The proposed use would be located on an approximate 0.58-acre parcel at 7702 80th Street South, which is the northwest corner of Hinton Avenue and 80th Street. Site Location The applicant has submitted the following applications: 1. Site Plan Review — for the removal of the existing building at 7702 80th Street South and the construction of a 583 square foot coffee shop with a drive -through window and outdoor patio area. 2. Conditional Use Permit — Per City Code 11-10B-1: Permitted, Conditional, Accessory, and Interim Uses, restaurants with drive -up windows are allowed per a conditional use permit. 3. In the early 2000s, a dance school and insurance agent occupied the building. For approximately the last five years the building has been vacant. The building's lower level is not handicap accessible and the layout of the interior space is not conducive to current commercial uses. The only activity that has taken place on the property since the last business left in the early 2000s is overflow parking for Kok Funeral Home. The overflow parking is only on an "as needed" basis. The developer plans to continue allow for overflow parking for funerals when needed. Planning Considerations Zoning and Comprehensive Plan The current zoning for this parcel is Mixed Use and the proposed use is consistent with the City's zoning ordinance. The restaurant will have a walk-up window, patio area, and a drive -through window, requiring a conditional use permit (CUP). The City's 2040 Comprehensive Plan guides this parcel as a Mixed -Use. Preliminary Plat The applicant has submitted a preliminary plat for the parcel located at 7702 80th Street South. The preliminary plat dedicates right-of-way along 80th Street and Hinton Avenue that lines up with adjacent parcels. A patio area is proposed on the west side of the building, which would include a small 64 square foot outdoor seating area. No additional parking is required to support the patio seating area given there will be no more than 30 outdoor seats. The School District provides crossing guards at the Hinton Avenue and 80th Street intersection during high -traffic school times. It has also been noted the signal at 80th Street and Hinton Avenue is set to protect red, meaning at any time the pedestrian signal is engaged, all directions of traffic receive a red light, therefore no traffic is crossing the intersection when pedestrians are crossing. Parking/Stacking Minimum parking is required for the proposed use-, City Code requires no less than one parking space for each 60 square feet of gross floor area. Given the proposed Caribou Cabin building is approximately 583 square feet, ten parking spaces are required. The applicant is proposing a total of 18 spaces, meeting the minimum required. City Code calls for 20-foot-long parking stalls-, how- ever, 18-foot long stalls are permitted if the developer allows for a 2-foot overhang along the curb or sidewalk. Currently the developer is proposing 18-foot parking stalls along the east, south, and west parking lot. All these areas per the site plan have the required 2-foot overhang. The proposed use also requires a conditional use permit as a drive -through is proposed. The drive -through window would be on the east side of the building along with a walk-up window on the west side of the building (within the proposed outdoor seating area). The site has room to support approximately 15 vehicles in queue for the drive -through lane as they would be able to wrap around the parking lot or park within the site. Because of the inability for access to the site off 80th Street as site lines are an issue, City staff understands they will need to monitor the traffic patterns of the new use of the site once the business is open to ensure any safety impacts are addressed immediately. Architecture The building's exterior will be comprised of multiple materials, including stone along the knee wall and Hardie plank siding and trim. Overall, including the windows along the north, west, and east elevations, the architecture meets City Code requirements for a minimum of 65 percent Class 1 materials on the facade and will feature Caribou Cabin brand colors. No more than a total of 45.5 square feet (1.25 square feet x 36.4 feet of tenant frontage) of wall signage is permitted on each side of the proposed building. The applicant indicated they would utilize the existing pylon sign located on the site; however, given the sign is legally a non -conforming sign and has not been in use for over one calendar year, the applicant will be required to remove the existing pylon sign and replace it Planning Commission Staff Report — Caribou Cabin Planning Case No. PP2021-011, CUP2021-012, & SP2021-013 February 22, 2021 Page 9 of 13 with a pylon sign no greater than 15 feet tall with a copy area of 35 square feet or a monument sign no taller than 10 feet in height with no more than 70 square feet of copy area. Tree Mitigation The applicant is proposing to remove some mature trees on the site as part of demolition of the existing building and reconstruction of the Caribou building and surrounding parking areas. The proposed removal is 54 total qualifying inches. Per City Code, permitted removal is 50 percent of the total qualifying inches inventoried on a site (27 inches). Given the proposed removal is 14 inches greater than the permitted, the applicant is required to replace those inches on site or pay the mitigation fee per inch. The applicant is proposing to plant the required additional 14 mitigation inches (14/1.5 replacement inches = 6 additional overstory trees) on site. Landscape The proposed Caribou Cabin project provides landscaped features that are consistent with the minimum ordinance regulations. The landscaping minimum requirements for the property are as follows: • 7 overstory trees • 7 coniferous trees • 15 shrubs The applicant is proposing to plant the following: • 14 overstory trees (6 of which are mitigation trees) • 13 coniferous trees • 90 shrubs Landscape Plan Planning Commission Staff Report — Caribou Cabin Planning Case No. PP2021-011, CUP2021-012, & SP2021-013 February 22, 2021 Page 10 of 13 Because the proposed parking lot area is less than 25 parking spaces, no additional parking lot landscape islands are required. Stormwater Since the site is less than one acre in size, it is not required to obtain an NPDES permit from the MPCA. However, the City's rules regarding rate control and water quality do apply. The applicant's proposed stormwater system meets the City's rules and routes most site runoff to the existing pond to the north while a portion of the site will drain to 80th Street. A stormwater maintenance agreement will be required to inspect and remove sediment from the proposed sump catch basin. The sump catch basin is required in the manhole just upstream of the pond in order to remove sediment from the water before it discharges into the pond. Utilities The subject property is within the Metropolitan Urban Service Area (MUSA). All city utilities in this vicinity provide the necessary capacities to serve this parcel. The installation of on -site utilities and supporting infrastructure will be privately designed and constructed to meet City specifi- cations. Conditional Use Permit The City Code requires that restaurants with drive -up windows are allowed but must obtain a conditional use permit. When reviewing conditional use permits, the Planning Commission looks to Title 11-2-9F, Criteria for Issuance of Conditional Use Permits, as the guiding doctrine for review. This section states that in granting a CUP, the City Council shall find that: 1. The use will be in conformity with the City's Comprehensive Plan and with the purpose, intent and applicable standards of this Title. 2. The use shall be located, designed, maintained, and operated to be compatible with the existing or intended character of that zoning district in which it is located. 3. The use shall not depreciate values of surrounding property. 4. The use shall not be hazardous, detrimental, or disturbing to present and potential surrounding land uses due to noises, glare, smoke, dust, odor, fumes, water pollution, vibration, general unsightliness, or other nuisances. 5. The use shall generate only minimal vehicular traffic on local streets as defined by the transpor- tation element of the Comprehensive Plan. The use shall not create traffic congestion, unsafe access or parking needs that will cause inconveniences to the adjoining properties. 6. The use shall be served adequately by essential public services, such as streets, police, fire protection and utilities. 7. The use shall not create excessive additional requirements at public cost for public facilities and services and shall not be detrimental to the economic welfare of the City. 8. The use shall preserve and incorporate the site's important natural and scenic features into the development design. The use shall cause minimal adverse environmental effects. 10. The use shall not adversely affect the potential development of adjacent vacant land. The City's Technical Review Committee reviewed this application under these criteria on February 3, 2021. The Committee found that the CUP criteria could be met and the CUP for the requested restaurant could subsequently be approved utilizing the same approval conditions imposed on other restaurants with "drive -through" windows. Public Hearing Notices The public hearing notice was published in the St Paul Pioneer Press and mailed to 88 property owners that are within 500 feet of the proposed project on February 10, 2021. Recommendation That the Planning Commission recommends that the City Council approve the preliminary plat to be named Cottage Grove Coffee, a site plan for the construction of an 583 square foot Caribou Cabin, and a conditional use permit to allow a drive -up window, subject to the following conditions: All applicable permits (i.e.: building, electrical, grading, and mechanical) and a commercial plan review packet must be completed, submitted, and approved by the City prior to the commencement of any construction activities. Detailed construction plans must be reviewed and approved by the Building Official and Fire Marshal. 2. The applicant receives all required building permits from the City of Cottage Grove prior to construction. 3. The applicant shall remove the existing non -conforming pylon sign. A separate building permit must be submitted, reviewed, and approved by the Planning Department for a monument sign meeting the City Code minimum standards prior to issuance. All proposed signage shall be in accordance with City Code Title 9-8, Signs. 4. A demolition permit is required to be secured prior to the removal of the existing building. 5. A six-foot wide concrete sidewalk should be provided along the north side of the drive access for pedestrian access to the Hinton Avenue trail. 6. Final grading and drainage plans must be submitted to the South Washington Watershed District for review. The final grading plan shall meet the approval of the City Engineer. 7. Irrigation shall be provided for all sodded and mulched landscaped areas, including mainte- nance to take place to the sidewalk along 80th Street and the trail along Hinton Avenue. The irrigation system shall consist of an underground sprinkling system that is designed by a professional irrigation installer to meet the water requirements of the site's specific vege- tation. The system shall be detailed on the final landscape plan. The grass area between the property boundary line and the 80th Street sidewalk and the Hinton Avenue trail is required to be regularly mowed. Installation of landscaping shall occur in a timely fashion and be consistent with an ap- proved plan. A letter of credit in the amount of 150 percent of the landscape estimate shall be submitted to the City as required by City ordinance prior to the issuance of a building permit. The financial guarantee shall be in effect for one year from the date of installation to ensure the installation, survival, and replacement of the landscaping improvements. 9. Concrete aprons for all private access drives shall be reviewed by the City and constructed per City detail plate STR-17 and be approved by the City of Cottage Grove's Engineering Department. 10. All site lighting must meet City Code requirements. All light fixtures must be downward directed with cut-offs. 11. The grading and erosion control plan for the site must comply with NPDES II Permit re- quirements. Erosion control devices must be installed prior to commencement of any grading activity. Erosion control must be performed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Control Planning Handbook" and the conditions stipulated in Title 10-5-8, Erosion Control During Construc- tion, of the City's Subdivision Ordinance. The Applicant shall be responsible for the costs for the City to inspect the site in relation to erosion control conformance. 12. The applicant must provide the City with an as -built survey of all private utilities and grading plan prior to issuance of the certificate of occupancy. 13. Any mechanical equipment on top of the building must be screened from public view. The mechanical units shall be screened as required in Title 11-6-4 of the City's Zoning Ordinance. 14. Trash enclosures must be constructed of building materials that are consistent with the principal building's exterior materials. 15. The applicant shall be responsible for maintaining the sidewalks and removing snow and/or ice from sidewalks on the site. 16. A bike rack will be required in the final parking design per City policy. 17. Applicant shall incorporate into the final plans the recommendations, requirements, and evaluations noted in the review memo from The City of Cottage Grove dated 1/15/2021 subject to modifications that are agreed to applicant and civil engineer. 18. If any fencing is installed on the site in the future, it shall be commercial grade ornamental fencing meeting the City's design specification and detail sheet (currently Montage Com- mercial Majestic 3/4 — Rail Fence). 19. The applicant is responsible for removing debris from all adjacent public roadways during their grading and construction process. These streets shall be swept clean daily or as needed. The sign shall be ten feet from the road- way edge and two feet from the driveway edge. The bottom of the sign shall be six feet from the ground. The "STOP" sign shall be a 30-inch sized sign having a high intensity face. Said sign shall be mounted on a 6-foot — No. 3 and 8-foot — No. 2 steel post. The applicant may request the City's Public Works Department to install said "STOP" signs but must reimburse the City for actual costs incurred. 21. At no time will there be any installation or use of an outdoor two-way communication system for ordering food or any other type of product to be sold or given away. 22. Rubbish, garbage, and recycling containers must be stored within an enclosed structure compliant with City ordinance screening requirements and shall always be maintained so as not cause odors or other public nuisances. 23. The applicant shall sign a maintenance agreement with the City for ongoing inspections and maintenance of the sump catch basin on site prior to the issuance of a building permit. We recognize some of the comments are related to final design and not necessarily a preliminary submittal, however we believe it is prudent to provide those comments early in the process. Sheet C1.0 1. If you have not done so already, please reach out to the Kok Funeral Home to get approval for the proposed work on their property. Sheet C2.0 2. Please revise the driveway entrance/exit to meet Hinton Avenue at a right angle. The driveway should continue straight for 20 feet west of property line. This will likely involve moving the curb cut to the south so that the driveway conforms to the 10-foot parking lot set back from the north property line. Sheet C4.0 3. Prior to beginning construction, field verification (pothole) of the existing water line to the property must be completed. If it is necessary to cut open 801" Street to install a 6-inch service, the City needs several weeks' notice. 4. The City's Fire Department has noted the coffee shop does not need sprinklers. Please confirm the need for a 6-inch service. 5. The City would prefer that the storm sewer was discharged into the pond to the north instead of connecting to storm sewer under Hinton Ave. Please review and revise as necessary. 6. Add catch basins along the driveway, one on either side, to catch runoff before it flows into Hinton Ave. 7. Irrigation for sod and shrubs is required for commercial properties. Please provide location of irrigation service on the plans. Sheets C5.0 — C5.1 8. The City updated its standard detail plates in 2020. Please update your detail sheets with the revised details that can be found on the City's website. Sheet SW1.0 9. Please provide inlet protection for the catch basin on the west side of Hinton Avenue just north of the construction site. Stormwater 10. The owner will be required to sign a maintenance agreement with the City for on -going inspections and maintenance of the sump catch basin. 11. The engineer should submit stormwater modeling reports to show that the proposed development meets the City's requirements for rate control and water quality (TSS and TP). 12. The South Washington Watershed District has expressed interest in partnering with the owner on stormwater improvements. The SWWD would pay for 50% of all stormwater costs if a stormwater treatment device is installed to reduce runoff volume. Infiltration is allowed in this area of the City.
