Kinsey Date: May 28, 1998 :• u_ =, ��• INTRODUCTION In lieu of the most recent criminal incident associated with dances held at the Majestic Ballroom, the following data is being brought to your attention for possible action. BACKGROUND Pursuant to the issuance of the 1998 Consumption and Dispiay Permit for the Majestic Ballroom, Council granted the permit citing ten {10) conditions of compliance . The city shall be notified in writing of alI public dances, a minimum of two weeks prior to the event. . You will hire 8 uniformed, unarmed security o�cers from a Mi�nesota licensed security company. • One of the above security officers must be fluent in the predominant language of the patrons at the dance, if other than English. • Security officers must check identification of all person entering the dance. �- •: �:: • Page 1 • Only the following forms of identification will be acceptable. • Valid Minnesota picture driver's license m Valid Minnesota picture identification card. • Valid driver's license from other states within the United States. • Current pass port • United States military green card • Valid INS Alien identification card • Persons under twenty-one years of age must be securely separated from areas where alcoholic beverages are sold, displayed, or consumed. Unless accompanied by their parent or legal guardian. • All person entering the Baliroom must remain in the building until leaving for the evening. No one will be allowed to leave and re-enter the building. . Any person under the age of twenty-one years of age found to be in the possession of or have consumed any aicoholic beverages, shall immediately be brought to the attention of the Cottage Grove Police Department. • Security officers will be present in the parking lot during all times when dances are being conducted to enforce fire lane parking restrictions and ensure that emergency lanes wide enough to allow the passing of all emergency vehicles (including fire apparatus) are maintained beiween each row of parked vehicles. . No more than 1200 people including Baliroom employees, band members, security and patrons, shall be allowed in the building. Numbered tickets indicating the number of patrons who have been admitted to the Baliroom shall be maintained and be immediately available to any member of the Cottage Grove Department of Public Safety. With the above conditions in mind, a form was developed by the Police Department to determine compliance at each of the dances held at the Majestic ballroom. Since February 13, 1998, a supervisor from the Cottage Grove Police Department has made an on site inspection of each dance held at the Majestic Baliroom, and documented the compliance findings on the developed form. Said findings were forwarded to former Director of Public Safety Dennis Cusick, and most recently to me. Of the 68 persons contacted, only one was a resident of Cottage Grove or for that matter, Washington County. 1998 17 Criminal incidents 2 Felony assaults 2 Misdemeanor assaults 1 Weapons Violation 1 Recovered stoien vehicle 3 Liquor violations 5 Property damage 3 Fire lane violations • Page 5 2 Service calis 1 Suspicious person 1 Public assist So far in 1998, a total of 39 persons have been contacted for the above listed 19 calls. Of the 39 persons contacted, only 1 person was a Cottage Grove resident, and that was our Officer who was assaulted. Cottage Grove Public Safety Department resources expended for 1997 and year to date 1998, calls to the Majestic Ballroom for scene response time only are: 1997 Criminal 1997 Service 1998 Criminal 1998 Service Totai (See attached) 1753.12 100.47 608.42 289.67 2751.68 In addition, in 1997, a squad car sustained damage in the apprehension of one of the attempted homicide suspects wherein the responding o�cer rammed the suspecYs vehicle to prevent the suspect from intentionally running over another pedestrian, which he was in the process of doing upon the officer's arrival. Damaged squad $2,888.30. Finally, the above costs do not reflect the additionai costs incurred by our department and the city with respect to additional investigations and follow up of eriminal incidents, investigation and patroi officer time in report documentation of all incidents, clerical, dispatch, and records transcription and data entry time, prosecution (attomey's fees) costs, officer court time, worker's compensation costs for the injured officer and the costs incurred by the multiple assisting agencies. CONCLUSION The owners of the Majestic Ballroom are operating their establishment in blatant disregard of the conditions imposed upon them by the Council. 2. An inordanant amount of our resources (personnel and financiai) are being consumed by the activities at the Majestic Bailroom. The citizens of Cottage Grove and Washington County are not pafronizing or benefiting form the events being held at the Majestic Ballroom. RECOMMENDATION Attach additional conditions to the Majestic Baliroom's Consumption and Display Permit requiring the owner(s) to be responsible for the actions of their • Page 6 patrons not only inside their facility but on their property and adjacent properties and roadways. 2. Attach manetary penalties for each and every future violation of their Consumption and Dispiay Permit. 3. Monetarily penalize for past violations of their Consumption and Dispiay Permit. 4. Suspend or revoke their Consumption and Display Permit as stated in Section 8-5 of the Cottage Grove City Code. COUNCIL ACTION For Council review. Attch. Un61 such time you have made formai applica6on to the city, provided ail required supporting documentation, and.received approval for the establishment of your own securify crompany, you are required to comply with the requirements of my letter of October 2, 1997 using current ARI Securify. As you and i have discussed frequenUy, as the liquor (icense hotder you are responsible for all of the security requirements imposed 6y the City Counc�'i, and you may not transfer that responsibi(ity to a security company even if it is your own. From recent inspection of events by members of the Cottage Grove Police Department, there appears to be two continuing problems: _ t.
