The proposed modular structure would consist of four class- rooms, two theater rooms, two offices, and restrooms. The Pine Harbor Church location is shown below: site Location Review Schedule Application Received: April 30, 2021 Application Accepted: April 30, 2021 Planning Commission Meeting: May 26, 2021 Tentative City Council Meeting: June 16, 2021 60-Day Review Deadline: June 29, 2021 Background The current church parcel was originally developed in 1983 with the approval of a site plan and conditional use permit for the construction of a church. Between 1984 and 1985, the Jubilee Chris- tian Faith Center applied to amend the 1983 approval to allow for the construction of a full-time Planning Commission Staff Report — Pine Harbor Church Planning Case No. SP2021-037 May 24, 2021 Page 2 of 8 school on the site along with the church construction and subsequent phased additions. These additions were never completed, and in 1993, the church received approval for construction of a 28,800 square foot addition that included classrooms, worship area, and restrooms. The addition was completed in 1993 along with parking lot improvements. The Harbor Church continues to operate on the site which includes three programs: The Harbor Church, Kids Kare Center, and Pine Harbor Academy. Zoning and Comprehensive Plan The current zoning of this parcel is R-1, Rural Residential. Religious institutions are permitted with an approved conditional use permit within residentially zoned districts per the City's Zoning Code. The parcel is also within the Mississippi River Critical Area Corridor and the proposal meets the criteria for those requirements. The City's 2040 Comprehensive Plan guides this parcel as public/ semi-public given the religious institution use; the proposed expansion aligns with the City's land use guidance. Zoning Map Project Site Plan Pine Harbor Academy has been in operation since 1993, and with the increase in recent enroll- ment, they are bursting at the seams. Due to this growth and the COVID-19 pandemic requiring splitting classrooms, the Church has been looking for ways to provide the needed additional space. The option to move the structure to the site as opposed to building an addition is less of a financial burden to the church while providing the additional room space needed. The modular structure is currently located within the Anoka -Hennepin School District, which no longer has a need for the space. The total structure height, including the roof mechanical units, is 15.5 feet, which meets the maximum 30-foot height Zoning Code standard. These materials are not able to be transported on the structure; therefore, they will be removed before moving. The applicant has proposed, once the building is in place, to install Hardie lap siding on the structure and paint to match the existing building color. The existing building is comprised of stucco and masonry materials, which was approved as part of the con- struction of the building. The proposed material would meet the City's residential architectural standards although, the applicant will be required to break up the walls with one additional material meeting the City's requirement of lengths of 100 feet or more be subdivided or have a change in plane. Proposed Building Elevation Parking As part of the 1993 expansion request, the applicant was required to ensure ample parking was provided per the City's Zoning Code. The required number of parking stalls as part of the addition was 146 spaces. The applicant provided a total of 160 parking spaces as well as an additional proof of parking for 87 spaces. The addition of the modular structure does not require additional parking space be provided on the site. Landscaping/Tree Mitigation The applicant is proposing to remove around 40 existing mature trees from the site in order to place the modular structure near the existing school building. The trees to be removed are on average 7 inches in diameter. Per the City's tree mitigation standards, the applicant is permitted to remove 35 percent of the qualifying inches and replace 50 percent of those inches removed in excess of the 35 percent. Therefore, the applicant is required to replace 130 inches. The plan below indicates the location of the replacement tree plantings on the site. The existing treed buffer along Highway 61 will continue to be maintained as best as possible with additional evergreen plantings proposed within the southeast corner of the site. The current sign along High- way 61 was installed in 2018. The sign meets the City's Zoning Code minimum standards and includes a dynamic display sign that is permitted to change no more than once per hour. Utilities City utilities are not available to this site, so the site is served by private well and septic systems. As part of the proposed additional school space, the applicant is required to provide verification that the existing septic system can support the additional classrooms, office space, and restrooms. The applicant has been working with a septic contractor to verify the existing system and with Washington County to verify any modifications that may be required. Approval of the system will be required prior to the issuance of a building permit. Plat The current parcel has a metes and bounds description and does not dedicate the Highway 61 right-of-way to MnDOT. There is a current permanent easement for the Highway 61 right-of-way, which extends a total of 225 feet. The applicant's current parcel extends the majority of the high- way. MnDOT has verified they prefer to be the fee owner of the right-of-way, therefore the appli- cant will be required to plat this parcel dedicating the required right-of-way, approximately 112 feet from the center of the state highway. An access agreement is typically required for access through adjacent properties, although no agreement can be located for this particular situation. As part of the platting process, the City will require an access and management agree- ment be recorded against both the River Oaks Golf Course parcel and the Pine Harbor Academy parcel. Access Agreement Required Planning Commission Staff Report — Pine Harbor Church Planning Case No. SP2021-037 May 24, 2021 Page 7 of 8 Public Hearing Notices The public hearing notice for the May 24, 2021 Planning Commission meeting was published in the St Paul Pioneer Press and mailed on May 12, 2021, to 6 property owners that are within 500 feet of the proposed project. Recommendation That the Planning Commission recommends that the City Council approve the site plan for the addition of a 70-foot x 140-foot (9,800 square foot) modular structure to the Pine Harbor Christian Academy parcel located at 11125 West Point Douglas Road South, subject to the following condi- tions: The parcel is required to be platted dedicating the appropriate right-of-way as approved by MnDOT prior to issuance of a certificate of occupancy. 2. As part of the required platting of the parcel, the applicant shall enter into an access agree- ment with the City of Cottage Grove for the section of joint access off of Highway 61 through the River Oaks Golf Course property. 3. Prior to the issuance of a building permit, a stormwater memo providing documentation of the stormwater needs for the additional building shall be submitted and approved by the City. 4. Elevations proposing an additional exterior material will be required given the lengths exceed 100 feet and are required to be broken up with two materials or a change in plane. 5. All applicable permits (i.e.; building, electrical, grading, and mechanical) and a commercial plan review packet must be completed, submitted, and approved by the City prior to the commencement of any construction activities. Detailed construction plans must be reviewed and approved by the Building Official and Fire Marshal. 6. The applicant receives all required building permits from the City of Cottage Grove prior to construction or moving of the building to the site. 7. Final grading and drainage plans must be submitted to the City for review and approval of the City Engineer. 8. Installation of landscaping shall occur in a timely fashion and be consistent with an ap- proved plan. A letter of credit in the amount of 150 percent of the landscape estimate shall be submitted to the City as required by City ordinance. The financial guarantee shall be in effect for one year from the date of installation to ensure the installation, survival, and replacement of the landscaping improvements. 9. The applicant must provide the City with a grading plan prior to issuance of a grading permit or building permit. All mechanical equipment on top of the building must be screened from public view from Highway 61. The mechanical units shall be screened as required in Title 11-6-4 of the City's Zoning Ordinance. 11.
