Re: OUTDOOR EVENT PERMIT APPLICATION — MAJESTIC BALLROOM
�NTRODUCTION
Mr. Donald and Genevieve Meissner, on behalf of the Majestic Baliroom, have
made application for a permit to conduct an outdoor music festival on Friday,
August 14th through Sunday, August 16th, 1997. This has bee� an historical event
for the Majestic Baliroom, formerly known as a Polka Fest.
BACKGROUND
The Cottage Grove City Ordinance has been amended to transfer the review of
such permit applications from the Department of Community Development to the
Department of Public Safety.
DISCUSSION
In accordance with the requirements of Cottage Grove Ordinance 607, the Public
Safety, Health and Welfare Commission reviewed the applicatio� for this event
submitted by Mr. Donald and Genevieve Meissner, at their Juiy 14th meeting and
unanimously recommended the foilowing conditions for the conduct of this event.
• Trash and debris in all dance areas, parking lots and other areas of the
property shall be periodically picked up during the festivai period.

• Adequate policing as determined by the Director of Public Safety shall be
provided to maintain order. Any costs incurred for the police enforcement
required for the events shail be the responsibility of the applicant.
• Adequate sanitary facilities shall consist of a minimum of six portable unisex
toilets. Portabie toilets shall be pumped as necessary.
• All tents used shall meet the requirements listed in the Uniform Fire Code.
Proof of fire retardancy treatment for all tents must be provided for
inspection by the City Fire Marshali.
• The applicanUFestival Promoter shall contact the Director of Public Safety
during City Hall business hours to go over the Festival safety plan, and to
schedule all required inspections. These inspections must be completed one
week prior to the opening or operation of any Festival activity.
• AII requirements deemed necessary by the Director of Public Safety shali be
foIlowed.
• The designated dance area shall be fenced off with separate areas where
alcohol is permitted.
• All necessary electrical permits shall be the responsibility of the electrical
contractor. AII eiectrical connections shail be inspected as required by; the
State Electricai Code.
• All tra�c entering the Majestic grounds shall be directed onto 96th Street
from West Point Douglas Road (Southeast of the Majestic property). Traffic
access to the overfiow lot shall not be via lslay Avenue and 96th Street
South.
• No vehicles shall be allowed to park on West Point Douglas Road, between
Islay Avenue and 96th Street or anywhere else posted.
• Marked Fire lanes shall be kept open around the festival site. The width and
location of said lanes shall be approved by; the Fire Marshali.
• Ali music shall cease by the times on the dates specified beiow.

• All events must conform to the criteria concerning noise set forth in Section
28.51.1 of the Zoning Ordinance.
• The Outdoor Event Permit shall be valid for a period of one (1) year from the
date approved by the City Council. The City Council reserves the right to
revoke, review, add, or modify any part of the permit as listed during this
period.
� Trash and recycling bins shall be provided throughout the designated dance
area and be clearly marked.
• Ali resident campers on the Majestic site shall be informed of the on-site
sewage dumping location, and of any other waste disposal locations in the
area.
• The Majestic septic system shall be monitored on a daily basis. This may
inciude pumping and/or restricting use of the disposal system.
• A name and phone number of a contact person that shail be responsible for
handling noise complaints shall be included in the festival safety plan.
• There shall be at least three semi-tractor trailers parked on the west edge of
the property to serve as a noise buffer.
RECOMMENDATION
It is my recommendation that the City Council authorize tne issuance of a permit.
COUNCIL ACTION REQUIRED
If the City Council concurs with this recomme�dation, they should pass a motion
authorizing the issuance of the permit to Mr, Donaid and Genevieve Meissner,
subject to the conditions outlined in this memorandum.

CONDITIONS OF A PERMIT:
Permit issued under Sectio� 8-1 1 of City Cade may be subject to conditions to protect
the public heaith, safety, and welfare, and minimize any effects upon, adjacent to, and
nearby property owners. Conditions of a permit shall address, but not be limited to,
the foilowing:
• Approval of the layout, parking, emergency lanes, and access with inspection by
the Department of Pubiic Safety before the event commences.
• Provision for adequate policing during the event. Proof of compiiance to the
Uniform Fire Code must be provided at the time of City inspection.
• Provide and mai�tain adequate sanitary facilities for patrons and workers.
• That adequate safety measures are taken with respect to any tents used in
conjunction with an event, which shail include compliance with the U�iform Fire
Code, prohibition of smoking, and provision of adequate fire extinguisher.
• That events comply with the provisions of the City's noise ordinance, Section
28.51.1.
s All music and/or amplified communication shall cease by 12:00 midnight.
• That adequate temporary trash/recyciing containers be provided and cleariy
marked. Provision for a daiiy pickup of the containers shall be made.
• That fencing of the area be done if necessary.
• Hours of the event's operation be specified.
•. Buffers to minimize the effects of noise to adjacent property shall be provided.
•. if water is requested from a fire hydrant source, a fee shall be established from
time to time by City Councii resolution. AII connections shall be approved by the
Director of Public Works and back flow preventors shall be used.
• No intoxicating beverages shall be consumed by equipment operators while on
duty. No operators shali operate any equipment while in an intoxicated condition.
• Any camper 2railers and recreationai vehicies have sanitary holding tanks
pumped/drained as often as necessary to maintain sanitary conditions. Disposai
of this materiai shouid be done by qualified personnel or at a designated dumping
station.
�• All equipment and vehicles shall be removed from the site by 6:00 a.m. of the
Monday following the event, except ail weight restricted and wide-ioads may
remain on the site until 9:00 a.m. of the Monday following the event.
• Parking fot attendants shall be provided if required by the Director of Pubiic Safety
at the entrance of each parking area. These attendants shall direct traffic to
designated parking spaces.
• The applicant shail contact the Director of Public Safety duri�g City Haii business
hours to schedule ali required inspections. These inspections must be completed
prior to the opening or operation of street dance.
X• The City of Cottage Grove shail be named as an additionai insured by the
applicant's Comprehe�sive General Liability and Liquor Liability insurance policies
for a minimum of S1,000,000 coverage. Proof of coverage shall be submitted in
the form of a Certificate of tnsurance no later than one week prior to the event.
• Designated street dance areas shall be fenced off with separate areas where
alcohol is permitted. No glass containers shail be used, displayed or aliowed i�
the designated street dance area or perimeter parking area.
• All necessary electrical permits shall be the responsibility of the electrical
contractor. AI� electrical connections shali comply with the State Electrical Code.
• Other conditions or measures to conform to the intent of appiicable ordinances.

WFiEREAS, Mr. Don Meissner has filed an application with the
City of Cottage Grove Planning Coaunission for an Interim
Conditional Use Permit, to conduct an Annual Music Festival on the
property legally described as follows:
"Lots i tnrough 8 of block 15; Lots 1 through 6 of Block 16;
'Lots 1 through 11 of Block 18; and Lots i through 9 of Block
19, all within the Langdon Addition, Cottage Grove, Washington
County, Minnesota.°

Commonly described as Majestic Ballroom, 9165 West Point
Douglas Road, Cottaqe Grove, Minnesota.
WHEREAS, Public hearing notices were mailed to property owners
within 500 feet of the above described property, and published in
the Washington County Bulletin; and
WHEREAS, No Testimony was received in opposition to the
requested Interim Conditional Use Permit.
WHEREAS, The Planning Commission held a public hearing on
August 9, 1993 and recommended to the City Council, that the
application request be approved subject to conditions; and
NOW THEREFORE BE IT RESOLVED, by the city council of the City
of Cottage Grove, County of Washington, State of Minnesota that the
three year Interim Conditional Use Permit application made by Mr.
nanald M??ssner shall be apnroved, subject to the followina
conditions: -
1. Trash and debris in all dance areas, parking lots and
other areas of the property shall be periodically picked
up during the festival period.
Adequate policing as determined by the Director of Public
Safety shall be provided to maintain order. Any costs

15. The Interim Conditional Use Permit shall be valid for a
period of three years from the date approved by the City
Council. The City Council reserves the right to revoke,
review, add, or modify any part of the permit as listed
during this period. Such a review, if deemed necessary,
does not mandatorily require a publishing to be held.
Although, if it is determined that a public hearing is
necessary, the City Council can conduct such a hearing or
refer the matter back to the Planing Commission for a
recommendation (sj.
