The subject site was subdivided as part of the Hinton Heights 1st Addition plat, which was approved in July 1979. The site has had numerous development proposals but none of them have come to fruition. Planning Considerations Use The Applicant is proposing a 52-unit affordable senior (age restricted 62+) apartment building. The proposed project will provide 36 units set at 30 percent of the area median income (AMI) rents and the remaining 16 units will be set at 60 percent AMI. The table below shows 2023 income and rent limits for affordable housing. Data is provided from the Metropolitan Council. 2023 Income limits by household size: Washington County AMI 1 Persons 2 Person 30% $26,100 $29,820 60% $52,200 $59,640 2023 HUD maximum gross rents by bedroom size: Washington Count AMI Studio 1 Bedroom 30% $652 $699 60% $1,305 $1,398 There will be high demand for the proposed housing provided by the project due to a limited availability of the deep affordability that will be offered. The unit types include studios and one bedroom with multiple different layouts. The amenities will include on -site management and resi- dent service coordination, on -site laundry (common area laundry room), craft room with program- ming, storage lockers, on -site parking, and secure mail/package rooms. Unit amenities will include luxury vinyl plank flooring or similar, accessible units, dishwashers, and patios for select units. The location is ideally situated for the planned project given its proximity to the following: • Gateway North Shopping Center (grocery, restaurant, services, etc.) • Park Grove Library • Oakwood Park • DARTS Cottage Grove Bus Loop • Metro Mobility Comprehensive Plan As part of the comprehensive planning process, state law requires cities in the seven -county metropolitan area to include standards, plans, and programs for providing adequate housing opportunities to meet existing and projected local and regional housing needs. One of the primary goals in the Cottage Grove 2040 Comprehensive Plan is to provide a diverse mix of housing types that are needed to serve all income levels and stages in the life cycle. The proposed development fulfils this goal as it provides a deeply affordable housing option for seniors. The proposed project also meets the following additional goals and policies found in the Comprehensive Plan. Planning Commission Staff Report —Trellis Senior Housing Planning Case No. SP/PUD 2023-012 June 26, 2023 Page 3 of 11 • The proposed development provides residential housing near economic centers. • The proposed development provides opportunities for alternative housing types that increase density and is responsive to the site and surrounding areas. • Encourage the infilling of housing in urban areas that make more efficient use of existing infrastructure. • Provide opportunities for alternative housing types and patterns, such as planned unit devel- opments, mixed -uses, and other techniques that reduce development costs, increase density, and achieve projects that are flexible and responsive to the site and surroundings. • The proposed project assists the city in meeting its Metropolitan Council goal of providing 333 new affordable units for 30 percent AMI in the Community. Land Use and Density Density is calculated by taking maximum permitted density as allowed by the 2040 Comprehen- sive Plan and dividing it by the total land area. The 2040 Comprehensive Plan Land Use Plan guides the subject site as Mixed Use. The permitted density in this district is 20 to 40 units per acre. The subject site is 0.9 acres and has a permitted density of 36 units. However, the 2040 Comprehensive Plan and City Code provides the City Council the authority to increase density via a Density Bonus and/or Transfer for individual residential projects that support the specified public policy goal of providing affordable housing. Density Bonus Density bonuses consistent with the comprehensive plan may be granted by the City Council to increase the maximum permitted density for residentially guided land if the proposed project meets certain affordable housing policies. The allowable total density can increase under this provision but shall not be increased more than 20 percent. City Code section 11-4-1 states that projects with 10 to 15 percent of the total units set aside for 30 percent AMI may receive a density bonus of 15 to 20 percent. The Applicant is proposing 69 percent of the units to be set at 30 percent AMI, which significantly exceeds the zoning code requirement and allows for the maxi- mum density bonus of 20 percent or an increase of seven units. Density Transfer A density transfer through the PUD process is a common practice for multi -family projects as a method to increase density within a certain portion of a project area. A density transfer is the relocation of housing units on part of a site to another part of the same site resulting in an increase in density to the transfer area for the purpose of preserving open space. The subject site is part of the Hinton Heights 1 st Addition, which consisted of 16 lots and one outlot (Outlot A) for storm - water ponding. The area north of 79th Street South was replatted as part of the Bright Keys and Park Grove Estates developments, but Lots 1 through 4 and Outlot A of Hinton Heights 1 st Addi- tion remained as shown below. A secondary access is not required. City Code requires a minimum of 1.5 spaces per unit for senior citizen housing (independent) or a total of 78 parking spaces for 52 dwelling units. The Applicant is requesting flexibility to reduce the number of parking stalls onsite to 43 via the PUD. The intent of the independent senior citizen housing parking standard is to regulate market rate senior housing and not affordable senior fa- cilities. The Applicant owns and manages several other affordable senior properties and has found low parking utilization compared to the general occupancy housing it owns and operates. Planning Commission Staff Report —Trellis Senior Housing Planning Case No. SP/PUD 2023-012 June 26, 2023 Page 6 of 11 The reduction in the required parking ratio is requested to better suit the actual, expected utiliza- tion of parking by future residents, staff, and guests as shown in the table above. The project will also benefit from having existing on -street parking available for guests during peak times such as holidays and from regular route transit service provided by the DARTS Cottage Grove Bus Loop and Metro Mobility Transit. The Applicant has requested flexibility to encroach into the 20-foot front yard parking lot setback. The proposed parking lot is setback approximately 12 feet from the front yard property line along 79th Street South. This request is not precedent setting as other approved projects have received similar flexibility. The Grove 80 apartment building located at 7550 80th Street South was provided setback flexibility of 8.5 feet from the property line. The remainder of the proposed parking lot is in conformance with the parking lot setback requirements. Lighting Outdoor light fixtures will consist of wall units on the building's exterior walls and two parking lot light poles that are 15 feet in height. Per City Code any lighting used to illuminate an off-street parking area, sign, building, or yard shall direct light away from any adjoining residential property or from the public streets and be compatible with adjacent lighting in adjoining districts. The re- flected glare of spill light shall not exceed one (1.0) foot-candle as measured on the property line. The Applicant has submitted a photometric plan that is consistent with City Code. Landscaping The Applicant has submitted a detailed land- scaping plan. The Zoning Code requires that a minimum number of trees and shrubs be pro- vided based on the gross square footage of the subject property. The minimum landscaping re- quirements for the property are 11 overstory trees, 10 coniferous trees, and 23 shrubs. The applicant is proposing to plant 11 overstory trees, 10 coniferous trees, and 39 shrubs. In addition to the planting of trees and shrubs throughout the property, the proposed land- scaping plan includes 30 perennials and grasses to be located along the building's perimeter as required by ordinance. The Appli- cant is also exploring adding additional shrubs and grasses along the eastern side of the park- ing lot to assist in screening the parking area from the commercial use. Architecture i------------f----------- I fir' I 1 Landscaping Plan The City's Zoning Code requires an apartment to utilize three Class I materials as outlined in the City's Code and be composed of at least 65 percent Class 1 or 2 materials. The Applicant is requesting PUD flexibility to use 46 percent Class I and 54 percent Class III materials. The Applicant has proposed exterior materials and articulation that provide for all high quality, attractive, and durable materials. The building exterior is designed to complement both the existing commercial and residential characteristics of the surrounding neighborhood. On the first floor adjacent to Hemingway Avenue, the Applicant is proposing the large patio units to help activate the building at a pedestrian scale and reinforce the building's residential character. The flat roof and metal canopies that are typically found on commercial buildings in the community, while the exterior material palette consisting of cultured stone with various fiber cement lap and panel sidings are consistent with the residential properties to the north of the project site. The proposed project has similar material percentages as the Grove 80 apartment building located to the southwest of the subject site. Given the proposed development will be accessing off 79th Street, the developer would be required to make all necessary repairs to the sidewalk as part of construction of the access to the site. The devel- oper would also be responsible for adding sidewalk along the east side of Hemingway Avenue. Utilities The subject property is located within the Metropolitan Urban Service Area (MUSA). The devel- opment is planned to connect to available sanitary, watermain, and storm sewer located adjacent to the property. Both sanitary and water main are currently located within 79th Street and are available for connection to support the proposed development. Grading and Stormwater The site grading for the project is proposed to meet the surface water management requirements established by the State, Watershed District, and the City's Surface Water Management Plan. Stormwater management is proposed to be addressed with an underground stormwater infiltration chamber in the northeast corner of the parking lot. The underground infiltration chamber on the site will be privately owned and maintained; therefore, a private maintenance agreement will be required to be recorded with the property. The chamber outlet would connect to the existing storm sewer system within 79th Street. Neighborhood Meeting The Developer held a neighborhood meeting on June 13, 2023. They mailed notices of the neigh- borhood meeting to property owners within 500 feet of the proposed development (112 property owners). One resident and one commercial property owner attended and participated in the open house style meeting. The resident had concerns about potential impacts to his property caused by the development, traffic on Hemingway, and concerns for the large number of children that wait for the school bus on the subject site. The commercial property owner had concerns about construction noise impacts and screening concerns. The Applicant responded to the screening concerns by of- fering to add additional landscaping. The additional sidewalks should provide more safety for children waiting for the bus. The proposed use is a low vehicle trip generating use. Planning Commission Staff Report —Trellis Senior Housing Planning Case No. SP/PUD 2023-012 June 26, 2023 Page 9 of 11 Public Hearing Notices Notices announcing this public hearing were published in the St. Paul Pioneer Press and mailed to 112 property owners within 500 feet of the proposed development property on June 14, 2023. Staff has received one email in support of the proposed project, which is attached. Recommendation That the Planning Commission recommend that the City Council approve the Planned Unit De- velopment and Site Plan Review for a 52-unit, four-story affordable senior multi -family apartment building located at 7601 79th Street South, subject to the following conditions: General Development 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to the plans, as determined by the planning staff, shall require review and approval by the Planning Commission and City Council. 2. Prior to the issuance of a building permit, the Developer shall incorporate the recommen- dations, requirements, and evaluations noted in the Bolton & Menk memorandum dated June 20, 2023, and subject to modifications that are agreed to by the developer and City Engineer. All comments shall be adopted herein by reference. 3. Planned Unit Development and Site Plan Review approvals shall expire one year from the date of City Council approval unless a building permit has been requested or a time exten- sion has been granted by the City Council. The City Council may extend the expiration date of such approval upon written application by the person to whom the approval was granted. 4. The applicant receives appropriate permits or approvals from other regulatory agencies including, but not limited to: South Washington Watershed District, Minnesota Department of Health, Minnesota Department of Natural Resources, and Minnesota Pollution Control Agency. 5. All grading, drainage, erosion control, and utilities must conform to the final plans approved by the City Engineer. 6. Signage is not approved as part of this application. All signage shall meet the requirements of the sign ordinance, including a monument sign with a base wrapped in the same mate- rials as found on the principal structure per the City Code. 7. The developer shall enter into a stormwater management agreement with the City for the ownership and maintenance of the private underground infiltration chamber and storm water system. Construction and Grading 8. A grading permit and financial security are required for grading activity related to the project. All light fixtures must be downward directed downward directed with flush lenses. In addition, any lighting under canopies (building entries) shall be recessed and use a flush lens. The specifications of all light fix- tures must be provided with the application for a building permit. The light poles and fixtures shall be consistent in design and color with the development. 10. Prior to the issuance of a building permit the final architectural plans, lighting details, and exterior construction materials and colors must be reviewed and approved by the Commu- nity Development Department. 11. All mechanical units shall be screened as required in Title 11-6-4 of the City's Zoning Ordi- nance. All mechanical equipment screening shall be consistent with the principal building architecture and must comply with City ordinance regulations and be reviewed and ap- proved by the Community Development Department prior to the issuance of a building permit. 12. Rubbish, garbage, and recycling containers shall be stored in doors prior unless pickup is occurring. 13. Any decorative fencing shall be approved by planning staff prior to installation. 14. No exterior storage shall be permitted. Landscaping 15. Prior to the issuance of a building permit, the applicant shall submit a letter of credit in the amount of 150 percent of the landscape estimate shall be submitted to the City as required by City ordinance. The financial guarantee shall be in effect for one year from the date of installation to ensure the installation, survival, and re -placement of the landscaping improvements. 16. Irrigation shall be provided for all sodded and mulched landscaped areas. The irrigation system shall consist of an underground sprinkling system that is designed by a professional irrigation installer to meet the water requirements of the site's specific vegetation. The sys- tem shall be detailed on the final landscape plan. 17. All areas of the site, where practical, shall be sodded and maintained. The development shall mow and maintain all site boulevards to the curb line of the public streets. 18. Prior to the issuance of a building permit, planning staff shall review and approve a final landscaping plan in writing. Onsite Infrastructure Improvements 19. The developer is responsible for all street maintenance; upkeep, and repair of curbs, boule- vards, and sod. The developer hereby agrees to indemnify and hold the City harmless from any and all claims for damages of any nature whatsoever arising out of developer's acts or omissions in performing the obligations imposed upon developer by this paragraph. Developer will be required to conduct all major activities to construct the improvements during the following hours of operation: Monday through Friday 7:00 A.M. to 7:00 P.M. Saturday (requires 48-hour notice) 9:00 A.M. to 7:00 P.M. Sunday Not Allowed This does not apply to activities that are required on a 24-hour basis such as dewatering or bi pass pumping, etc. Any deviations from the above hours are subject to approval by the City. 21. The Developer shall weekly, or more often if required by the City Engineer, clear from the public streets and property any soil, earth, or debris resulting from construction work by the developer or its agents or assigns. All debris, including brush, vegetation, trees, and dem- olition materials, shall be properly disposed of off -site; burying construction debris, trees, and other vegetation is prohibited. Burning of trees and structures is prohibited, except for fire training only. 22. The Developer grants the City, its agents, employees, officers, and contractors, permission to enter the site to perform all necessary inspections during grading and construction activities. 23. The Applicant must provide the City with an as -built survey of all private and public utilities and grading plan prior to issuance of the certificate of occupancy. 24. Adequate dumpsters must be on site during construction. When the dumpsters are full, they must be emptied immediately or replaced with an empty dumpster. Please label all pond and local drainage emergency overflow elevations (EOF) locations and elevations, specifically through the parking lot and for each proposed stormwater basin. 9. Please contain the EOF and associated overland route for the catch basin in the southeast side of the site within this proposed development. Sheet C4.0- 10. Please modify note #4 accordingly. 11. The city fire department has requested an additional hydrant(s) for firefighting purposes. a. Fire Code requires hydrant coverage of 400 feet for any sprinkled building as measured along the approved fire route (parking lot or street). Due to a single hydrant along 791n Street being accessed off the city street, an additional hydrant will be required per Fire Code. Sheets C5.0: 12. Add the following city standard details to the plans: a. STR-17 (since STR-21 references it), WAT-1, WAT-3. Sheet L1.0: 13. No plantings are currently proposed in public drainage and utility easements, but for clarity please add a note to the plan that no plantings will be allowed in the existing drainage and utility easements. Other: 14. A site lighting and photometrics plan shall be submitted. Stormwater Comments: 15. Soil Borings: Soil borings are required in the vicinity of proposed volume control BMPs. Borings are needed to identify soil conditions and the presence of groundwater or bedrock. Soil borings should extend a minimum of 3 feet below the lowest constructed elevation of proposed BMPs. 16. Infiltration Pipe: The Infiltration System detail on Sheet C5.1 shows two lines of 120" CMP and the HydroCAD model includes three lines of 72" CMP. Please update the plans or model to be consistent. 17. Rational Storm Sewer Design: Sheet C4.0 shows storm drain catch basins and pipe alignments. a. On -site storm sewer should be sized to a 5-year rational method design. Trunk facilities should be analyzed and designed to accommodate the 100-year ponded discharges plus 5-year rational flows from areas that enter the trunk to be carried to the next storage area downstream. When changing pipe sizes in structure, match crown of pipe elevations instead of inverts. iv. Please show storm catch basin IDs, pipe sizes, grades, elevations, and drainage areas on the plans consistent with the rational design tables. 18. Infiltration Testing: Sheet C5.1 states contractor must provide double ring infiltrometer testing once infiltration chamber subgrade is excavated. The post -construction testing of infiltration rates within the basin, or post -construction records of water level measurements within the basin, will be required to verify that design infiltration/filtration rates and drawdown periods will be met. Please add the following to the infiltration basin plan notes: "Post construction testing of the infiltration rate and drawdown period will be required." Post construction testing should yield results of approximately twice the design rate, providing a safety factor consistent with Section 16.11 of the NPDES Construction Stormwater Permit. If test results exceed 8.3 inches per hour, Section 16.16 requires that soils be amended to slow the infiltration rate below 8.3 inches per hour. 19. Control Erosion at Construction Sites: Construction sites will be inspected to ensure compliance with the existing erosion and sediment control ordinance, Watershed District requirements, and with the construction site permit under NPDES Phase II MS4 rules. The city completes quality assurance inspections on all NPDES permits in the city (where the city is not the owner) twice each month. Erosion and sediment control best management practices as outlined in the Minnesota Stormwater Manual will be required and must be shown on required submittals to the City for approval. a. Any street sweeping conducted by the City to remove erosional debris from streets will be charged to the owner of the property. b. Please note that rigorous sediment and erosion controls are necessary to keep sediment and runoff away from the infiltration basins during construction. c. On the final plans, please describe phasing to ensure excavation of the infiltration basin after the drainage area is stabilized. d. Sheet SW1.4 Permanent Stormwater Management 3. States: "IT IS NOT FEASIBLE TO MEET REQUIREMENT FOR WATER QUALITY VOLUME." Since the infiltration system appears to provide sufficient treatment, please correct or delete the statement. e.
