The building will be located outside the existing tank containment system (tank farm) on their property at 6483 85th Street South. Site Location Map Review Process Application Received- December 28, 2021 Acceptance of Completed Application- December 28, 2018 Tentative City Council Date- February 16, 2022 60-Day Review Deadline- February 26, 2022 Background The first oil storage tank in this location was installed on the site in 1957. Subsequent construction phases over the decades have added additional tanks. The existing use for the storage of crude oil, refined oil, alcohol, and other liquid is a conditional use for the 1-3, Heavy Industry, zoning district where it is located. A conditional use permit (CUP) was granted for the existing use as oil storage on the site in 1999 and remains in effect. The applicant continues to submit up to date preparedness plans and completes annual compliance inspections with the City Public Safety Department. This building and fire suppression system will support emergency preparedness for the Minnesota Pipeline Company activities at this site. Planning Staff Report Flint Hills Resources Site Plan Review — Fire Suppression Building January 24, 2022 Page 2 of 7 The City received a request by the Minnesota Pipeline Company for a site plan review to allow Flint Hills Resources to construct a new tank foam building at their site located on 85th Street South. The construction of this new building will support their new fire suppression system as a further precautionary measure to ensure ready deployment of fire suppression equipment and materials in the event of a fire at the tank farm. NEW PROJECT AREA - ........... .. _ t R` 7-7 i \ Overall Layout Planning Considerations Ordinance Requirements Site plans are required to be approved before a building permit for a new structure or major addi- tion to an existing structure may be issued. The purpose of site plan approval is to assure that new proposed development conforms to the city's development standards and ordinances and provide the most appropriate and compatible site plan for the area. Given the proposed structure is adjacent to a residential neighborhood and is an additional structure to the site layout and op- erations from the original approvals for the first development on the property in 1957, a site plan review process is required. In accordance with the site plan review procedures required by Chapter 11-2-4 of the City Code, the city staff has reviewed the site plan for: 1. Traffic and pedestrian circulation 2. Parking 3. Drainage 4. Landscaping 5. Compliance with other applicable ordinances Planning Staff Report Flint Hills Resources Site Plan Review — Fire Suppression Building January 24, 2022 Page 3 of 7 Land Use/Zoning Minnesota Pipeline Company's property is located within the 85th and Geneva Staging Area as defined in the Cottage Grove 2040 Comprehensive Plan. The area south and east of 85th Street and Geneva Avenue is mostly guided Industrial with respect to the petroleum tank farms present. Most of the property in this area is owned by petroleum companies, including Minnesota Pipeline Company. There are two rural homesteads and five single-family homes on the west and north edges of the area, fronting Geneva Avenue and 85th Street. Changes to the Land Use Plan will guide the western and southern parcels as Low Density Residential to buffer the area from future Industrial development. Minnesota Pipeline Company's current operations and proposed building are compatible with current and future land use guidance. Minnesota Pipeline Company' property is zoned 1-3, Heavy Industry. This zoning classification is consistent with the adopted Cottage Grove 2040 Comprehensive Plan. Site Plan The applicant is proposing to construct a 210 square foot steel frame structure. The building foot- print is 12 feet, 4 inches by 15 feet, 10 inches with a height of 12 feet 4 inches at its highest elevation. The building will be equipped with an insulated surface door as well as an insulated, rolling overhead garage door. The required setback to the north is150 feet as it abuts a residential district. The side and rear setbacks are adjacent to the existing facility and would not apply. Grading and Drainage The total project disturbance area for the construction of the new building is expected to be 0.11 acres. The disturbed areas outside the new drive and the building will be seeded for a permanent grass cover (approximately 0.06 acres). Stormwater runoff from the project area is conveyed across an established section of dense grass, eventually draining to the 85th Street drainage swale. Because the project impacts less than one acre, no stormwater detention or post -construc- tion water quality treatment will be necessary Planning Staff Report Flint Hills Resources Site Plan Review — Fire Suppression Building January 24, 2022 Page 5 of 7 Vehicle Access The new fire suppression building will have vehicle access via an extension of the existing gravel entrance off 85th Street South. The new drive extension will provide a vehicle path between the terminal station's existing gravel and the new building's equipment access door. Vehicle Access Parking The proposal does not impact any current or proof of parking areas. Landscape/Restoration Plan The disturbed areas outside the new drive and the building will be seeded for a permanent grass cover (approximately 0.06 acres). Depending on construction timing, temporary seeding may be required. If temporary seeding is installed, the contractor will return to the project site and install permanent seeding at the appropriate time. No additional landscape plantings are proposed so as to not obstruct access to the structure and the equipment as needed. Proposed Restoration Plan Rendering Public Hearing Notices The public hearing notice for the January 24, 2022, Planning Commission meeting was published in the Saint Paul Pioneer Press and mailed to 101 adjacent property owners within 500 feet of the proposed project on January 12, 2022. City Department and Advisory Commission Comments The City's Technical Review Committee met on January 5, 2022. At this meeting, staff considered requiring further landscaping around the building. However, given the purpose of the building is to aid in an emergency fire suppression effort, the Committee determined landscape trees and Planning Staff Report Flint Hills Resources Site Plan Review — Fire Suppression Building January 24, 2022 Page 7 of 7 shrubs could become a potential obstacle for connection to or deployment of emergency equip- ment. The Technical Review Committee found that the proposed site plan meets the requirements of all applicable ordinances. Recommendation That the Planning Commission recommend that the City Council approve the site plan review appli- cation for the 210 square foot fire suppression building on the property of Minnesota Pipeline located at 6483 85th Street South, subject to the conditions stipulated below: The applicant and builders must comply with all City ordinances and policies except as may be modified by agreement of the applicant and City staff. 2. All grading, drainage, erosion control, and utilities must conform to the final plans approved by the City Engineer. 3. All outdoor lighting must meet City Code requirements and must be downward directed with cut-offs. The specifications and analysis of all light fixtures must be provided with the application for a building permit. 4. The applicant is responsible for removing debris from 85th Street South during their con- struction process. This street shall be swept clean daily or as needed. Parking along 85th Street South is prohibited. 5. No exterior storage is allowed. 6. The fire suppression plan must be submitted to and approved by the Fire Marshal and Chief Building Official before a Certificate of Occupancy can be issued. The property owner is responsible to maintain their private watermains, hydrants, and fire suppression systems. 7. Erosion control devices must be installed prior to commencement of any grading activity. Erosion control shall be performed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Control Planning Handbook" and the conditions stipulated in Title 10-5-8, Erosion Control During Construction of the City's Sub- division Ordinance. The applicant is responsible for erosion control inspection fees at the current rates. 8. The applicant will be required to conduct all major activities to construct the improvements during the following hours of operation: i. Monday through Friday 7:00 A.M. to 7:00 P.M. ii. Saturday 9:00 A.M. to 5:00 P.M. iii.
