The proposal is a result of the City's request to terminate the applicant's existing lease allowing for the antennas and equipment to be located on the communications tower at the former Cottage Grove City Hall location. A new agreement with the City permitting Verizon to lease space on the Meadow Grass water reservoir will also require City Council approval in addition to the 2019 CUP. Installation of the proposed antennas would allow for continued coverage of Verizon Wireless service within the Cottage Grove area. Verizon plans for installation of the permanent communi- cations equipment at the site prior to August 15, 2019, although, if additional time is needed to meet all regulatory standards, a temporary communications site may be installed. Approval is subject to the provisions of the zoning ordinance and any conditions required by the City. When reviewing conditional use permits, the Planning Commission looks to City Code Title 11-2- 9F; Criteria for Issuance of Conditional Use Permits, as the guiding doctrine for review. This section states that in granting a CUP, the City Council shall find that: 1. The use will be in conformity with the City's Comprehensive Plan and with the purpose, intent and applicable standards of this Title. 2. The use shall be located, designed, maintained and operated to be compatible with the existing or intended character of that zoning district in which it is located. 3. The use shall not depreciate values of surrounding property. 4. The use shall not be hazardous, detrimental or disturbing to present and potential surrounding land uses due to noises, glare, smoke, dust, odor, fumes, water pollution, vibration, general unsightliness or other nuisances. 5. The use shall generate only minimal vehicular traffic on local streets as defined by the transpor- tation element of the Comprehensive Plan. The use shall not create traffic congestion, unsafe access or parking needs that will cause inconveniences to the adjoining properties. 6. The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. 7. The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the City. 8. The use shall preserve and incorporate the site's important natural and scenic features into the development design. 9. The use shall cause minimal adverse environmental effects. 10. The use shall not adversely affect the potential development of adjacent vacant land. The City's Technical Review Committee reviewed this application under those criteria. The Com- mittee found that the CUP criteria could be met, and the conditional use permit for Verizon Wireless, LLC could be approved subject to conditions. Verizon's application complies with City ordinance regulations. Installing six additional antennas to the mounting platform on top of the water reservoir structure will not significantly change the appearance of the reservoir's top. Planning Staff Report Verizon Wireless, LLC — Planning Case No. CUP2019-012 March 21, 2019 Page 3 of 7 Equipment Storage and Antennas The communications tower at the former City Hall location (7516 80th Street South) was con- structed in 1998. Verizon Wireless has had a lease with the City for their antennas at this location since approximately 2014. The City has requested early termination of the lease for the antennas, which requires decommissioning and relocating the Verizon equipment. The former City Hall is planned for redevelopment and demolition of the building would take place during the summer of 2019. The six antennas would be located on the guardrail of the approximate 150 -foot water reservoir. The antenna equipment would be installed on galvanized steel pipes and would extend approxi- mately eight feet above the guardrail. The antenna size would be similar in size to the existing antennas currently located on the guardrail. Wireless communications equipment from other com- panies currently exists on the reservoir. Additional equipment storage cabinets would be installed and located at grade level within the water reservoir and would not be visible. Depending on the timing of State and Federal regulatory considerations, permitting processes, contractor and construction schedules, and weather, Verizon may be required to install a temporary site near the southwest corner of the property until installation of the permanent equipment has been completed. The area would be approximately 440 square feet and would be contained by a chain-link fence. Equipment within this area include exterior cabinets and an ap- proximate 102 -foot monopole tower to support the temporary antennas. The applicant's goal is to have the permanent equipment operating at the Meadow Grass location prior to decommissioning the equipment at the old City Hall site, although the temporary site may be in place for up to 24 months. Public Hearing Notices The public hearing notice was mailed to 160 property owners who are within 500 feet of the site on March 13, 2019 and published in the South Washington County Bulletin on March 13, 2019. Recommendation That the Planning Commission recommend to the City Council approval of Verizon Wireless, LLC's request to install four antennas on top of the City's Meadow Grass water reservoir as shown on Verizon's site plan prepared by Design 1 dated December 13, 2018 and subject to the following conditions: All applicable permits (i.e., building, electrical, mechanical) and a commercial plan review packet must be completed, submitted, and approved by the Building Official, Fire Marshal, and Public Works Director prior to the commencement of any construction activities. 2. Applicant must submit as -built drawings to the City upon completion of the installation. 3. The applicant continues to work with the Public Works Department in finalizing the lease area. The applicant must schedule a pre -construction meeting with the Public Works Director and City Engineer before work can begin. 6. Advertising on the antennas or equipment building is prohibited. 7. Outdoor storage is prohibited. 8. Color and sample materials for all cables, antennas, mounting brackets/braces, and equip- ment must be submitted to the Public Works Director for final approval prior to issuance of the building permit. City -specified manufactured colored coaxial cable will be required (painted coaxial cable will not be accepted). 9. No significant change in the use or design of the antennas may be made without consent of the Public Works Director. Minor modifications to service or use may be considered if such changes will not cause the antennas to violate the performance standards set forth in the City Codes or the conditions of this conditional use permit. 10. Utilities must be installed underground as approved by the Public Works Director. 11. The applicant must restore turf areas damaged by construction of the temporary communi- cations site by providing a minimum of four inches of topsoil and seeding and watering of all disturbed areas. Seed mix shall be approved by the Public Works Director.
