Proposal

South. The proposed post -construction variance request is to allow a portion of a constructed
accessory structure to be 5 feet 6 inches from the southerly side yard property line when 6 feet is

Background
The Applicant submitted a building permit application for a detached accessory structure which
was received by City Staff on April 19, 2022. The building permit detailed a 320 square foot ac-
cessory structure (16 feet by 20 feet). The submitted site plan indicated a 6-foot side yard setback
to the south property line and a 10 foot rear yard setback to the west property line, which aligns
with the minimum setback requirements for the R-3, Single Family Residential Zoning District.
The Applicant's submitted plans were reviewed as part of the standard permit review process and
were verified by City Staff to meet City Code requirements indicating the proposed construction 6
feet from the south property line (side) and 10 feet from the west property line (rear).

Submitted Site Plan
The permit submittal was reviewed and approved by City Staff and the permit was issued to the
Applicant on April 28, 2022 (Permit Number 2022-016728). All required inspections were com-
pleted, and the final inspection of the structure was approved on August 3, 2022. Given the City
does not have a surveyor on staff, it is the responsibility of the property owner to verify and indicate
to the inspector the location of the property lines on site to measure setbacks.
A survey was completed by the neighboring property owner, which indicated a portion of the
structure to be located 6 inches closer to the side (south) property line. The property owner of
6761 93rd Bay relied on the neighboring property's fence with the assumption the fence was built
following the property line. However, the survey that was completed indicated that the neighboring

fence was erected by the property owners of 6763 93rd Bay several inches onto their property,
which resulted in a portion of the structure not meeting the required 6-foot side yard setback.
City Staff conducted an onsite inspection on June 8, 2023, to verify the setback distance from the
structure to the southerly property line. The neighboring property owner ran a string from the
surveyed property corners from which the inspector measured from as it was indicated that was
the actual property line. Measurements indicate the onsite setback distance at the southeast cor-
ner to be 5 feet, 6 inches from the property line when 6 feet is required, and 6 feet 3 inches from
the southwest property line. The applicant unintentionally measured just off the property line uti-
lizing the fence as the property line marker but the fence was not constructed exactly on the
property line.

Planning Considerations
Zoning and Accessory Structure Standards
The subject site is zoned R-3, Single Family Residential, and accessory structures are permitted
as an accessory use. City Code Title 11-3-5 states the following minimum requirements for
accessory structures within the zoning district.
Side yard setback
6 feet
Rear yard setback
10 feet
Number of structures allowed
1 structure, maximum of 1,000 square feet

Exterior finish
For accessory structures over 200 sq. ft.-
Wood, split face block, vinyl lap, or cement
board materials that are complimentary to the
color palette of the principal structure
Ordinance Criteria
With all variance requests, the Planning Commission must look to the zoning ordinance for guid-
ance and direction. City Code Title 11-2-5: Variances, states the following:
A. Purpose. The purpose of the variance is to allow variation from the strict application of the terms of
this Title where, by reason of the exceptional physical characteristics of the property, the literal en-
forcement of the requirements of this Title would cause practical difficulties for the landowner.
F. Findings. A variance may be granted only when all of the following conditions are found:
1. The variance is in harmony with the general purposes and intent of this Title.
2. The variance is consistent with the Comprehensive Plan.
3. The applicant for the variance establishes that there are practical difficulties in complying with this
Title. "Practical difficulties," as used in connection with the granting of a variance, means that all of
the following must be found to apply:
a. The property owner proposes to use the land in a reasonable manner for a use permitted
in the zone where the land is located, but the proposal is not permitted by other official
controls;
b. The plight of the landowner is due to circumstances unique to the property and that are not
created by the landowner, and
c. The variance, if granted, will not alter the essential character of the neighborhood.
4. Economic considerations alone do not constitute practical difficulties.
Public Hearing Notices
The public hearing notice for the June 26, 2023, Planning Commission meeting was published in
the Saint Paul Pioneer Press and mailed on June 15, 2023, to 68 property owners that are within
500 feet of the proposed project. Staff has not received any comments at the time of writing the
report.
Findings
Findings of facts for a favorable recommendation of the variance request are as follows:

A. The Applicant obtained a building permit for the 320 square foot accessory structure.
B. The building permit application submittal material included a site plan with the shed sketched
in a location compliant with setback requirements.
C. The final building inspection was conducted and passed on August 3, 2022.
D. The rear portion of the shed meets the required 6-foot setback.
E. The structure setback from the west property line (rear) is 10 feet; therefore, the structure
meets the minimum rear yard setback.
F. The structure does not encroach into any drainage and utiliy easements nor does it impact
any City infrastructure.
G. The structure setback from the north property line (side) is 45 feet; therefore, the structure
meets the minimum side yard setback to the north property line.
H. The structure meets the exterior finish requirements and does not alter the essential character
of the neighborhood.
I. The structure is built on a concrete slab, thus reducing the moveability of the constructed
structure.
Recommendation
Based on the findings of fact, staff recommends that the Planning Commission approve the vari-
ance to allow a portion of the shed that was constructed at 5 feet, 6 inches from the south property
line, subject to the following:
1. Any future expansion of the existing accessory structure or replacement of the structure
must meet the setback requirements established in City Code Title 11-3-5.

In the summer of 2022, we had made the decision to build a 16'x20' detached
garage/shed on our property to help store some of our belongings. By this time, we already had a
chain -link fence installed surrounding the remaining unfenced parts of our yard with a 10-foot
gate. This gate was located on the west side of our property and favored the north side. Due to
the size of the shed that we wanted to construct, and not wanting to block our 10-foot gate, we
opted to place our shed on the southwest corner of our property.
When we closed on our home in 2020, we received a copy of the survey that our builder
had completed. From the information we received our lot is a very basic rectangular shape.
Knowing what the offsets needed to be for both the back property line and from the neighboring
property we decided to line up the shed to be parallel to the rear property line because it faces
Mississippi Dunes Boulevard and we wanted the shed to be aesthetically pleasing as it would be
seen by everyone driving on Mississippi Dunes Boulevard and our HOA needed to approve the
location as well.
When deciding to place the shed parallel to the west side property line we had no idea our
biggest obstacle would be finding the property line with a neighboring fence that was not
straight. The neighbor's privacy fence was already in the process of being installed when we
closed on our home and was fully completed more than a year by the time we had decided to
build this shed. They had the property line marked out with a string for the installation of their
fence, so we assumed it followed the property line as anticipated. Upon further inspection while
doing the measurements for our shed, it was determined that their fence was crooked on the
property line. The neighboring fence started many inches onto their property at one end and at
the other it ended up almost a foot onto our property. Our contractor and ourselves had calculated
out approximately where we believed the fence crossed over the property line. We were only able
to locate the southwest property pin, we were never able to locate the south east property pin.
Due to this our measurements were based off of the back southwest property pin and the fact that
our home had to be a minimum of 7 1/2 feet off of the property line. On the east corner of the
shed, we had believed the fence had already crossed the property line, so the forms for the
concrete slab were placed approximately 6 feet away from the fence to ensure that we still were
within the accurate setbacks that the city requires. On the west side of the shed, we knew that
their fence was on their property at that point, so we ensured we added extra distance from the
fence to the shed. On that corner of the shed we are approximately 7 feet away from the
neighbor's fence.
After the forms were completed and we were ready for the concrete slab to be poured,
our contractor did have to have the forms and the setbacks approved by the city. It was even
asked if they could verify that we were far enough off the property line or if the forms had to be
moved and it was ensured that we were far enough away and they had signed off on the forms
and the setbacks for the permit. Thinking that the measurements for the setbacks were great, we
had resumed with the rest of the building process.
We are requesting a variance as it has been brought to our attention one corner of our
shed is too close to the property line. A new survey was recently completed by our neighbors and
their attorney after their first contest of our shed was determined to be inconclusive by the city
building inspector. Inadvertently, our shed is too close to the south property line despite all our
best efforts to try to comply with the city's setback rules for an outdoor structure. It was not our
intention to not be in compliance with the city's rules. We made all attempts to measure and to
calculate where the property lines were based off the existing southwest property pin and where
the property line was between the homes, and even double checked our work. In the end, we are
