CALL TO ORDER

The City Council of the City of Cottage Grove, Washington County, Minnesota
held a speciai meeting on Tuesday, June 9, 1998, at the Cottage Grove City Hali,
7516 80 Street South. Mayor Pro Tem Jim Wolcott calied the meeting to order
at 8:00 a.m.

Mayor Pro Tem Jim Wolcott presided over the meeting.
Site Plan Variance — Renewal by Andersen
Council reviewed the application of Jim Stoker of Corporate Real Estate, inc., for
a variance application to permit construction of loading docks on the south side
of a building.

Cantinuation af Public Hearing — Gherokee Licauors Inc..
Council continued the public hearsng fram June 3, 1998, to consider the
applicatinn of Cherokee Liquors, Inc., fnr an "C�ff Sale" Intox'scating Liquor
License at 8118 Nadley Avenu� South. At the June 3 meefing, the Ci#y Cauncil
asked tFre City Attorney to review whether Minnesofa Statutes. Sectian

340A.412, subd. 4(a)(5} would prohibit the issuance of the license application
because of its proximity to the National Guard Armor� building, a portion of which
is leased for the operation of the WIC program.
Administrator Schroeder highlighted the City Attorney's opinion as outlined in a
June 8 Ietter from Carrine Thomson. The iimitation imposed by Minnesota
Statutes is not appiicabie to the premises at 8118 Hadley Avenue South and the
City Council would not be prohibited from issuing a liquor license for that
premise. The WIC program operated in the National Guard Building is not an
"institution" under the supervision or control of the commissioner of human
services.
MOTION BY HALE, SECONDED BY SHIE�Y, TO AUTHORIZE ISSUANCE OF
AN "OFF SALE' INTOXICATING LIQUOR LICENSE TO CNEROKEE LIQUORS,
INC., D.B.A. COTTAGE GROVE LIQUORS, 8118 HADLEY AVENUE SOUTH,
UPON COMPLIANCE WITH THE FOLLOWING:
1. THE OFF-SALE LIGENSE SHALL BE ISSUED ONLY UPON SURRENDER
OF THE EXISTING LIGENSE ISSUED TO DAVID �. WROLSTAD; AND
2. THE NEWLY ISSUED LICENSE SHALL TERMINATE UPON THE OPENING
OF THE NEW G-WILL LIQUOR ESTABLISHMENT.
MOTION CARRIED. 3-0.
