HomeMy WebLinkAbout5.3b Resolution 2022-005 Conveyance of Easement1 COTTAGE GROVE ECONOMIC DEVELOPMENT AUTHORITY WASHINGTON COUNTY STATE OF MINNESOTA RESOLUTION NO. 2022-005 A RESOLUTION AUTHORIZING THE CONVEYANCE OF AN EASEMENT TO THE CITY OF COTTAGE GROVE WHEREAS, the Cottage Grove Economic Development Authority (“EDA”) is the fee owner of certain real property located in the City of Cottage Grove, County of Washington, State of Minnesota, legally described as follows: Lot 1, Block 1, Glengrove Industrial Park 5th Addition, Except the South 50 feet, Washington County, Minnesota. Abstract Property PID No. 20.027.21.43.0011 WHEREAS, as a part of the Low Zone Raw Water Main Phase I Project (“Project”), the City of Cottage Grove (“City”) has requested the EDA convey to it a permanent utility easement and temporary easement for construction purposes located under, over, across, through and upon the real property legally described on the attached Exhibit A and depicted on the attached Exhibit B (“Easement”); and WHEREAS, the EDA desires to convey the Easement to the City in order to provide Project efficiency; and WHEREAS, on February 8, 2022, the EDA held a public public hearing on the conveyance of the Easement to the City and the EDA considered all of the information presented at the public hearing. NOW THEREFORE BE IT RESOLVED by the Board of Commissioners of the Cottage Grove Economic Development Authority that the conveyance of the Easement to the City is in the public interest of the City and its people, furthers its general plan of economic development and furthers the aims and purposes of Minn. Stat. Sections 469.090 to 469.108; and the appropriate officials are authorized to take such action so as to effectuate such conveyance. Adopted this 8th day of February, 2022. Myron Bailey, President Attest: Jennifer Levitt, Executive Director A-1 EXHIBIT A LEGAL DESCRIPTION OF PERMANENT EASEMENT AREA AND TEMPORARY EASEMENT AREA PERMANENT EASEMENT AREA: A permanent easement for utility purposes over, under and across that part of Lot 1, Block 1, GLENGROVE INDUSTRIAL PARK 5TH ADDITION, Washington County, Minnesota, described as follows: Commencing at the northwest corner of said Lot 1; thence North 89 degrees 48 minutes 39 seconds East, assumed bearing along the north line of said Lot 1, a distance of 80.00 feet to the east line of the West 80.00 feet of said Lot 1, and said point being the point of beginning of the easement to be described; thence South 00 degrees 07 minutes 30 seconds West along said east line of the West 80.00 feet, a distance of 328.64 feet to the north line of the South 50.00 feet of said Lot 1; thence North 89 degrees 48 minutes 39 seconds East along said north line of the South 50.00 feet thereof, a distance of 345.17 feet to the southeast line of said Lot 1; thence northeasterly 20.42 feet along said southeast line of Lot 1 to the north line of the South 70.00 feet of said Lot 1; thence South 89 degrees 48 minutes 39 seconds West along said north line of the South 70.00 feet a distance of 329.18 feet to the east line of the West 100.00 feet of said Lot 1; thence North 00 degrees 07 minutes 30 seconds East along said east line of the West 100.00 feet, a distance of 308.64 feet to said north line of said Lot 1; thence westerly 20.00 feet along said north line of Lot 1 to the point of beginning. TEMPORARY EASEMENT AREA: A temporary easement for construction purposes over, under, and across that part of Lot 1, Block 1, GLENGROVE INDUSTRIAL PARK 5TH ADDITION, according to the recorded plat thereof, Washington County, Minnesota, said easement is bound on the west by a line drawn 100.00 feet east of the west line of said Lot 1 and is bound on the south by a line drawn 70.00 feet north of the south line of said Lot 1.
