HomeMy WebLinkAbout4.3a Airgas Temporary Construction Easement Amendment Memo TO: Economic Development Authority FROM: Jennifer Levitt, City Administrator DATE: March 11, 2022 RE: Airgas Temporary Easement Amendment Background/Discussion In 2019, when Airgas was constructing its new facility, it requested use of land adjacent to its property (North and West) for construction staging areas. To facilitate the transaction, the EDA leased certain land from WAG and leased that same land to Airgas for construction purposes. The leases expired last year, but Airgas did not remove all of its equipment and restore the areas prior to the expiration of the leases. WAG and Airgas have agreed to extend the lease to allow Airgas sufficient time to restore the areas this spring. This lease amendment allows for a modest extension of the leased areas. Economic Development Authority March 11, 2022 Page 2 of 2 Recommendation 1. Authorize the EDA President and City Administrator to execute the Temporary Construction Easement Amendment with WAG Farms. 2. Authorize the EDA President and City Administrator to execute the Temporary Construction Easement Amendment with Airgas subject to minor modifications by the City Attorney.
