Subject: Zywiec's Landscape & Garden Center Events
BACKGROUND
The City of Cottage Grove received three applications for events during September, October and
November at Zywiec's Landscape & Garden Center, 10900 East Point Douglas Road:
1. Application from Zywiec's Landscape & Garden Center for a Special Event Permit for The
Haunting Experience — Haunted House & Hayride (Dates of September 21, 27, 28; October 4,
5, 11, 12, 16, 17, 18, 19, 24, 25, 26, 27, 31; November 1, 2).
2. Application from Cottage Grove Lions for a Temporary 3.2°� Malt Liquor License in
association with the event (Dates of October 4, 5, 11, 12, 18, 19, 25, 26).
3. Application from Spiral Brewery for a Temporary Intoxicating Liquor License in association
with the event (Dates of September 27, 28; November 1, 2).
The Special Event application was reviewed by the Public Safety and Community Development
Departments and they recommended conditions for the event in the attached memo. A Public Hearing
Notice for the Special Event was mailed to property owners within 500 feet of the applicant property on
August 29, 2019.
The Temporary 3.2°� Malt Liquor License application from the Cottage Grove Lions has been reviewed
by the Public Safety Department and no facts were found that would constitute a basis for denial of the
application.
The Temporary Intoxicating Liquor License application from Spiral Brewery has been reviewed by the
Public Safety Department and no facts were found that would constitute a basis for denial of the
application.
STAFF RECOMMENDATION:
1. Conduct a Public Hearing to consider the application from Zywiec's Landscape & Garden Center to
hold a Special Event at 10900 East Point Douglas Road.
2. Authorize issuance of the Special Event Permit to Zywiec's Landscape & Garden Center contingent
on compliance with conditions outlined in the Memo from Pete Koerner and Christine Costello dated
9/12/2019.
3. Authorize issuance of a Temporary 3.2°� Malt Liquor License to the Cottage Grove Lions.

Zywiec's Landscape & Garden Center, 10900 East Point Douglas Road, has made application
for a special event permit to allow for the operation of their annual "the Haunting Experience.
The applicant is not listing changes from previous years and lists "see previous years" on the
application.

Location Detail
Public Safety and Community Development have reviewed the application and past permits for
the event. Public Safety and Community Development have listed below conditions for
approval of the special event permit.
Calls for service
A record check of the event from the past four years revels limited calls for service at the
event. The following is a summary.
2018 — 3 calls for service

■ Lockout— Public Assist 10/13/18
2017 — No calls for service
2016 — 2 calls for service
■ Medical — Possible head injury— no transport 10/08/16

■ Crash — Two vehicles backed into each other in parking lot 10/18/2015

The following are conditions of the special event permit:
Buildinq Permits
Building and Electrical Permits and any associated fees are required for the temporary stage,
tents over 750 square feet, electrical hookups, and any other usage as required by the uniform
building code, state statute, or local ordinance. In addition, all tents must meet the
requirements listed in the Uniform Fire Code. Proof of the fire-retardant treatment for all tents
must be provided for inspection.
Noise
Noise has not been reported to be a problem in past events. The Applicant is reporting that
amplified sound is proposed during the duration of the scheduled events. In conjunction with
the approval of this permit, an exception to the noise ordinance will be granted to allow for
amplified music between the hours of 10:00 p.m. to 11:00 p.m. on the event days scheduled to
end at 11:00 p.m.
Parkinq
Public Safety is requiring that all parking be on site, that parking be prohibited along Highway
61, and that all vehicular access be restricted to the current ingress and egress drives to the
site. No off-site parking or walking is permitted for the event. During high volume times, staff
shall assist with parking to prevent any backups onto Highway 61.
Required fire lanes shall be maintained at all times.
Security
The applicant will be responsible for on-site security. No police officers are required to be
hired. Excessive police services being required may be cause for revocation of the special
event permit.
Emergency Action Plan
Prior to the event, the applicant must provide the Public Safety Department with an emergency
action plan for instances of severe weather, lost child, accidents and other similar events. The
plan shall include the cell number of an emergency point of contact.
Staff needs access to communications to be able to call 9-1-1 to report emergencies.
Recommended that prior to the opening each day, staff should have a safety briefing. Due to
the event having screaming, etc. staff should have a code for an emergency that can be
relayed to staff alerting them to an emergency.
EMS/First Aid
The applicant shall have a designated first aid location on site.
Sanitation
The applicant will provide 12-16 additional portable toilets and adequately maintain.
Waste Collection
The applicant will have an additional 12 trash containers on site. Staff will empty containers
throughout the event.
Bonfire
The applicant plans on having a bonfire near the beer garden area. The area must be
inspected prior to the event to ensure it's a safe distance from structures.
The fire pit area shall not be left unattended. The fire must be extinguished prior to staff
leaving. There must also be a water source at the fire pit area.
Food Sales
All on-site food sales locations must be licensed and inspected by the Washington County
Health Department.
Alcohol Sales
The Cottage Grove Lions and Spiral Brewery are obtaining temporary "On Sale" 3.2 Malt
Liquor and Intoxicating Liquor licenses respectively for the event. Selling, serving or dispensing
liquor to a person under the age of twenty-one (21) years of age is prohibited. Persons twenty-
one (21) years of age or older purchasing alcoholic beverages shall be issued a wristband for
identification purposes. The license holders will be required to obtain proof of age for
purchasing or consuming liquor by:
a. Valid driver's license or identification card issued by Minnesota, another state, or
a province of Canada, which includes the photograph and date of birth of the
licensed person.
b. Military identification card issued by the United States Department of Defense, or
c. A valid passport.
No sale or display of alcoholic beverages will be allowed after midnight.
Site Inspections
The Fire Marshal and Building Official must be contacted for a site inspection prior to the
event. All conditions imposed by the Fire Marshal or Building Official shall be complied with;
failure to do so may be cause for revocation of the special event permit.
Recommendation
Approve the event contingent on compliance with the conditions outlined in this memo and all
other applicable state and local statutes.

Subject: LIQUOR LICENSE APPLICATION - TEMPORARY
INTRODUCTION
All locations within the City of Cottage Grove that sell alcoholic beverages are required by
State Law and City Ordinance to be licensed.
BACKGROUND
Pursuant to City Ordinance, Ronald Eugene Williams, on behalf of the Cottage Grove Lions
Club, P.O. Box 2, Cottage Grove, MN 55016, has submitted an application for a temporary
"On Sale" 3.2% Malt Liquor License to be held at Zywiecs Landscape Center, Haunting
Experience, October 4tn & 5tn ��tn & �2tn �gtn & 19th and 25th & 26th, 2019, from 5:OOpm to
12:OOam. The Department of Public Safety is required to conduct a police investigation of
the applicant/manager in charge.
DISCUSSION
The application of the Cottage Grove Lions Club, as submitted, is complete and in
compliance with our ordinance.
We have investigated the applicant and have not found any facts, which would constitute a
basis for denial of an "On Sale" 3.2% Malt Liquor License, under the provisions of the City
Liquor Ordinance or Minnesota Statutes relating to alcoholic beverages.
RECOMMENDATION
Recommend that the City Council approve the Liquor License application for the Cottage
Grove Lions Club.

East, Hastings, MN 55033, has submitted an application for a temporary On-Sale
Intoxicating Liquor License to be held at Zywiec's Haunting Experience, September 27 &
28, 2019 from 7pm — 11 pm and November 1 & 2, 2019 from 7pm — 11 pm. The Department
of Public Safety is required to conduct a police investigation of the applicant/manager in
charge.
DISCUSSION
The application of the Spiral Brewery, LLC, as submitted, is complete and in compliance
with our ordinance.
We have investigated the applicant and have not found any facts, which would constitute a
basis for denial of an "On Sale" Intoxicating Liquor License, under the provisions of the City
Liquor Ordinance or Minnesota Statutes relating to alcoholic beverages.
RECOMMENDATION
Recommend that the City Council approve the Liquor License application for the Spiral
Brewery, LLC.
