The generator would be screened by vinyl privacy fencing. A new lease agreement with the City permitting the additional use of space would require City Council approval in addition to the 2019 CUP. Location Map Review Process Application Received: April 24, 2019 Acceptance of Completed Application: May 9, 2019 Tentative City Council Date: June 19, 2019 60 -Day Review Deadline: July 7, 2019 Planning Staff Report T -Mobile Central, LLC — Planning Case No. CUP2019-018 May 10, 2019 Page 2 of 7 Planning Considerations Ordinance Criteria The City's Electromagnetic Communication Facilities ordinance requires a conditional use permit for antennas and related wireless transmission facilities and equipment. Approval is subject to the provisions of the zoning ordinance and any conditions required by the City. When reviewing conditional use permits, the Planning Commission looks to City Code Title 11-2- 9F; Criteria for Issuance of Conditional Use Permits, as the guiding doctrine for review. This sec- tion states that in granting a CUP, the City Council shall find that: 1. The use will be in conformity with the City's Comprehensive Plan and with the purpose, intent and applicable standards of this Title. 2. The use shall be located, designed, maintained and operated to be compatible with the existing or intended character of that zoning district in which it is located. 3. The use shall not depreciate values of surrounding property. 4. The use shall not be hazardous, detrimental or disturbing to present and potential surrounding land uses due to noises, glare, smoke, dust, odor, fumes, water pollution, vibration, general un- sightliness or other nuisances. 5. The use shall generate only minimal vehicular traffic on local streets as defined by the transpor- tation element of the Comprehensive Plan. The use shall not create traffic congestion, unsafe access or parking needs that will cause inconveniences to the adjoining properties. 6. The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. 7. The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the City. 8. The use shall preserve and incorporate the site's important natural and scenic features into the development design. 9. The use shall cause minimal adverse environmental effects. 10. The use shall not adversely affect the potential development of adjacent vacant land. The City's Technical Review Committee reviewed this application on May 8, 2019 under the above criteria. The Committee found that the CUP criteria could be met, and the conditional use permit for T -Mobile Central, LLC could be approved subject to conditions. Installing an emergency backup generator would not significantly change the appearance of the equipment shelter, and T - Mobile's application complies with City ordinance regulations. Planning Staff Report T -Mobile Central, LLC - Planning Case No. CUP2019-018 May 10, 2019 Page 3 of 7 Background The T -Mobile equipment at the 81st Street water reservoir location was approved by Resolution No. 04-067 in 2004. The conditional use permit allowed for the construction of a 20 -foot by 40 - foot equipment shelter and installation of six antennas on top of the water reservoir providing additional service to Cottage Grove residents. In 2014, Resolution No. 2014-101 permitted installation of three additional antennas to improve communication capacity and data transmission speed to current and future wireless communica- tions systems. Site Characteristics There are two existing water reservoirs at the 8520 81st Street site. The smaller reservoir (1.0 million gallon) is located west of the 3.0 -million -gallon reservoir. The water storage structures provide services to the intermediate pressure zones in the community. Both reservoirs are surrounded by an eight -foot high chain-link fence. The remainder of the area is generally open space with a stormwater holding pond along the east side of the parcel. The only structures on the property include equipment shelters on the north and east sides of the 3 - million gallon water reservoir. A paved access drive extends from 81st Street. The parcel is surrounded on the west, south, and east sides by residential dwellings. �!;!`` A- a Site View from South Equipment T -Mobile currently houses 12 antennas on top of the water reservoir and equipment within the storage shed to the east. The generator would be natural gas fueled. Timbers would be utilized for edging around com- pacted gravel under the platform. The approximate 203 square feet of additional area would be surrounded by a five-foot vinyl privacy fence. Below is an image of the proposed vinyl fence. The generator would not run until the back-up batteries on site had been depleted as well and would ensure that cellular service is provided until responders could reach the site. Recommendation That the Planning Commission recommend to the City Council approval of T -Mobile Central, LLC's request to install an emergency generator with required screening at the City's 81st Street water reservoir site as shown on T -Mobile's site plan prepared by Trileaf Architecture & Engineer- ing dated April 17, 2019, subject to the following conditions: 1. All applicable permits (i.e., building, electrical, mechanical) and a commercial plan review packet must be completed, submitted, and approved by the Building Official, Fire Marshal, and Public Works Director prior to the commencement of any construction activities. 2. Applicant must submit as -built drawings to the City upon completion of the installation. 3. The applicant shall continue to work with the Public Works Department in finalizing the lease area. 4. Applicant must comply with the terms and conditions of the Lease. 5. The applicant must schedule a pre -construction meeting with the Public Works Director and City Engineer before work can begin. 6. Outdoor storage is prohibited. 8. No significant change in the use or design of the generator location and enclosure may be made without consent of the Public Works Director. 9. Utilities must be installed underground as approved by the Public Works Director. 10. The applicant must restore turf areas damaged by construction of the pad, platform, and fenc- ing by providing a minimum of four inches of topsoil and seeding and watering of all disturbed areas. Seed mix shall be approved by the Public Works Director. 11. Any noise emitted shall be in conformance with City Noise Ordinances. Monthly exercises shall not be operated between the hours of 7:00 p.m. and 7:00 a.m. 12. Utilities must be installed underground as approved by the Public Works Director. 13. Avoid intrusion into the staked stormwater easement area during construction. Notify Public Works if access if needed.
