to surrounding views, especially from the public way. They are setback 350 ft from 100th St. S. frontage, and 125 ft from the gravel lane (Glendenning Rd. S.) Accordingly, it wouldn't be appropriate to create more "visual interest" on the facades; but rather, let those facades provide a uniform Neutral Background tone to the process equipment in the foreground. Our objective is to provide adequate perimeter screening of the ground equipment via strategic placement of perimeter landscaping and a perimeter solid fence. Our 3D renderings demonstrate that there are no significant views to the primary buildings from 100th St. S. Our proposal is to use prefinished metal siding (Class 4) wall materials on most of the walls to act as that Neutral Background. As recommended by your Planning Dept,; and out of respect for any future development on the east side of the adjacent pond; we have added simulated (EIFS) face brick wainscoting (Class 1 / 2 material) to the Office & Vehicle Maintenance Building's South and East facades. We have 21% of those facades treated accordingly. Attached to this narrative is product information about the simulated (EIFS) face brick system; including a picture of a local example used successfully along an urban public sidewalk. Signage: One ground -mounted sign is needed at the entry driveway, with the company name and address. Painted company name signs are proposed near to the top of the taller Distilling Tower; one sign on the north face and a second sign on the south face. Parking: The use of the facility does not fit squarely within any specific use category in the city's 'Required Off Street Parking' table 11-3-9, F. Airgas runs 3 shifts, 24/7. The weekday shift has the most employees, 15, including six employees on site in the Office / Maintenance Building, plus nine delivery drivers that only show up to park and take their truck on the route. The Compressor Equip. Bldg is normally unoccupied. All other shifts have fewer employees. We are proposing parking for 17 cars, which allows for two extra / visitor stalls in addition to the 15 employees. The site is gated for security, and is not open to the public. The delivery trucks make deliveries 24 / 7; only returning to reload and change drivers. So the site does not need to accommodate the entire truck fleet parking on site. Further, the truck route times are somewhat staggered so that doesn't cause overlapping shift -change double parking issues. Landscaping and Screening: We are providing a perimeter fence, 6 ft in height with 100% opacity, made from no -maintenance vinyl planks; light tan color. The fence, in combination with the plantings, will serve as a screen to the building and related process piping. Landscaping consists of hardy, climate appropriate shade trees and evergreens. The planting pallet is varied and contains a native and non-native mix of tree types that should perform well in the area indicated. As shown on the landscape plans, we are proposing planting additional evergreen trees beyond code requirement to further enhance the screen as a tradeoff for a portion of the code required shrub counts since the perimeter plantings are a more appropriate focus for this facility. Wetland: The City of Cottage Grove contracted Bolton & Menk, Inc. to perform wetland delineation for the water habitat that borders the east side of the project site. South Washington Watershed District (SWWD) considers this wetland to be a "protect" classification level requiring a 100 -foot average buffer. A field investigation by Bolton & Menk was performed on November 2"d, 2018 to stake the west boundary of the wetland for determining the extent of the required 100 -foot wetland buffer which is reflected in the site plans. Delineation approval is anticipated from SWWD in May 2019. No impervious surfaces from the proposed development are proposed within the buffer area and on-site stormwater management has been designed to meet the water quality requirements for site discharge to the wetland. Sanitary Sewer and Storm Water: The nearest available sanitary sewer is a 30" diameter public trunk line that runs along the east edge of the property. The facility proposes one 4" domestic sewer pipe to drain northeast and connect to the trunk line at the nearest existing manhole with an exterior drop connection which is the preference of City Engineering staff. Stormwater runoff from the roof drains and all developed impervious surface will be collected in two infiltration basins designed to meet requirements for runoff rate control, volume reduction, and water quality. The basins are proposed at the northeast and southeast corners of the site, respectively. Site Lighting: LED lights on poles and one LED wall pack light are proposed; refer the Site Lighting Plan. All fixtures are downward -cast style. We have contacted the local FAA office to inquire about safety lighting on top of the 160 ft tower. Their preliminary opinion is that no special lighting will be required, due to tower being less than 200 ft tall, and its proximity 5.5 miles away from Fleming Field in South Saint Paul. They did ask us to apply for a more formal review via their online "Obstruction Evaluation / Airport Airspace Analysis" (OE/AAA) process; however that FAA service wa temporarily closed due to the federal government shutdown. Sheet C1.01: 1. Consider referencing the 2018 edition of the MnDOT standard specifications for construction, as that edition is referenced within the City standard specification. Sheet 3.01: 2. Due to the detail on sheet C9.01 as well as key note M, we assume a ribbon curb is proposed around the perimeter of the pavement. However, key note M is not labeled anywhere in plan view. 3. There appears to be no interior ribbon curb adjacent to paved areas. Ribbon curb is recommended for edge protection in areas where vehicles may depart paved areas onto the aggregate surfacing. 4. We assume key note J represents the bollard detail on sheet C9.01. 5. Clarify/label the type of perimeter fence proposed. 6. There are existing overhead power lines that run north -south along the east side of the current access road (old Glendening Road South) shown on C2.01. The lines are also shown on sheet C3.01 within the fenced property. However, these overheads lines do not appear on the perspective view from 100th on Sheet A4. At this time we assume they will remain in place and are not to be relocated underground. There also appears to be an aerial cable line attached to the power poles. It is our understanding that these utilities have a prescriptive easement. 7. The area identified as a Lay Down & Construction Parking Lot on the north side of the site is mostly north of the proposed Airgas property. This will require a temporary easement with the property owner to the north. 8. Provide a stop sign at 100th Street. 9. Identify proposed traffic control measures on 100th Street as work is depicted right up to the travel lane. Depict measures to protect Lake Flora during installation of the storm sewer down near the lake. As depicted, the pipe extends beyond the perimeter silt fence. Sheet C6.01: 18. Extend the proposed FES to the water elevation of Lake Flora. 19. The city fire marshal has reviewed and approved the location of onsite hydrants. 20. The proposed 4" sanitary sewer service pipe should not connect to existing trunk sanitary sewer manhole as depicted, it goes against flow. The 4" service pipe should be installed directly east from MH -01 and connect directly to the existing trunk line. This connection should be constructed using the Inserta Tee Fatboy detail attached to this memo. Due to this change, MH - 01 could also be relocated further south if desired. a. Cleanouts are needed if the service length exceeds 100 feet (City detail SER -10). 21. The plan view identifies RCP storm sewer pipe with the exception of two segments at the south west corner of the site being PVC. The utility construction notes on the sheet state all storm pipe shall be HDPE. Change all labels and references to utilize RCP storm pipe except where different materials are required by the Department of Labor and Industry (at water crossings). 22. Provide a profile and detailed elevations of the proposed storm sewer pond outlet pipe crossing the existing trunk sewer at the northeast and southeast corners of the site. Shpptt C9_n1 23. A stormwater maintenance agreement shall be required for all basins and the pipe outside of the subject property to Lake Flora. The City will follow up with an agreement form. 26. Rational Storm Sewer Design: On-site storm sewer should be sized to a 5 -year rational method design. Submit rational method design calculations for the storm sewer system. Please submit a drainage area map for each catchment. Include individual pipe segment velocities with calculations for review. Trunk facilities should be analyzed and designed to accommodate the 100 -year ponded discharges plus 5 -year rational flows from areas that enter the trunk to be carried to the next storage area downstream. 27. For stormwater facilities with emergency overflows, the low entry elevation for all new structures must be a minimum of 3 feet above both the peak surface water elevation for the 100 -year precipitation event and 2 feet above the emergency overflow elevation of any immediately adjacent new stormwater basin. The stormwater management plan indicates that the emergency overflow elevations for the north and south basin are 777.25 and 780.25, respectively. The proposed buildings have finished floor elevations of 784.5 feet as shown on Sheet C4-01. The highwater levels for the infiltration basins are 775.42 and 779.6, for the north and south basin respectively. The NWL and EOF elevations should be shown on the plan sheets. The proposed basin HWL and EOF design elevations within the stormwater report comply with the freeboard requirements. 28. The South Infiltration Basin (Pond 3P) is modeled in HydroCAD with exfiltration at 0.45 inches per hour. The pretreatment forebay is 3 feet deeper than the infiltration basin, with the invert of the pretreatment cell at elevation 774. There is a problem related to the bottom elevation of the pretreatment basin: 1) 48 hour drawdown rules limit the depth that an infiltration basin can be (1.8 feet for infiltration rate of 0.45 inches per hour). The HydroCAD model should be revised to only allow exfiltration within the infiltration basin and not within the pretreatment forebay. 29. Soil Borings: Soil borings and a geotechnical report have been provided. The report indicates that except for Boring B-01, all other borings encountered limestone at depths from 3 feet to 15 feet. Boring B-01 is located near the proposed north infiltration basin (Pond 2P). The basin design bottom elevation is 773. Groundwater was encountered at elevation 764-9 feet below the planned basin bottom. Silt soils are found near the surface overlying well graded sands. If a silt layer is encountered during construction it should either be removed or a lower infiltration rate should be assumed. Boring B-06 is located near the proposed south infiltration basin (Pond 3P). The basin design bottom elevation is 777. Limestone bedrock was encountered at elevation 774.1-2.9 feet below the planned basin bottom. Please note that at least 3 feet of separation to bedrock must be provided so should the encountered rock elevations vary, rock excavation may be needed when constructing the basins. 30. The geotechnical report states: "The underlying limestone and relatively close proximity to mapped karst features could lend itself to karst-induced subsidence. The applicant should demonstrate how this potential condition has been investigated and the suitability of the proposed infiltration areas onsite. In addition, the South Washington Watershed District Rule 8 includes standards that are applicable to projects on sites with known karst features. The South Washington Watershed District interactive map viewer (http://map.swwdmn.org/) includes "Known Karst Features" and "Bedrock Faults" layers under the Land mapping layer. The District advises that remediation procedures should be in place to address karst features if they develop on site. Please refer to the Watershed District for the full text of the rule. 31. The City requires a uniform volume control treatment equal to 1" of runoff from the net increase in impervious areas. The SWPPP indicates an area of disturbance of 8.3 acres and impervious areas of 0.25 acres existing and 3.76 acres proposed. Therefore, a Net Increase in impervious surfaces of 3.51 acres is proposed. The HydroCAD models indicate existing and proposed impervious areas of 0.23 and 3.93 acres, and a net increase in impervious area of 3.70 acres. Please resolve the impervious area discrepancies between the stormwater management plan, the SWPPP and the HydroCAD model.
