Background County 3tate Aid Highway 39 (Hadley Avenue South) has been designated to be improved by Washington County. The County has approached the City for approval of a cooperative agreement concerning this stretch of road. The Council has not yet approved the cooperative agreement. The Council called for the public heazing on July 15�' to be held August 5` Enclosed, please find the feasibiliry report and cooperative agreement. Brian Guage, an Engineer for Washington County will be available to answer questions during the p�blic hearing. Requested Action Hold the public hearing and adopt the resolution ordering the improvement contingent upon approval of the cooperative agreement. >a � . . � ,. . .� u�. RESO�UTION NO. 98-107 RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS FOR COUNTY STATE AID HIGHWAY 39 (HADLEY AVENUE) RECONSTRUCTION PROJEGT WHEREAS, a resolution (#98-97) of the City Council adopted the 15 day of July, 1998, fixed a date for a Council hearing on the proposed improvement of that portion of CSAH 39, AKA Hadley Avenue South; and WHEREAS, ten days' mailed notice and two weeks' pubiished notice of hearing was given, and the hearing was held thereon on the 5` day of August, 1998, at which all persons desiring to be heard was given an opportunity to be heard, now THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF COTTAGE GROVE, COUNTY OF WASHINGTON, AND STATE OF MINNESOTA; 1. Such improvements are necessary, cost effective, and feasible as detailed in the feasibility report. 2. Such improvements are hereby ordered as proposed in the City Council resolution adopted the 15`" day of July 1998. 3. The Washington County Engineer is hereby designated as the engineer for this improvement. The engineer shail prepare plans and specifications for the making of such impravement. Stransky, City Clerk WASHINGTON COUNTY COOPERATIVE AGREEMENT WITH CITY OF COTTAGE GROVE FOR COUNTY STATE AID HIGHWAY (CSAH) 39 THIS AGREEMENT, by and between the City of Cottage Grove, a municipal corporation, herein after referred to the "City", and Washington County, a political subdivision of the State of Minnesota, hereinafter referred to as the "County": WITNESSETH: WHEREAS, the County and the City desire to design, construct, and maintain County State Aid Highway (CSAH) 39 (Broadway Avenue/Hastings Avenue/Hadiey Avenue), between CSAH 22 (Summit Avenue) and Grange Boulevard; and WHEREAS, items as part of this contract require City cost participation in accordance with County policy; and WHEREAS, CSAH 39 from 700 feet north of 77th Street to Grange Boulevard is in the City and in the County; and WHEREAS, the County project number for this project is SAP 82-639-05; and WHEREAS, a cooperative effort between the City and the County is the appropriate method to facilitate the construction; and WHEREAS, the County and City desire to use State Aid and local funds on this improvement; and WHEREAS, this Agreement is made pursuant to statutory authority contained in Minnesota Statute 162.17 sub.1. NOW THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: A. PLANS AND SPECIFICATION PREPARATION 1. The County shall prepare the necessary plans and specifications, and obtain ali approvals required for the advertisement for bids for this project. B. RIGHT OF WAY AND EASEMENTS 1. The County shall acquire all permanent right-of-ways, permanent drai�age easements, and temporary slope easements for which the City wiil reimburse the County pursuant to Section E1 of this Agreement. 2. Ail right-of-ways, permanent drainage easements, and temporary siope easements wili be in the name of the County. Page 1 CSAH 39 COOPERATIVE AGREEMENT WITH CiTY OF COTTAGE GROVE 3. Any right-of-ways, permanent drainage easements, and temporary slope easements which cannot be obtained through negotiation wiil be acquired by the County through eminent domain proceedings. C. ADVERTISEMENT AND AWARD OF CONTRACT After the plans and specifications have been approved, all other approvals obtained, and necessary right-of-ways and easements acquired, the Cou�ty shall advertise for construction bids, and award the contract. The County shall determine the lowest responsibie bidder but concurrence in award by the City shall be a condition precedent to the finai award of the bid. D. CONSTRUCTION ADMINISTRATION, OBSERVATION, AND TESTING 1. The County shall perform the construction administration, o6servation, and testing. E. COST PARTICIPATION ITEMS AND ESTIMATED COSTS 1. The City shali pay to the County the items, percentages, and estimated costs set forth in Section 1.a, through Section 1.d. as iollows: a. The City shall pay to the County 100 percent of the cost of all permanent right-of-ways, permanent drainage easements, and temporary slope easements within the City. The cost to the City is estimated at 56,500. b. The City shall pay to the County 50 percent of the cost of the concrete curb and gutter. The cost to the City is estimated at 520,401. c. The City shall pay to the County its prorated share of the cost of Mobilization, Fie1d Office, Traffic Control, Bale Check, Silt Fence, and Construction Signs - Special. The cost to the City is estimated at 51,963. d. The City shall pay to the County 100% of the cost of concrete driveway aprons constructed to replace gravel and bituminous entrances. The cost to the City is estimated at S 1 1,095. 2. In addition to the amounts set forth in Section 1.a. through 1.d., the City shall pay to the County 2.3 percent of the design and constructio� engi�eering fees. The cost to the City is estimated at 53,962. Page 2 CSAH 39 COOPERATIVE AGREEMENT WITH GTY OF COTTAGE GROVE 3. Quantity and cost distribution identified above are merely estimates of the engineer. Actual costs shall be based on the contractor's unit prices and the quantities constructed. Attached is a copy of the CSAH 39 Cost Participation (Exhibit A1 identifying the City's cost items and demonstrating the method of cost calculation. F. PAYMENT The County shail, when a construction contract is proposed to be awarded, prepare a revised estimate and cost participation breakdown based on the contract unit prices and submit a copy to the City. The City shall advance to the Treasurer of Washingto� County an amount equal to the City's estimated co�struction cost share plus engineering fees and costs in obtaining right-of-ways. 2. Upo� substantial completion of the work, the County shall prepare an updated revised estimate of cost participation breakdown which wil! be based upon the contract unit prices and the actual units of work performed and submit a copy to the City. The County shail add to the City's estimated final construction costs the costs of suppfemental agreements, if any, make necessary adjustments for liquidated damages, if any, and deduct City funds previously advanced for the project by the City. The City agrees to pay to the County any amounts due, if more than the estimated sum of the first revised estimate. I� the event the ca�culations show that the City has advanced funds in greater amount then is due the County, the County shali refund the amount to the City without interest. G. CHANGE ORDERS AND SUPPLEMENTAL AGREEMENTS 1. Through a duly adopted City Councii resolution, the City may request changes to the final approved pians and/or specifications . H. MAINTENANCE/OWNERSHIP L Upon completion of the project, the County sha(i own and mai�tain the storm sewer trunk line, catch basins, and leads on its County road right-of-ways and drainage easements. 2. Upon compietion of the project, the City shali own and maintain the storm sewer trunk line, catch basins, leads, and drains servicing property outside the County road right-of-ways and drainage easements. 3. Parking on the road and other roadway regulations wili be controlied by the County. OTHER AGREEMENTS 1. The County shall enter into a separate agreement with the City of St. Paul Park for its share of the construction and related costs as shown on the attached CSAH 39 Cost Participation tExhibit AI, identifying the cost items and demonstrating the method of cost calculation. J. LIQUIDATED DAMAGES 1. A�y Iiquidated damage assessed the contrector in connection with the work performed on the project shall be shared by the City and the County in the following proportion: The respective total share of construction work to the total construction cost without any deduction for liquidated damages. K. CONDITIONS Any city utility or facility which are subsequently modified or added to those currently in the plans and specifications shall be made part of this construction contract by suppiemental agreement and shail be paid for as specified in the suppiemental agreement. Page 4 CSAH 39 COOPERATNE AGREEMENT WITH CITY OF COTTAGE GROVE 2. The City shall not assess or otherwise recover any portion of its cost for this project through levy on County-owned property. L. CIVIL RIGHTS AND NON-DISCRIMINATION 1. The provisions of Minn. Stat. 18t.59 and af any applicable ordinance relating to civil rights and discrimination shall be considered part of this Agreement as if fully set further herein, and shall be part of any Agreement entered into by the parties with any contractor subcontractor, or material suppliers. M. WORKERS COMPENSATION 1. It is hereby understood and agreed that any and all employees of the County and ali other persons employed by the County in the performance of construction and/or construction engineering work or services required or provided for u�der this agreement shall not be considered employees of the City and that any and alI ciaims that may or might arise under the Worker's Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any and all ciaims made by any third parties as a consequence of any act or omission on the part of said County employees while so engaged on any of the construction and/or construction engineering work or services to be rendered herein shalf in no way be the obiigation or responsibility of the City. N. INDEMNIFICATION 1. The City agrees that it will defend, indemnify and hold harmless the County agai�st any and ali liability, loss, darnages, costs and expenses which the County may hereafter sustain, incur or be required to pay by reason of any negligent act by the City, its agents, officers ar employees during the performance of this agreement. 2. The County agrees that it wiil defend, indemnify and hoid harmless the City against any and all liability, loss, damages, costs and expenses which the City may hereafter sustain, incur or be required to pay by reason of any negiigent act by the County, its agents, officers or empioyees during the performance of this agreement. CSAH 39 begins at thc intcrscdion of CSAH 22 (Summit Avenue) in SL Paul Park and ends at the soulh rnmps of the Tnmk Highway ( U Grange Boulevard interchange in Cottage Grove. This projec[ was initiated by Washin�tmi Counly Department of Public Works as part of [he their Capiliil Improvement Plan. Washington County Dcp�rtmcnt of Public Works is the lead agency. The Cities of St. Paul Park and Cott�ge Grove sI�ITand o(licisis, as well as loc�11 residents h�ve been involved in [he project's development. T7�e propos��l includes reconstniction of CSAH 39 bet�veen Summit Avenue �nd Grange Boulevard, a distance of approsim�tely 2.7 kilometers (L67 miles). EXISTING CONDITIQNS As noted prcviously, ihe need for reconstnicting CSAH 39 is being driven by the deteriorating p�vement condition and increasing draimge problems. De[criorating Pa��emcnt Conditions The existing pavement along CSAH 39 is in poor condition. This is the result of the age of the bituminous materiat as �vell �s the f�ilurc of the underlying gnvet and base materi�ls. This deterioration is typical of older road�ti•ays and of ro�d�� ays in 1re�s ���th old or ineffective srorcn sewer. The existing bituminous curi� is also in very poor condition. The resutt is a high�vay �j�tli a rough ride, standing water problems, U�e settlement of utiliry sin�ctt�re, and tl�e need for continued and eatensive maintenance work. Incrcasing Drainagc Problcros The storm sewer sysicm along Uiis high��ay is m�de up of various rypes, and ages of pipe, as weli or the use of bituminous ��tter and spil! �vater. The project begins at the intersection ofBroadway Avenue and 5ummit Avrnue in St. Paul Park and ends at the intersection of Grange Bouicvard and I-iighway 61 in Cottage Grove. 7'he work will consist of the following: Betwecn Summit Aveaue and Beiden Boulevard - Reconsttuction entire rpadway and stoan sewer system and insta!]arion pf concrtte curb and gutter and driveway approaches. Skewed interseetions and the wmer near the St. Faul Park City Fiali will be realigned to improve sight distance and safety. Between Belden Boulevard and Grange Bouicvard - The pavement will be mitled and overlaid. The existin� surb and gutter and storm sewer system will be maintained. Along Grange Boulevard bttween Hadley Avenue and Highway 61 - New signing will be installed. The project was started in the fall of 1996. Pubiic meetings have been heid to keep the residents and local agencies informed of the project status. The current schedule is to wait for the public improvement and assessmert hearings to take piace and then to advertise the project. It is currentiy pianned to start construction in the Spring of 1999, so the letting date will be sometime this Fall or Winter. 7'he construction should take Sess than one season. NSF wili also be relocating s high pressure 6" gas line aloag this corcidor at this time. It is pianned to reconstruct the roadway in sections to maintain access to businesses along CSAFI 39. Through traffic will be detoured along E bl for the duration of the project. Some permanent and temporary easements wiIl be required ro address the zealignment of imersections and dcainage revisions. Attached is the curreni cost estimate and cost participation for the project. As indicated in the cooperative agreement, the actually costs will be deternvned at the time of letting.
