The existing home on the property is an underground basement home. The applicant would like to raze the small above -grade components of the underground home and construct a new above - grade residence over the existing foundation. The new home will be the residence of the appli- cants' daughter. The roadways adjacent to the property are gravel and lack curb and gutters. This can make identification of property lines and setbacks from property lines difficult to interpret. The property is zoned R-4, Low Density Residential, which permits single family residences with a required 30 -foot front yard setback. City ordinance states that the City Council may grant variances from the strict application of the Zoning Ordinance and can impose conditions and safeguards on the variance. In considering variance applications, the effect of the proposed variance upon the following issues should be considered: 1. The health, safety and welfare of the community; 2. Traffic conditions; 3. Light and air; 4. Danger of fire; 5. Risk to the public safety; 6. The effect on values of property in the surrounding area; and 7. The effect of the proposed variance upon the Comprehensive Plan. The City's Technical Review Committee discussed the application request in consideration of the variance criteria, found that the variance satisfied the criteria, and recommended approval of the variance. Architecture Details of the proposed home and the encroaching landing are shown below. Findings The findings of fact for a favorable recommendation that were considered during the review are identified as follows: A. The existing foundation of the house currently encroaches into the front yard setback and was not a result of any action by the applicants. B. The basic construction techniques to build a new home and ingress and egress code re- quirements dictate the placement of the front porch in the proposed location. C. The road locations within the public right-of-way in the Langdon neighborhood and the lack of curb and gutters and historic building placement make identification of property lines and setbacks difficult to interpret. D. Many of the homes in the 1874 Langdon plat were constructed prior to the enactment of the City zoning ordinance and have varied setbacks. The applicant's improvements to the property and the construction of the new home and landing will have a positive impact on the surrounding properties and value of the home on the property. Recommendation That the Planning Commission recommend that the City Council approve a variance to the front yard setback to allow a 9.6 -foot deep landing to be located 17.6 feet from the front property line on a new house to be constructed at 8724 95th Street South, based on the established findings of facts and subject to the following conditions: 1. The property owner must be issued a building permit before any construction begins. 2. Erosion control measures shall be required to be in place during construction. 3. The final grade from the house shall be positive. 4. An as -built survey shall be required prior to the issuance of a permanent certificate of occupancy. 5. The identified detached accessory structures with setback encroachments shall be removed before the issuance of a certificate of occupancy. 6. The remaining detached accessory structure shall conform to the roofing and siding materials of the new principal structure. 7. The home and landing building perimeter shall consist of foundation landscaping includ- ing a variety of landscape materials that provide year-round color and screening benefits. A landscaping plan detailing said plantings shall be included with the building permit application. 8. A $500.00 landscaping escrow shall be posted with the building permit application to en- sure the planting and survival of the required landscaping. Prepared by: John M.
