Dear Mr. Wallner,
I received your letter regarding the recent cleanup actions on the Marathon Ashiand Petroleum
property. The letter addressed some of the staging questions we had requested. i also
received a phone cail from Mr. Ed Bacig informing me that Area 3 wiil aiso be addressed in this
summer's cleanup activity. In fact, Mr. Bacig will be submitting an amended grading permit
which includes infotmation regarding the cieanup and grading activity associated with Area 3.
The information regarding additional cieanup of the site is weicome given the concerns which
have been expressed by the City Council and Cottage Grove citizens. As stated in my previous
letter, the City is certainly interested in the disposition of the site and has made a commitment
to monitor the cleanup activity in light of potential land use changes. I wiil be forwarding this
new information to the Councii so that they are aware of the on-going activity. I also perused
the information submitted regarding the nine monitoring wells. It appears from the attached
cover letter that sampling is taken four times per year. The City would appreciate a periodic
update regarding the findings of the well sampling.
I would also request that after final cleanup the MPCA provide what the final status of the
property is. in other words, aside from Area 4, where no contamination has been found, is the
site considered totaliy clean? Would monitoring of the wells continue and for how long?

Dear Ms. Lynquist:
Thank you, and Ryan Schroeder, for meeting on Ju(y I, 1998, to discuss the Cottage Grove site.
Enclosed is the information you requested which includes water monitoring data, and well
locations.
You also asked for a summary of the cleaoup actions to date by each area. This summary is as
follows:
Area 5- In December 1997, Marathon Ashland Petroleum (MAP) completed the cleanup of
Area 5. This area contained the greatest volume of concentrated waste. Over 10,900 tons of the
most heavily contaminated material was excavaYed and thermally freated to prevent the
possibiliry of future contaminants leaching to ground water. The cleaned soil was remrned to the
excavation.
After completion of Area 5, the Minnesota Pollution Controi Agency (MPCA) was satisfied that
the cleanup was complete even though some waste, primarily in Areas 1 and 2 remained.
Because of their smaller volumes, these waste masses were judged to pose negligible risk to the
environment or human health if !efr on site.
Once Area 5 was completed, all that remained was to remove some surface deposits of dry
asphalt. This was going to be done by the Department of Natural Resources once they acquired
the property from MAP. However, as any purchaser of contaminated property would do, the
DNR requested a No Association letter from tbe MPCA. This letter assures the purchaser of
contaminated properry that they will not be held (iable in the future. The MPCA's Voluntary
Investigation and Compliance Unit reviewed DNR's request, and concluded that there was a
concem because some concentrated waste was still present just betow the dry asphalt. As a
result of this concern the MPCA asked MAP to dig additional test trenches to determine the
extent of the concentrated waste. The trenching work revealed additional waste below the dry
asphalt. We informed MAP that additional excavation was needed, and estimated that only
about 1,000 additional cubic yards had to be removed. We believed that this needed to be
removed in order to (imit the DNR's and MAP's future liability. This is a retatively small
amount. However, to Marathon Ashland Petroleum's credit, they made a decision to remove a
much higher quantity of waste. At this point I should have called the city to let you know that
more work would take place but I did not. It was not a conscious decision to exclude the city.
Once the decision was made to remove more waste MAP began excavating around the first of
June 1998. The following is the summary of this additional work by azea.

Area I- All the waste from Area i was removed. I visited the site afrer the excavation, but
before backfilling, and can verify that all waste was eemoved.
Area 2- Ashland is currently working on this area. Their intent is to remove all waste. Prior to
staRing on this area they erected a silt curtain, and agreed to reseed the disturbed areas. As of
Juty 2, 1998, MAP has removed an additional 6,599 tons of waste from areas I and 2.
Area 3- This area is next in Iine (possibly referred to as a phase ofthe cleanup by some). The
extent of cleanup is to be determined, and is scheduled for this month
Wastes from Areas l, 2 and 3 are being taken to a non-hazardous waste landfill.
Area 4- This is the ravine which contains miscellaneous debris such as tires, bed springs, etc.
No surface or subsurface contamination has ever been founzl here. Consequently this area does
not need to be cleaned up. My understanding is that the DNR will remove the debris once they
acquire the property.
Marathon Ashland Petroleum has gone beyond our requirements for cleaning up the Cottage
Grove site, which should add an additional level of comfort for the City. With regard to the
reseeding issue, MAP has assured me that they will reseed any disturbed areas. Also, MAP has
erected a silt curtain. I appreciate your verbal approval to MAP which allowed them to eontinue
work even though a written grading plan had not been submitted. They assured me that a
grading plan would be submitted ASAP.

RE: Final Grading Plan for Okey Farms Excavation Project, Cottage Grove, Minnesota
Dear Nlr. Burbank:
Bay West, Inc. is providing this Final Grading Plan for the Okey Farms Excavation Project, as
per our June 11, 1998 Application for Grading Permit. The Final Grading Plan was developed
based on several meefings and conversations with the Minnesota Pollution Control Agency
(MPCA) and the Minnesota Department of Natural Resources (MDNR).
According to the MDNR, this site is a natural prairie and, therefore, non-native material must not
be used when backfilling the site. Based on this information, Yhe MDNR has told Hay West Yo
backfill the excavation only were it exceeds a three-foot depth. Areas of the excavation that
exceed a three-foot depth will be backfilled using soil scraped from the agricultural fields
adjacent to the site. An area approximately 400 feet by 500 feet by .25 feet deep will be scraped
to provide approximately 1,852 cubic yazds ofbackfill material. Areas of the excavation less
than three feet deep will be graded to match the slope of the surrounding area. The edges of the
excavation will also be graded so as to provide a smooth transition between the former
excavation and the undisturbed areas.
Once the excavation areas have been backfilled, leveled, and graded, they will be seeded using
either oats or wheat at an application rate of approximately 50 pounds per acre.
Bay West is looking forwazd to working with the City of Cottage Grove on the Okey Farm
