Ordinance Amendment Regarding Self -Storage

Introduction
The City of Cottage Grove has filed an application for a zoning text amendment to City Code Title
11, Chapter 10, Article D, Subsection 7, regarding self -storage, and for an amendment to the
Business District Use Table in Title 11, Chapter 10, Article B, Subsection 1C. The proposed
amendment allows exterior storage as an accessory use to self -storage facilities. Self -storage
facilities would still require a conditional use permit for approval. The other text amendment to the
Use Table in the Business Districts Chapter is to allow self -storage facilities only in the Planned
Business zoning district as a conditional use, and to remove the use from the B-2, Retail Business,
and B-3, General Business, Zoning Districts where it is currently listed as a conditional use.
Background
The City's current standards for self -storage facilities were adopted as part of a 2012 revision of
the Zoning Ordinance that addressed all business districts. A sub -committee comprised of Plan-
ning Commission members and representatives from other City advisory commissions partici-
pated in this revision process. In May 2012, the City Council approved Ordinance No. 904, which
amended the business district section of the zoning ordinance. The staff report for the 2012 text
amendment gave special consideration to the question of exterior storage in self -storage facilities
(Planning Case No. TA2011-021). While noting that exterior storage at self -storage facilities was
not a permitted use at that time, the report suggested regulations should the use be permitted in
the future:
"For your consideration, outdoor storage could be allowed by conditional use permit and
the performance standard prohibiting outdoor storage changed to limit the amount of
outdoor storage area. An example may be to stipulate that the maximum area of exterior
storage does not exceed 50 percent of the combined footprint of the indoor self -storage
structures."
Proposal
The proposed text amendment for consideration would enact the guidelines outlined by the Plan-
ning Commission in their 2012 consideration of exterior storage at self -storage facilities. Under
the proposed amendment, exterior storage could be permitted in the Planned Business district,
subject to the following:
• Exterior storage is allowed only as an accessory use to interior self -storage.
• Exterior storage areas are limited to an area no greater than 50 percent of the site's building
footprint.
• Exterior storage must be located behind buildings.

• Exterior storage areas must be surfaced with concrete asphalt, and individual spaces must
be striped.
• Exterior storage areas must include interior landscaping islands to break up the impervious
surface.
• No exterior stored items shall exceed 12 feet in height.
• No stored items shall be visible from Trunk Highway 61.
• No exterior storage shall be permitted within one mile of another self -storage facility with
approved exterior storage.
Recommendation
That the Planning Commission recommend to the City Council the approval of an ordinance
amending City Code Title 11, Chapter 10, Article D, Subsection 7, regarding self -storage and to
amend the Commercial District Use Table in Title 11, Chapter 10, Article B, Subsection 1, to allow
self -storage facilities only in the Planned Business zoning district as a conditional use.

AN ORDINANCE FOR THE CITY OF COTTAGE GROVE, MINNESOTA, AMENDING
COTTAGE GROVE CITY CODE AND AMENDING TITLE 11, CHAPTER 10B,
SECTION 1 REGARDING PERMITTED, CONDITIONAL, ACCESSORY, AND
INTERIM USES AND AMENDING TITLE 11, CHAPTER 10D, SECTION 7
REGARDING SELF -STORAGE FACILITIES
The City Council of the City of Cottage Grove, Washington County, Minnesota,
does hereby ordain as follows:
SECTION 1. AMENDMENT. The Code of the City of Cottage Grove, County of
Washington, State of Minnesota, Title 11, Chapter 1013, Section 1 shall be amended as
follows:

SECTION 2. AMENDMENT. The Code of the City of Cottage Grove, County of
Washington, State of Minnesota, Title 11, Chapter 10D, Section 7 shall be amended as
follows:
11-10D-7: SELF -STORAGE FACILITIES:
Self -storage facilities are subject to the following conditions:
A. Shall not allow maintenance of any vehicles on site, except for minor maintenance
such as tire inflation, adding oil, wiper replacement, and battery replacement.
B. Shall have a security system adequate to limit access to persons renting a storage

C. Exterior storage is prohibited. allowed only by conditional use permit as part of a legal
conforming self -storage business, provided the following conditions are met:
1. Exterior storage shall be accessory to the principal use and shall not be a principal
use by itself.
2. Exterior storage shall be limited to an area not larger than 50% of the ground
coverage of the principal building(s).
3. Exterior storage areas shall be located behind the principal building(s) and not
within side or front yard areas and not abutting a public street.
4. Exterior storage areas shall be surfaced with concrete or asphalt, and if a parking
lot is being utilized for the exterior storage, individual parking spaces shall be
clearlv delineated with striaina. In no event shall the exterior storaae area reduce
the number of required parking spaces for the principal use.
5. Exterior storage shall be subject to the screening requirements of Title 11-6-4 of
this code
6. Exterior storage areas are exempt from the landscaping requirements pertaining
to parking lots regarding that portion of the parking lot that is used exclusively for
exterior storage. If the exterior storage area is no longer needed and the area is
used as a parking lot, not for exterior storage purposes, the owner shall comply
with the landscaping requirements for parking lots specified in this code within 90
days after the termination of the exterior storage use.
7. Stored items shall not be visible from Trunk Highway 61 or any public right-of-way.
8. The height of stored boats, recreational vehicles, and other exterior storage items,
includina anv affixed accessories. shall not exceed 12 feet. as measured from the
ground.
9. The use shall not be located within one mile of another self -storage facility with
exterior storage.
D. Shall not be located closer than three hundred feet (300') to any residential use
and/or zone.
All drive aisles and parking surfaces must be surfaced with asphalt or concrete.
-F. All storage space openings shall be oriented internally to the facility and shall not
directly face a public street or adjoining property.
-a An accessory caretaker residence may be permitted with a storage facility,
provided it is only used for resident security and management purposes and the
exterior building materials match those of the principal and accessory storage facility
structures.
The hours of operation of the self-service storage facility shall be restricted to
between the hours of six o'clock (6:00) A.M. and eleven o'clock (11:00) P.M.
.i. Access to the interior of the fenced area shall be available to emergency responders
in a manner acceptable to the fire marshal.
SECTION 3. SUMMARY PUBLICATION. Pursuant to Minnesota Statutes Section
412.191, in the case of a lengthy ordinance, a summary may be published. While a copy
of the entire ordinance is available without cost at the office of the City Clerk, the following
summary is approved by the City Council and shall be published in lieu of publishing the
entire ordinance.
The Cottage Grove City Council adopted Ordinance XXX. This amendment
provides for exterior storage as a conditional use as an accessory use to a legal
conforming self -storage facility. It requires all exterior storage to be located on a
concrete or asphalt surface, that it not be more than 12 feet in height, and requires
adequate screening so that it is not visible from adjacent right of way.
SECTION 4. EFFECTIVE DATE. This ordinance shall be in full force and effect
from and after its passage and publication according to law.

Self -storage facilities are subject to the following conditions:

C. Shall screen all storage, consistent with the requirements of this code.
D. Shall be screened from all public right of way and residential use and/or zone, with an
opaque fence, wall or berm not to exceed eight feet (8') in height, constructed of new
materials (chainlink with slats is not an acceptable screening material), and maintained in
good condition.
E. Exterior storage is prohibited.
F. Shall not be located closer than three hundred feet (300') to any residential use and/or zone.
G. All drive aisles and parking surfaces are surfaced with asphalt or concrete.
H. All storage space openings shall be oriented internally to the facility and shall not directly
face a public street or adjoining property.
I. An accessory caretaker residence may be permitted with a storage facility, provided it is only
used for resident security and management purposes and the exterior building materials
match those of the principal and accessory storage facility structures.
J. The hours of operation of the self-service storage facility shall be restricted to between the
hours of six o'clock (6:00) A.M. and eleven o'clock (11:00) P.M.

L. Common parking space available to all storage units shall be provided at a rate no less than
