Proposal
Danner, Inc. applied for an Interim Conditional Use permit (ICUP) for the ability to grade and
excavate approximately 500,000 net cubic yards of earth materials from approximately 38.42
acres of land located northwest of Keats Avenue and East Point Douglas Road, known as the
Apache site. The grading plan proposes the following:
• Installing/repairing erosion control early in May 2019
• Start grading operations in May 2019
• Grading to follow proposed phasing plan.
• Removing trees and brush in conjunction with the grading phases.
• Stockpiling various dirt materials and hauling material off-site.
• Screening dirt material and stockpiling the material on-site.
• Loading dirt materials onto trucks and hauling the material off-site.

Planning Considerations
Background
Since 2009, Danner Inc. has operated similar grading and export activities on this property and
the 6.7 -acre property directly south of the proposed 38.42 -acre Apache site. Resolutions 2009-
102 and 2010-108 regulated this activity and still are in effect. Both properties are under the
same ownership and share a common access point onto East Point Douglas Road. The previ-
ous grading and extraction process resulted in the removal of approximately 600,000 cubic
yards of material from 32.5 acres of the site. The current planning application request is for the
next phases of the project needed to continue to grade and extract material, fine tune current
graded areas, and establish building pads with elevations suitable for future commercial and
high density housing development.
Grading Operations
Grading on the 38.42 -acre site will begin in the southeast corner. As Danner begins to excavate
into this hillside, much of the grading activity will occur on the 6.7 -acre parcel. Materials will be
stockpiled on this smaller parcel and hauled away as the material is needed for off-site construc-
tion projects. As more material is needed, Danner will continue excavating northward and west-
ward into the hillside on the Apache site. The phasing plan is shown below.

Grading Plan
The previous grading activities on the site established a vegetated sloped berm/buffer along
Keats Avenue for the purpose of screening the grading activities from public view. This buffer
will remain under the proposed grades. The finished grade elevations will increase as the site is
graded to the north. As proposed, grade elevations for Phases 1 through 3 have a low elevation
of 878 feet above sea level and a high elevation of 892 feet above sea level.

Grading Plan
Tree Inventory
A tree inventory dated April 13, 2009 was completed for the Apache parcel. A total of 374 trees
are proposed to be removed in all three phases. The tree species and trunk caliper size for each
tree was included in this inventory. This information will be used to calculate the tree mitigation
requirements when the site is developed in the future.
Future Development
The application material includes a concept detail showing future pad development of the site. It
is included below.

On February 20, the City Council approved a grant application to the Washington County CDA
for the master planning of the Shoppes at Cottage View area. The purpose of the master plan
will allow for the City to market the site at various economic development related events. The
Shoppes at Cottage View is a "gateway" into the community and the City wants to ensure that
the site is planned appropriately for the future. The City will work with Danner Inc. and the
property owner to ensure that the final grading plan matches the adopted master plan for the
Shoppes at Cottage View.

Erosion Control and Stormwater Management
The City's consulting engineer, Bolton & Menk, reviewed the application and provided comment
in the attached letter from dated March 21, 2019.
Summary
A, The phased grading/excavation on the site has occurred since 2009 with no negative issues
identified by the City.
The proposed grading establishes the road bed elevations for the future Ravine Parkway
and the Cottage View Drive.
Removing dirt now should reduce some of the grading costs for future development on the
Apache parcel.
r The final grading plans will be required to match the approved small area land use and
transportation study adopted by the City.
Recommendation
That the Planning Commission recommend to the City Council approval of an Interim Conditional
Use Permit to allow the continued grading of the Apache site as proposed on the grading plan
dated February 2, 2019, as prepared by Pioneer Engineering, subject to the following conditions:
1. The grading permit shall expire on April 1, 2026, or upon rezoning of the property.
2. The site shall be restored by June 1, 2026, with ground cover elevations and slopes
approved by the City Engineer.
3. An as -built survey of the final site grades shall be provided to the City prior to the release
of any financial guarantees.
4. The conditions of Resolutions 2009-102 and 2010-108 shall be complied with.
5. A financial guarantee, in the form of a cash escrow or letter of credit, of 150 percent of
erosion control costs, necessary site restoration, and street sweeping must be posted
with the City before a grading permit is issued.
6. The City has the authority to revise the grading permit if on-site conditions or changing
conditions make the original grading permit ineffective. The City may suspend or revoke
a grading permit whenever the permit is issued in error or on the basis of incorrect infor-
mation being supplied or is found to be in violation of any local, state, or federal ordi-
nance or regulation. The City will provide written notice of the intent to suspend or revoke
the permit based upon the above criteria.
7. Finished grades shall have a minimum topsoil of at least four inches.

8. All exposed soils resulting from grading activities must be seeded within 10 days of the
completion of the active site grading activity. The City may approve an extension of this
deadline, but in no case shall site restoration be delayed beyond October 1.
9. Any grading which creates erosion or sedimentation problems, flooding, ponding, and/or
negatively alters water drainage must be corrected by the land owner or operator.
10. Temporary basins may be required as part of erosion and sediment control during con-
struction operations. The duration of the basins is dependent upon the time of excavation
and re -vegetation of the site.
11. Land shall be developed in phases of workable size such that adequate erosion and sedi-
ment control measures can be provided as construction progresses. The smallest practi-
cal area of land shall be exposed at any one period of time.
12. For soil stockpiles greater than 10 cubic yards, the toe of the stockpile must be at least
30 feet from any road or drainage channel. Erosion from stockpiles shall be controlled by
placing appropriate barriers around the pile as necessary to contain sediments. If these
measures do not adequately control the erosion, the piles shall be stabilized by mulching,
vegetative cover, tarps, or other means. Any stockpile that is intended to be left over
winter must have a temporary vegetative cover established and adequate sediment con-
trol measures surrounding its perimeter by October 31.
13. A temporary rock pad entrance must be installed at all points where vehicles exit and
must be constructed prior to commencement of grading activity. The rock pad is to be
maintained to accommodate continuous removal of mud from vehicles. The rock pad
must meet design criteria, standards, and specifications found in the MPCA publication
"Protecting Water Quality in Urban Areas."
14. The landowner or operator must sweep East Point Douglas Road as needed to remove
any sediment and/or debris that may accumulate due to vehicles and equipment entering
and exiting the site. The City may require street sweeping within 24 hours of verbal or
written notification. If the street is not swept, the City will clean the street and bill the
owner or operator, as determined by the Public Works Director.
15. Corrective action and landscape restoration for erosion or sedimentation problems on
neighboring properties, or any location other than the permitted site, must commence
within 24 hours of written or verbal notification.
16. Burying organic material or construction debris is prohibited.
17. Site grading activities cannot occur between 7:00 P.M. and 7:00 A.M.
18. The landowner and operator must allow City staff to enter the site to inspect the erosion
and sediment control measures required by the permit.
19. Bituminous/asphalt materials are prohibited from being buried or temporarily stockpiled on
the property.

20. Prior to grading, all trees to be preserved must be field identified and grading limits cor-
doned with a suitable barrier such as snow fencing by the applicant and verified by City
staff. The barrier shall be located to coincide to the extent practicable with the drip line of
trees to be preserved.
21. The tree inventory dated April 13, 2009, will be included in the review process and tree
mitigation requirements will be imposed on the future development of this site.
22. Access from Keats Avenue (CSAH 19) is prohibited.
23. Crushing rock and other materials is prohibited.
24. Comments in the Bolton & Menk letter dated March 21, 2019, shall be addressed prior to
issuance of the grading permit.
25. Uncontrolled stormwater or sediment runoff from the site is prohibited. Runoff from the
site shall not have negative impacts to neighboring properties or right-of-way. Any
damage caused to neighboring property or right-of-way as a result of stormwater runoff
shall be repaired by the applicant.

A submittal for the Danner, Inc. Apache Mining Permit Project was received March 13`',
including a Phasing and Grading Plan (2/15/19) by Brian Molinaro of Pioneer Engineering.
The following comments relating to stormwater are provided:
Rate Control: Peak flow rates after development shall not exceed pre -development peak flow
rates for the critical 2 -year, 10 -year, and 100 -year recurrence interval precipitation events. Please
submit a hydrologic analysis for existing and proposed conditions. Use 24-hour NOAA Atlas 14
Precipitation events for rate control analyses and pond storage design.
NPDES Construction Stormwater Permit: As this project disturbs more than 1 acre, an
NPDES Construction Stormwater Permit and SWPPP will be required. Part of the project area
drains less than 1 mile to Ravine Lake which has an EPA -approved impairment for nutrients.
The impairment is considered to be construction related and requires additional best management
practices (BMPs), site stabilization within seven (7) calendar days after the construction activity
ceases in that portion of the site, temporary sediment basins for areas with five (5) or more acres
disturbed at one time, and may also require SWPPP review by the MPCA.
