COTTAGE GROVE PLANNING DIVISION Planning Staff Contact: Emily Schmitz, Senior Planner, 651-458-2874, eschmitz@cottagegrovemn.gov Application Accepted: 12/18/19 60-Day Review Deadline: 2/16/20 City of Cottage Grove Planning Division  12800 Ravine Parkway South  Cottage Grove, MN 55016 Planning Staff Report Cub Foods Interim Conditional Use Permit Planning Case No. ICUP20-001 January 27, 2020 Proposal Cub Foods, located at 8690 East Point Douglas Road, is requesting approval of an interim con- ditional use permit (ICUP), which would allow the applicant to erect a 21-foot by 60-foot tempo- rary greenhouse to conduct outdoor seasonal sales. The sales, storage, and display of plant and landscape materials would take place within the temporary structure as well as within an outdoor sales area. Temporary outdoor sale operations are proposed to take place from April 1 to July 1 of each year. The applicant is requesting the ICUP be granted for a five-year time period. Location Map Review Process Application Received: December 18, 2029 Acceptance of Completed Application: December 18, 2020 Planning Commission Date: January 27, 2020 Tentative City Council Date: February 19, 2020 60-day Review Deadline: March 2, 2020 Background An interim conditional use permit for a temporary greenhouse in the Cub Foods parking lot was originally granted by the City in 1992, and several others have been granted since that period. The latest interim conditional use permit (Resolution 2014-030) expired July 1, 2019. Since the initial Planning Staff Report – ICUP20-001 Cub Foods Interim Conditional Use Permit – Outdoor Sales January 23, 2020 Page 2 of 3 approval of the ICUP in 1992, Cub Foods has secured a building permit allowing for a temporary greenhouse structure and outdoor sales of plants and landscape items. The applicant has and will be required to pay the annual fee for the ICUP with the submittal of the building permit application. The current annual rate for an interim use is $300 annually. Planning Considerations Property Characteristics The Cub Foods site is fully developed on approximately 8.2 acres of land. The property is com- mercially guided and located within the B-2, Retail Business District. The 64,569 square foot build- ing is located at the north end of the site. There are 371 parking spaces provided on the south and west sides of the building with motor vehicle access provided from East Point Douglas Road, Jamaica Avenue, and 90th Street. Outdoor Sales The applicant proposes to continue operating outdoor sales of landscaping material, just as they have in past. The temporary greenhouse and outdoor sales area are proposed to be located in the northeast corner of the parking lot. In the past, the sales area had been located in the southwest corner of the parking lot area; however, the location needs to be closer to the building to obtain wi- fi connection. The perimeter of the display area will be fenced with a split-rail type barrier. The site plan for the outdoor sales area is shown below: Proposed Sales Area Planning Staff Report – ICUP20-001 Cub Foods Interim Conditional Use Permit – Outdoor Sales January 23, 2020 Page 3 of 3 The outdoor display and sales of plants, landscape products, and merchandise typically utilizes approximately 45 parking spaces. This approximate parking impact has occurred since 2009 and has not had a negative impact on the site’s parking, as an abundant number of parking spaces are still available within the Cub Foods parking lot area. Public Hearing Notices Notices announcing this public hearing were published in The Bulletin and mailed to 104 prop- erty owners within 500 feet of the Cub Foods property on January 15, 2020. Summary The proposed use is temporary in nature, and the sales items are consistent with approved mer- chandise for the B-2 zoning district. Seasonal outdoor sales are listed as an interim conditional use, and as proposed, the use would meet the criteria for issuing this type of permit. Recommendation That the Planning Commission recommends that the City Council approve Cub Foods’ interim conditional use permit to construct a 21-foot by 60-foot temporary greenhouse and the outdoor display and sales of landscaping materials and plants in the southwest corner of their parking lot, subject to the following conditions: 1. The interim conditional use permit is valid beginning on April 1, 2020 and expiring on July 1, 2024. 2. The applicant must annually pay the interim conditional use permit application fee to the City prior to the operation of the seasonal outdoor sales. 3. A sign package shall be submitted with the annual building permit application and will be reviewed and approved by the Planning Division annually. Advertising signage attached to the temporary tent is permitted. Free-standing signs or off-premise advertising are prohibited. 4. A building permit for the temporary greenhouse must be issued by the City before any greenhouse is erected. A building permit is required each year that a greenhouse is used on the property. 5. The temporary greenhouse, fencing, and outdoor storage of items must setback a minimum of 20 feet from and property line and no storage or display of materials shall be located on grass areas. 6. Overhead electrical service or electrical extension cords are prohibited from any power source that extends across the parking/paved area of the Cub Foods site.
