The proposed plat is to be called Wood- ward Ponds 3rd Addition and will adjust the existing townhome unit lot lines of 44 of the existing platted lots. The proposed Woodward Ponds 3rd Addition plat will not create additional lots. The 1st Addition final plat of the Woodward Ponds development was reviewed and approved at the May 6, 2020, City Council meeting (Resolution 2020-065) and included 48 lots for townhomes. The Woodward Ponds 2nd Addition final plat was reviewed and approved at the March 17, 2021 Council meeting with 116 lots for townhomes (Resolution 2021-033). Planning Staff Report —Woodward Ponds Case No. PP2022-007 January 20, 2022 Page 2 of 4 Donnay Homes sold the Woodward Ponds 1 st Addition lots to M/I Homes along with several lots in the Woodward Ponds 2nd Addition. Since that time, M/I Homes has found certain slab -on -grade townhome products to be selling better than their product with a basement; therefore, they have proposed to adjust the lot lines of 44 existing lots to accommodate the additional length needed to support the slab -on -grade product. The site plan below indicates the proposed lots which will have adjusted lot lines: -7J Woodward Ponds 3rd Addition Preliminary Plat Planning Considerations Land Use and Zoning The property was rezoned as part of the preliminary plat process in 2020; therefore, no zoning amendments are being requested. The current zoning of the property is R-5, Medium Density Residential. The proposed adjusted lots meet the minimum standards as approved. Zoning Development Standards The development performance standards of the requested zoning district classifications are detailed below and would remain the same for the Woodward Ponds 3rd Addition. The City's Engineering team has reviewed the submitted plans and have no additional review comments to be addressed. Easement Vacation The common lot area of Woodward Ponds 2nd Addition (Lot 37, Block 2, Woodward Ponds 2nd Addition) was required to be platted with a drainage and utility (D&U) easement to allow for City access to public utilities within the lot. Given the proposed adjusted lot lines, the existing D&U easement is required to be vacated prior to platting the new 3rd Addition lots and a new D&U easement dedicated over the new common lot (Lot 31, Block 2, Woodward Ponds 3rd Addition). ,« 372 'QUTL^-/' 3 A11.0? 21, �� h Easement Vacation Area Planning Staff Report —Woodward Ponds Case No. PP2022-007 January 20, 2022 Page 4 of 4 Area Charges and Development Fees All area charges and related development fees for this project were paid as part of the Woodward Ponds 2nd Addition final plat. No additional area charges or development fees are required as part of the proposed 3rd Addition. Public Hearing Notices Public hearing notices were mailed to 80 property owners who are within 500 feet of the proposed subdivision and published in The St Paul Pioneer Press on January 12, 2022. Recommendation That the Planning Commission recommend that the City Council approve the preliminary plat for a residential subdivision to be called Woodward Ponds 3rd Addition, which will consist of 44 at- tached unit lots for multi -family townhomes. Approval of the preliminary plat is subject to the following conditions: General Development 1. The developer and builders must comply with all City ordinances and policies except as may be modified by agreement of the developer and City staff. 2. The Developer must abide by the conditions stipulated in Resolution 2020-007, which ap- proved the Woodward Ponds preliminary plat, and Resolution 2021-033, which approved the Woodward Ponds 2nd Addition final plat. 3. A drainage and utility easement shall be platted over all of Lot 37, Block 2 of Woodward Ponds 3rd Addition and as noted on a few townhome lots within Block 2. 4. The final plat must be recorded with the Washington County Recorder's Office before any building permits can be issued.
