Re: Low Zone Raw Water Main Phase 1 – Easement Agreements Approval
Background/Discussion
Phases 1 and 2 of the Low Zone Raw Water Main Project, are scheduled to be constructed this
upcoming construction season. This project is identified in the Conceptual Drinking Water
Supply Plan and is fully funded with 3M Settlement Agreement funds. These two phases of the
project are being undertaken at this time due to development scheduled to begin this year along
the alignment of the water main. Installing the water main now will eliminate the issue of coming
back later and re-disturbing property and roadways that are being constructed this year as part
of the development.
This stretch of water main, when fully completed with Phase 3 (at the time of the treatment plant
construction), will provide the connection from Well #10 to the future water treatment plant at the
northeast corner of Ideal Avenue and 110th Street S. Phase 1 of the project is the section of
water main that will be installed from Well #10 at 95th Street S., southerly through the Glengrove
industrial park to 100th Street S. The water main alignment traverses through(on) or adjacent to
four properties. Two of the properties are owned by WAG Farms Inc. et.al, one is owned by
Belijah LLC (Gardenworld), and one is currently owned by the Cottage Grove Economic
Development Authority (EDA). As such, the City needs to acquire various permanent utility and
temporary construction easements along the water main alignment.

The specific easement that needs to be acquired from the EDA is as follows.
1. CG EDA, Lot 1, Block 1, Glengrove Industrial Park 5th Addition
a. Permanent Utility Easement and Temporary Construction Easement of varying
widths, along the westerly and southerly property lines of the lot.
Pursuant to Minn. Stat. 469.105, the EDA must hold a public hearing on the conveyance of the
easement and publish notice of the hearing at least 10 but not more than 20 days in advance.
Such notice was published in the City’s official newspaper for this hearing.
Recommendation
1. Approve a resolution authorizing the conveyance of an easement to the City of Cottage
Grove.
2. Approve the attached Permanent Utility Easement and Temporary Construction Easement
Agreement with the City of Cottage Grove.
