EASEMEN'� AND AGREEMENT
THIS INDENTURE, made this 5th day of MaY , 1998, by and
between Thomas M. Venin, (Grantor); and the City of Cottage Grove, Washington
County, Minnesota, (Grantee).
WITNESSETH:
Wf�REAS, Grantor is the owner in fee simple of the real estate hereinafter
described.
That for and in consideration of the sum of One Thousand Five Hundred and
no/100's Dollars ($1,500.00) and other good and valuable consideration, the receipt of
which is hereby acknowledged, Grantor has this day bargained and sold, and by these
presents does bargain, sell and transfer unto the City of Cottage Crrove, its successors and
assigns the following:
A perpetual easement for public utility purposes with the right to enter upon the
real estate hereinafter described at any time that it may see fit, and construct, maintain and
repair any lines, equipment, materials, or other items for public utility purposes, for the
purpose of maintaining, repairing or reptacing the said public utilities over, across, through
and under the lands hereinafter described, together with the right to excavate and refill
ditches and/or trenches for the location of said public utitities, and the further right to
remove trees, bushes, undergrowth, and other obstructions interfering in the tocation,
construction and maintenance of said public utilities.
That said public utility easement located in the County of Washington, State of
Minnesota, is described as fotlows, to-wit:
A perpetual easement for public utility purposes over, under and across the
north 10 feet of the south 70 feet of that part of the Southwest Quarter of
the Southeas� Quarter of Section 8, Township 27, Range 21, Washington
County, Minnesota, described as follows:
Be�inning at a point on the south line thereof, distant 1700 feet west from
the southeast comer of said Southeast Quarter; thence northerly at right
angles to said south line 300 feet; thence easterly parallel with said south
line 200 feet; thence southerly at right angles 100 feet; thence westeriy
parallel with said south line 50 feet; thence southerly at right angles 200
feet to said south line; thence westerly along said south line 150 feet to the
point of beginning. Subject to an easement for street purposes over the
south 60 feet thereof..
TO HAVE AND TO H�LD said perpetual easement and rights-of-way unto the
City of Cottage Crrove, Washingon County, Minnesota, its successors and assigns,
forever:
Grantor does hereby covenant with the City of Cottage Grove, that it is lawfully
seized and possessed ofthe reatestate above described.
IN WITNESS WF�REOF, the said parties have caused this instrument to be
