Y 4 Al 1 tk R A'; .. 01 F 11 i a Review Schedule Application Received: May 31, 2023 Application Accepted: May 31, 2023 Planning Commission Meeting: June 26, 2023 Tentative City Council Meeting: July 19, 2023 60-Day Review Deadline: July 30, 2023 Planning Commission Staff Report — Chase Bank Planning Case No. SP/CUP2023-011 June 26, 2023 Page 2 of 9 Background At their July 28, 2002, meeting, the City Council approved an 88,000 square foot Kohls store with a future expansion of 20,000 square feet located on the east side of the building. The approvals included a variance to reduce the parking setback from 20 feet to 5 feet along a public roadway. The approved site plan for Kohls consisted of 530 parking stalls. In 2007 the City Council approved a preliminary plat, site plan, and conditional use permit for a 3,954 square foot restaurant (Culver's) with a drive -through to be constructed in the southwest corner of the Kohls lot as shown below. 2006 2010 Am i The addition of Culver's removed approximately 52 parking stalls, leaving a total of 478 parking stalls for Kohls. The approvals required Culvers to enter into a cross parking agreement with Kohls prior to the issuance of a building permit. Planning Considerations Zoning and Comprehensive Plan The subject site is zoned MU, Mixed Use District, and is guided as Mixed Use in the 2040 Com- prehensive Plan. The request is consistent with the City's zoning ordinance and land use plan as banks with drive-throughs are permitted with the issuance of a Conditional Use Permit in the Mixed -Use zoning district. Planning Commission Staff Report — Chase Bank Planning Case No. SP/CUP2023-011 June 26, 2023 Page 3 of 9 Site Plan Review The Applicant is proposing to remove 50 parking stalls and construct a 3,319 square foot building with a drive -through lane for an in -wall automatic teller machine (ATM). The proposed building will be constructed by JPMorgan Chase Bank. However, JPMorgan Chase Bank will own the proposed building, but lease the surrounding 1.03 acres from Kohls. The Applicant will be respon- sible for the maintenance of the leased space. The proposed building meets all required building setbacks. The proposed trash enclosure is located in the landscaped island to the north of the proposed building and will be constructed using the same materials as the principal structure. Use The hours of operation for the bank will be Monday through Friday 9.00 AM to 6.00 PM and Saturday 9.00 AM to 2.00 PM. The total number of employees onsite at any one time will be eight. The proposed bank is low impact as other similarly designed branch locations with an average of about 20 to 30 inside teller transactions per day (5 days per week) and the exterior drive -up ATM averages about 25 trips per day. The total trips per day is approximately 55. Parking and Site Access Access to the site is proposed via the internal driveway that connects to Hardwood Avenue. A traffic signal warrant analysis was performed to determine if the anticipated increase in traffic volumes would trigger a traffic signal to be warranted at Hardwood Avenue and Hardwood Court. The analysis took into account the recent and potential developments in the area. It was deter- mined that the proposed use is low impact and would not warrant a signal on Hardwood Avenue at Hardwood Court. However, the total proposed lease area will consist of 52 stalls post construction. A cross parking agreement with 7998 Hardwood Avenue (Culvers) will be required prior to the issuance of a building permit. The proposed ATM drive though proposes stacking for six vehicles, which is the minimum requirement. Drive -Through Site Plan Architecture City Code Title 11-6-13C requires that the fagade for this project be comprised of a minimum of 65 percent Class 1 materials. Class 1 materials include the following: • Copper panels • Fired clay face brick • Natural stone, synthetic or cultured stone • Transparent glass, opaque or mirror window panels • Other comparable or superior materials Planning Commission Staff Report — Chase Bank Planning Case No. SP/CUP2023-011 June 26, 2023 Page 5 of 9 The Applicant is proposing 89.2 percent Class 1 material including two different colors of fired clay face brick, stone, and glass windows (all Class 1 materials), as well accent metal panels (Class 3 material). The Applicant has sub- mitted a detailed landscaping plan that shows 8 new overstory trees and 95 shrubs. In addition, the proposed landscaping plan includes 255 perennials and ornamental grasses around the build- ing's perimeter. With the proposed development, the overall imperious surface of the leased area decreases from 37,983 square feet to 32,579 square feet. City ordinance limits the amount of light that can be emitted from commercial property. This limitation must not exceed 1.0 foot-candles onto adjacent proper- ties. The Applicant has submitted a photometric plan that is consistent with City Code. Utilities The subject property is located within the Metropolitan Urban Service Area (MUSA). The devel- opment is planned to connect to available sanitary, watermain, and storm sewer located adjacent to the property. The water service will connect to the 12-inch trunk watermain to the west, the sewer service will connect to the 18-inch trunk sanitary sewer to the east, and the storm sewer will connect to the existing structure on the southern side of the private parking lot. Surface Water Management/Grading The site grading for the project is proposed to meet the surface water management requirements established by the State, Watershed District, and the City's Surface Water Management Plan. Storm water will be managed through a combination of storm sewer and drainage swales. The proposed storm sewer will connect to the private storm sewer within the southern side of the private parking lot. The subject property is proposing the use of stormwater best management practices (BMPs) on -site. These BMPs will need to be maintained periodically to adhere to the surface water management requirements. Therefore, a private maintenance agreement will be executed between the City and the underlying property owner for maintenance of the private storm water system. Public Hearing Notices The public hearing notice for the June 26, 2023, Planning Commission meeting was published in the Saint Paul Pioneer Press and mailed on June 14, 2023, to 17 property owners that are within 500 feet of the proposed project. Staff has not received any comments at the time of writing the report. Recommendation That the Planning Commission recommend that the City Council approve the Conditional Use Permit and Site Plan Review for a 3,319 square foot building with a drive through lane for a in wall automatic teller machine (ATM) to be located in the south parking lot of Kohls, north of 80th Street, east of Culver's, and west of U.S. Bank subject to the following conditions: 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to the plans, as determined by planning staff, shall require review and approval by the Planning Commission and City Council. 2. Prior to the issuance of a building permit, the Developer shall incorporate the recommen- dations, requirements, and evaluations noted in the Bolton & Menk memorandum dated June 20, 2023, and subject to modifications that are agreed to by the developer and City Engineer. All comments shall be adopted herein by reference. 3. Signage is not approved as part of this application. All signage shall meet the requirements of the sign ordinance and requires the submittal of a sign permit application. Conditional Use Permit and Site Plan Review approvals shall expire one year from the date of City Council approval unless a building permit has been requested or a time extension has been granted by the City Council. The City Council may extend the expiration date of such approval upon written application by the person to whom the approval was granted. 5. Prior to the issuance of a building permit the Applicant shall provide the City with a copy of a recorded cross parking agreement with the property located at 7998 Hardwood Avenue. 6. Prior to the issuance of a building permit, the applicant shall submit a letter of credit in the amount of 150 percent of the landscape estimate shall be submitted to the City as required by City ordinance. The financial guarantee shall be in effect for one year from the date of installation to ensure the installation, survival, and re -placement of the landscaping improvements. 7. Prior to the issuance of a building permit, the Applicant shall provide a snow removal and storage plan detailing how snowfalls will be accommodated on site. 8. Prior to the issuance of a building permit, the applicant shall provide a parking lot and landscaping maintenance plan. In the event the maintenance plan is not being imple- mented, the underlying property owner shall be responsible for all maintenance in the leased area. 9. All applicable permits (i.e.; building, electrical, grading, right of way and mechanical) and a commercial plan review packet must be completed, submitted, and approved by the City prior to the commencement of any construction activities. Detailed construction plans must be reviewed and approved by the Building Official, City Engineer and Fire Marshal. 10. All light poles shall be a maximum of 25 feet in height, including base, and shall be shoebox style, downward directed, with LED lamps and flush lens unless approved in writing by Planning staff. Other than wash or architectural lighting, attached security lighting shall be shoebox style, downward directed with flush lens. In addition, any entry lighting under can- opies shall be recessed and use a flush lens. Shields shall also be added as directed by the City. 11. The grading and erosion control plan for the site must comply with NPDES II Permit re- quirements. Erosion control devices must be installed prior to commencement of any grad- ing activity. Erosion control must be performed in accordance with the recommended practices of the "Minnesota Construction Site Erosion and Sediment Control Planning Handbook" and the conditions stipulated in Title 10-5-8, Erosion Control During Construc- tion, of the City's Subdivision Ordinance. The Applicant shall be responsible for the costs for the City to inspect the site in relation to erosion control conformance. 12. The Applicant must provide the City with an as -built survey of all private and public utilities and grading plan prior to issuance of the certificate of occupancy. All mechanical equipment on top of the building and on the ground shall be screened from public view. The mechanical units shall be screened as required in Title 11-6-4 of the City's Zoning Ordinance. 14. The proposed trash enclosure shall be sized and designed appropriately to allow recycling containers. 15. The Applicant shall be responsible for maintaining the sidewalks and removing snow and/or ice from sidewalks on the site. 16. The Applicant is responsible for removing debris from all adjacent public roadways during their grading and construction process. These streets shall be swept clean daily or as needed. 17. All areas of the site, where practical, shall be sodded and maintained. 18. Irrigation shall be provided for all sodded and mulched landscaped areas. The irrigation system shall consist of an underground sprinkling system that is designed by a professional irrigation installer to meet the water requirements of the site's specific vegetation. The sys- tem shall be detailed on the final landscape plan. 19. All disturbed boulevards shall be restored with sod. The property owner shall mow to the back of curb line on all adjacent streets. 20. A private stormwater maintenance agreement shall be executed prior to the issuance of a building permit for the ownership and maintenance of the private infrastructure. Site Development Plans: Sheet C000: 1. A benchmark is identified, but please identify the horizontal and vertical datums for the project on the title sheet. 2. MnDOT right-of-way is labeled on the north side of the property. The city is not aware of right- of-way in this location, please provide documentation. Sheet C500: 10. Please provide additional detail on the plans related to the proposed drainage swales in greenspace. Greenspace grades should be 2% minimum grade to effectively convey drainage. Sheet C600: 11. The proposed sanitary sewer service pipe matches the existing invert of the city's 18" trunk sewer. This sewer serves a large portion of the city and should be expected to flow full. Therefore, it is not recommended to match at the invert. a. Rather than constructing a new manhole on the City's trunk line, which would likely involve bypass pumping, the city recommends an ADS Inserta Tee tapped into the existing 18" DIP. The service should be tapped into approximately the 10-oclock position in accordance with the manufacturer's recommendations. Type 304 stainless steel bands and hardware shall be provided. Please review lead times from the manufacturer for the 18" DIP to 6" Sch. 40 PVC connection. 12. The city fire department has requested a hydrant on the north side of the site for fire protection purposes, see location on attached sheet. 13. The City of Cottage Grove's 2023 standard details should be incorporated into this project (hydrants, valves, etc.): https://www.cottagegrovemn.gov/251/City-Standards Other: 14. A site lighting and photometrics plan shall be submitted. Stormwater Comments: 15. HydroCAD: a. The existing and proposed conditions HydroCAD models do not match the drainage area maps. The model reports include a single subwatershed for both the existing and proposed conditions, but the drainage area maps include multiple subwatersheds. 16. Water Quality Treatment: For redevelopment projects of less than 1 acre, the city requires a net reduction from pre -project conditions. Therefore, on an annual average basis, reductions shall be obtained for the stormwater discharge volume and the stormwater discharges of total suspended solids (TSS) and total phosphorus (TP). a. MIDS model water quality analysis results have been submitted. Since the impervious surfaces on the site are being reduced it makes sense that the project will comply with the water quality treatment requirements since there will be a reduction in runoff volume, TSS and TP. The MIDS results appear to overstate the water quality benefits, however, and show large reductions in dissolved and particulate phosphorus— likely due to simulated infiltration. Infiltration BMPs are prohibited on this site because it lies within the 10-year groundwater capture zone of city wells. Please update the MIDS models to indicate that infiltration BMPs are not allowed on the site, or further explain the results. 17. We assume greenspace areas are intended to positively drain to catch basin structure and not withhold drainage, see comment #10. Bolton & Menk is an equal opportunity employer. Chase Bank Plan Review Page: 3 If the greenspaces are intended to withhold water, any stormwater basin in this area should be lined to prevent infiltration. Place a 1-foot minimum clay liner along the basin bottom up to 1 foot above the NWL. Liner shall have a maximum permeability of 1x10-6 cm/s with a minimum 15% passing the #200 sieve. In addition, HyrdoCAD modeling would then need to be provided to demonstrate the HWL and freeboard. i. Freeboard: For stormwater facilities with emergency overflows, the low adjacent grade (LAG) elevation for all new structures must be a minimum of 3 feet above both the peak surface water elevation for the 100-year precipitation event and 2 feet above the emergency overflow elevation of any immediately adjacent stormwater basin. For backyard and side -yard conveyance and temporary ponding areas, there must be at least 1 foot between the overland overflow elevation and the low adjacent grade elevation of the adjacent structure. ii. Please label the high-water levels (HWLs) and emergency overflows (EOFs) in the stormwater basins and label other on -site surface overflow elevations to demonstrate that adequate freeboard is provided. 18. Rational Storm Sewer Design: Please include a map showing drainage areas to each catch basin and a table showing the rational storm drain design including capacities and velocities. On -site storm sewer should be sized to a 5-year rational method design. Submit design calculations for the storm sewer system and a drainage area map showing each catchment with manholes and catch basins labeled. Include individual pipe segment velocities with calculations for review. a. Pipe sizes and slopes should be selected to provide a minimum open channel velocity of 3 feet per second. b. Maximum storm sewer velocities should be kept at 10 feet per second or less. c. When changing pipe sizes in structure, match crown of pipe elevations instead of inverts. d. Please show storm catch basin IDs, pipe sizes, grades, elevations, and drainage areas on the plans consistent with the rational design tables. 19. Control Erosion at Construction Sites: Construction sites will be inspected to ensure compliance with the existing erosion and sediment control ordinance. The city completes quality assurance inspections on all NPDES permits in the city (where the city is not the owner) twice each month. Erosion and sediment control best management practices as outlined in the Minnesota Stormwater Manual will be required and must be shown on required submittals to the City for approval. a. Any street sweeping conducted by the City to remove erosional debris from streets will be charged to the owner of the property. b. Please note that the city requires silt fence or similar perimeter sediment controls at the back of curb and around lots during the building phase. 20. Models and CAD Files: Please note that digital copies of the final version stormwater models (HydroCAD, MIDS, etc.) and shapefiles or CAD drawings of existing and proposed drainage areas are to be submitted to the city once the review and revision process is complete.
