Mr. Theisen then proceeded to the next stage of the recruitment process, which included a background investigation, psychological examination, drug test and physical examination. Mr. Theisen, having successfully completed this second stage of the background investigation, and successfully completing alI other requirements, began his employment with the City as a CSO paramedic on Monday, April 20, 1998. Ali employees appointed via the Accelerated Law Enforcement Recruitment Program are required to sign an agreement. The attached agreement was signed by Paul Theisen, and is consistent with the agreements signed by previous participants in the program. The agreement simply outlines Mr. Theisen's responsibilities for continued employment under this program and what the City agrees to as employer under this program. Included in the agreement is language that states that Mr. Theisen agrees that in the event he fails to meet any of the requirements of this agreement, he would be obligated to reimburse the City for tuition and books, according to an inciuded reimbursement schedule. '� 1 _ �� , •• ' � 1 I � t' i . . � �. � . , "PAUL ANTHONY THEISEN" This Agreement is entered into by and between the City of Cottage Grove (hereinafter "City") and Paul Anthony Theisen (hereinafter "Theisen"). RecitaLs 1. Theisen has been offered employment by the City of Cottage Grove as a Community Service Officer/Paramedic with the understanding that he will complete educational requirements to become a full time licensed Police Officer/Paramedic 2. Theisen is currently enrolled in the Law Enforcement Skills Program at Minneapolis Community College, Energy Park Campus, beginning June 1998 3. Theisen is a licensed Paramedic within the State of Minnesota 4. Theisen .desires to become a full time licensed Peace Officer/Paramedic with the City of Cottage Grove NOW THEREFORE, in consideration of mutual promises contained herein, the City and Theisen agree as follows: 1. The City agrees to employ Theisen as a Community Service Officer/Paramedic pending his completion of the 04-07-98 Accelerated Law Enforcement Recruitment Program Paul Anthony Theisen Aareement Skill requirements to become a full time Police Officer; Theisen agrees to pursue and complete the Law Enforcement Skills Program by January 15, 1999. 2. Provided Theisen meets the requirements of condition Number 7, of this agreement, the City Agrees to pay the cost of tuition and books for Theisen's completion of the Law Enforcement Skills Program in an amount estimated not to exceed $6,000.00. 3. Theisen agrees to obtain a full time peace officer license from the State of Minnesota within 30 days of becoming eligible for licensure which is anticipated to be May 20, 1999. Failure to meet this requirement may result in the termination of employment as a Community Service Officer/Paramedic. 4. Theisen agrees to work as a full time Community Service Officer/Paramedic with the Cottage Grove Police Department while completing his Law Enforcement Skills Program. 5. Theisen agrees to maintain a current paramedic license within the State of Minnesota in accordance with the Department's Medical Directors while completing his degree in law enforcement. 6. The City agrees to employ Theisen as a full time Police Officer/Paramedic upon his successful acquirement of a full time peace officer license in accordance with POST Board rules for the State of Minnesota. 7. Theisen agrees to work as a Full Time Peace Officer/Paramedic for the City of Cottage Grove Police Department for a period of five (5) years commencing immediately upon becoming licensed as a Full Time Peace Officer. 8. Theisen shall be obligated to reimburse the City of Cottage Grove for any and all payments made by the City toward the cost of his tuition and books if any of the following occur: A. Failure to become licensed POST eligible as a Full Time Minnesota Peace Officer within 60 days of completing the Law Enforcement Skills Program. 09-07-98 Accelerated Law Enforcement Recruitment Program Paul Anthony Theisen Aareement � G 0 0 Termination from the position of Community Service Officer/Paramedic for poor job performance. Conviction of a crime or other activity which would prevent him from obtaining and maintaining a license from the POST Board as a Peace Officer. Failure to meet any of the selection requirements for the position of Peace Officer/Paramedic for the Cottage Grove Police Department. Failure to successfully complete the Police Department's Field Training Officer Program. F. Failure to complete the year probationary period, on the date of employment Peace Officer position. Police Department's one which period commences as a Full Time Licensed G. Resignation from the position of Peace Officer/Paramedic with the Police Department prior to completing five (5) years of service in that position. H. Termination for misconduct as a Peace Officer/Paramedic from the Cottage Grove Police Department prior to completing five (5) years of service in that position. 9. Theisen agrees in the event that he fails to meet any of the requirements of this agreement and becomes obligated to reimburse the City for tuition and books, said reimbursement shall be paid in accordance with the following schedule: 100 o reimbursement if termination occurs prior to completing one year as a Peace Officer/Paramedic. 80 % reimbursement if termination occurs prior to completing two years as a Peace Officer/Paramedic. 60 % reimbursement if termination occurs prior to completing three years as a Peace Officer/Paramedic. 40 % reimbursement if termination occurs prior to completing four years as a Peace 09-07-98 Accelerated Law Enforcement Recruitment Program Paul Anthony Theisen Aareement Officer/Paramedic. 20 o reimbursement completing five Officer/Paramedic. if termination occurs prior to years as a Peace No reimbursement is required after the employee has served as a Peace Officer/Paramedic for five years. If Theisen is obligated to repay any amount expended by the City for tuition and books, pursuant to the foregoing terms, the amount reimbursed shall be paid to the City in full within one hundred and twenty (120) days of the event triggering the necessity for repayment. The City Council may, at its sole discretion, allow additional time for Theisen to repay the amount due.
