RE: Hardwood Eminent Domain Proceedings Update
The owners of properties along the Hardwood Avenue corridor
were sent the attached letter from Kennedy & Graven. The letter
references the City's eminent domain proceedings for properties
that will be affected by the construction of Hardwood Avenue and
the drainage, utility, and ponding easements. The second page
lists all the property owners who were sent this information.
This is the official notification that begins the eminent domain
proceedings. You will be updated as the process advances.

TO THE RESPONDENTS IN THE ABOVE-REFERENCED ACTTON:
As you may know, the Ciry of Cottage Grove has undertaken to acquire interests in portions of
over portions of several properties located neaz Harkness Avenue and Point Douglas Road. The
property interests to be acquired include fee title to portions of some properties, for the
construction of Hazdwood Drive, as well as drainage, urility and ponding easements over portions
of some properties. The current construction schedule for the project requires that the City
acquire atle to property interests on or before September 16, 1998. In order to meet this
deadline, the City of Conage Grove has filed a condemnarion perition with the Washington
County District Court. The condemnation pedtion is being served upon you sepazately.
The purpose of this letter is to advise you that the City intends to acquire ritle to and possession
of the property interests pursuant to Minnesota Statutes, Secrion 117.042, the so-called "quick-
take" statute. A Noace of Intent to Take Title and Possession is enclosed and served upon you.
As described in the enclosed Nouce, the City will move the court to issue an order, transferring
title to and possession of the necessazy property interesu to the City as of September 16, 1998.
You will be noufied in the future of the court heazing on that motion. Prior to obtaining the
court order, the City will pay to you or deposit with the court an amount equal to the approved
appraised value of the property rights being acquired. The "quick-take" procedure affects only
the timing of the City's acquisidon of the properties. You retain the right to present evidence
to the condemnation commissioners concerning the amount of damages to be paid as a result of
the taking.
Please be assured that the City has initiated this proceed'eng at this time solely in order to
meet construction timelines. The City remains interested in continuing negotiations with
the affected property owners. If a voluntary agreement is reached, you will be dismissed from
this proceeding. If you have questions, I encourage you to contact me at (612) 337-9217.
