CALL TO ORDER The City Council of the City of Cottage Grove, Washington County, Minnesota, held a regular meeting on March 1, 2023, at Cottage Grove City Hall, 12800 Ravine Parkway. Mayor Bailey called the meeting to order at 7.00 p.m. 2. PLEDGE OF ALLEGIANCE The audience, staff, and City Council Members stood and recited the Pledge of Allegiance. 3. ROLL CALL City Clerk Tammy Anderson called the roll: Mayor Bailey - Here; Council Member Dennis - Here; Council Member Khambata - Here; Council Member Olsen - Here; Council Member Thiede - Here. Also present: Jennifer Levitt, City Administrator; Korine Land, City Attorney-LeVander, Gillen & Miller, PA; Tammy Anderson, City Clerk; Ryan Burfeind, Public Works Director; Zac Dockter, Parks and Rec Director; Pete Koerner, Public Safety Director; Brenda Malinowski, Finance Director; Emily Schmitz, Senior Planner/Interim Community Development Director. 4. OPEN FORUM Mayor Bailey opened the Open Forum. As no one wished to address the Council, Mayor Bailey closed the Open Forum. 5. ADOPTION OF AGENDA Council Member Dennis made a motion to adopt the agenda; second by Council Member Thiede. Motion carried: 5-0. 6. PRESENTATIONS - None. Approve the February 1, 2023 City Council Regular Meeting minutes. C. Reappoint Commissioners as detailed in the attached memo. D. Appoint Lisa Kons as Chair, Ron Kath as Vice Chair, and Kelsey Moyer as Secretary of the Public Services Commission. E. Appoint Debra Gustafson and Kelly Glasford to the Parks, Recreation and Natural Resources Commission. F. Approve the issuance of rental licenses to the properties in the attached table. G. Accept the donation of a bullet and stab protective vest (value $985.00) from Vested Interest in K9s, Inc. for K9 Scout. H. Authorize issuance of a retail tobacco sales license to Zaid Ali Jameel Aishammaa, on behalf of 4G LLC (DBA: Smoke Leaf) to be located at 7155 Jorgensen Lane South, Suite #120. I. Authorize issuance of a retail tobacco sales license to Lina Yang, on behalf of Releaf Plus, to be located at 7155 80th Street South, #150. J. Authorize issuance of a retail tobacco sales license to TD Retail Group, LLC (DBA High North Dispensary) at 8711 East Point Douglas Road South, Suite 108. K. Authorize issuance of an Intoxicating Cannabinoid License to TD Retail Group, LLC (DBA High North Dispensary) at 8711 East Point Douglas Road South, Suite 108. L. Authorize staff to apply for a MN DNR Conservation Partners Legacy Grant for the Cottage Grove Trailway Corridor native habitat restoration in the amount of $155,000. M. Approve naming the North Trailway Loop within Hamlet Park "The Olson Memorial Trail." N. Authorize service agreement with FPI Paving Contractors Inc. for the removal and replacement of the asphalt at Hamlet Park in the amount of $79,982.00. O. Adopt Resolution 2023-034 approving a new Limited Use Permit for the maintenance and operation of a non -motorized trail along Jamaica Avenue within Minnesota Department of Transportation right of way. P. Adopt Resolution 2023-035 awarding the quote for the 2023 Tree Clearing for the East Point Douglas Road and Jamaica Avenue Project to Precision Landscape and Tree, Inc. in the amount of $15,525.00. Q. Adopt Resolution 2023-033 approving the plans and specifications and establishing a March 23, 2023, bid date for the 2023 Pavement Management Project. R. 1) Approve the Memorandum of Understanding for Parcel 12. 2) Authorize execution of the corresponding easement. 3) Authorize payment of the settlement amount of $101,150.00. Adopt Resolution 2023-032 awarding the 2023 City -Wide Sweeping project to the low quote supplied by Mike McPhillips, Inc., for $117.00 per hour, which at the estimated 350 hours of sweeping for the City of Cottage Grove gives an estimated cost of $40,950. T. Adopt Resolution 2023-030 requesting conveyance of the tax forfeit parcel (PIN 08.027.21.43.0046). U. Adopt Resolution 2023-029, Fund Balance Policy. V. Receive timeline for 2023A Bond sale. Council Member Khambata pulled Item E, Appointments to Parks, Recreation and Natural Resources Commission, and Mayor Bailey pulled Item K, Intoxicating Cannabinoid License, and Item M, The Olson Memorial Trail Naming Request, for further comment and/or discussion. Council Member Khambata stated he had the opportunity, along with the Chair of the Parks, Recreation and Natural Resources Commission, to interview two very passionate and very well qualified applicants this last week. We had an opportunity to talk with Debra Gustafson and Kelly Glasford; both of them will bring a wealth of knowledge to the commission, and we look forward to their service. Mayor Bailey stated regarding Item K, there was a concern mentioned on social media that the City of Cottage Grove and our Council was not approving cannabinoids, so they would not be allowed in the City; that is false. We changed our ordinances to reflect that opportunity, so those who would like to follow the procedures and policies that we put into place are welcome to do so. A business that's already in Cottage Grove, High North Dispensary, is going to be moving into a new location, their goal is to sell this product through the channels of their retail store. Our Council did a really good job of putting forth the opportunity for this business, or any similar business, to be located in Cottage Grove with restrictions we had in place for other alcohol or tobacco businesses. So, we have a policy and we are allowing this in Cottage Grove; if anybody is saying that we're not allowing it, that's false. Mayor Bailey stated Item M, The Olson Memorial Trail Naming Request, has actually been in the works for a little while. Katie and Conway Olson (who has subsequently passed) and Katie's family lives in Cottage Grove; Mayor Bailey has known them for many years. Katie and Conway have donated money for public safety, parks, and have been very involved in our community. Because Conway and Katie loved to cross country ski, they've donated the grooming machine for grooming trails at the River Oaks Golf Course and other parks. The Parks and Recreation Commission came up with this opportunity for individuals who have really given something to the community in a very positive way. Not that long ago, we named a future park after Jack Denzer, a former Cottage Grove mayor and a local business owner; now we're able to name a trail corridor on behalf of the Olson family, Katie and Conway. This would be at Hamlet Park, and the Olsons lived in that area. Mayor Bailey stated he's very happy and excited that Parks and Recreation Director Zac Dockter and the Parks and Recreation Commission City Council Meeting Minutes March 1, 2023 Page 4 came up with this idea. The Conway family is pretty excited about it; Dave Olsen sent an email saying their family is very honored and appreciative of the opportunity to recognize their family in this way. Council Member Dennis stated he'd like to comment on the first item that Mayor Bailey addressed regarding the cannabinoid sales. He noted we patterned our ordinance almost exactly like that of the City of Woodbury, and believed that was also the case with some other communities. We didn't do anything that was outside the box relative to that situation that we were handed from the State of Minnesota; they tend to pass things down without always thinking things all the way through or giving us enough direction to actually come up with something, without having to completely make a wheel. He wanted to ensure the public was aware of that, as there was unfortunate information on social media; it's always a good thing when we can set things straight here. Mayor Bailey stated if you ever have a question, reach out to our City staff, who'll be more than happy to explain things, or reach out to me or one of our Council Members. If something is not good, we're going to say it's not good. If it's something that's not accurate, we're going to set the record straight; that's what he appreciates about this Council and our City staff. Motion by Council Member Olsen to approve the Consent Agenda; second by Council Member Khambata. Motion carried: 5-0. 8. APPROVE DISBURSEMENTS A. Approve payments for the period of 02-15-2023 through 02-22-2023 in the amount of $2,764,058.42. Motion by Council Member Dennis to approve disbursements; second by Council Member Olsen. Motion carried: 5-0. 9. PUBLIC HEARINGS - None. 10. BID AWARDS - None. 11. REGULAR AGENDA - None. 12. COUNCIL COMMENTS AND REQUESTS Council Member Thiede mentioned Strawberry Fest, and we always need helpers for that. The next meeting is Monday night, 6.00 p.m.. at Carbone's. Everybody is always welcome to attend and be part of the fun. Council Member Olsen stated he's wearing his Cottage Grove Lions logo on his shirt tonight because he wanted to let people know that the Lions are once again offering five scholarships for 2023 graduating seniors; they're $2,000 each, an increase from last City Council Meeting Minutes March 1, 2023 Page 5 year. These are predominantly for young people who as they apply can show that they have a real passion for volunteerism in our community; he read aloud the verbiage on the actual scholarship form. The application forms can be found at the guidance counselors' office at both Park High School and East Ridge High School. If there are any questions, feel free to reach out to any of us at the Cottage Grove Lions Club, and we'll be happy to explain the scholarship process and get you a form if necessary. The application deadline, April 5, 2023, is quickly approaching; the scholarships will be awarded in May after all applications are reviewed. Mayor Bailey stated there will be an Easter Egg Hunt at Woodridge Park on Saturday, April 1; it begins at 9:00 a.m., but registration is required. It's a fun time for the kids; if you're interested in that, check out the City's Facebook page or the City website to register your kids for that. Mayor Bailey stated now that Lent has begun, the Eagles Bar & Grill at River Oaks Golf Course has the Fish Fry every Friday night; Mayor Bailey stated he was there last Friday, and it was amazing. Reservations are required, go www.opentable.com to reserve your time and give the number of attendees. You'll enjoy a great evening of food at River Oaks. 13. WORKSHOPS - OPEN TO PUBLIC - None. 14.
