This is a formal written objection to the proposed assessment that is to be levied against property
address 950179th St S, Cottage Grove, MN 55016, for the 2024 Pavement Management Project. This
maintenance project did not provide any special benefit to my property and does not add any additional
value to my property. The city of Cottage Grove cannot produce a single document that shows that it has
ever taken the condition of the road into consideration when appraising the market value of my property
for proposed property taxes. If replaced roads and curbs adds value to a property, then the city should
have documentation showing that depreciated roads and curbs reduces the market value of a property. I
have the original appraisal of my home when I purchased it in 2018 and the only attribute that the
appraisal states about the road is that it is "paved". The appraisal states nothing about the condition.
Furthermore, the disrepair of the road was on full display in 2018 when I purchased the home and it was
not even a remote factor in whether I purchased the home or the amount that I purchased the home for.
Additionally, the so-called "special benefit" is only realized if the property owner sells the property.
The city of Cottage Grove is planning to levy this assessment pursuant to Minnesota Statutes, Chapter
429. However, the special benefit burden of proof under that statute has clearly not been met and I
believe that the city will have a very difficult time proving it in court. I strongly object to this assessment
and I plan to use all available options to prevent it.
