There are four current lawsuits or pending lawsuits of which Council either is
or shoutd be aware. We intend to provide at least updates on each of them at
your meeting of August 19.
1. Jebco. This is the drainage Bawsuit that apparentiy is over (see attached).
2. Jacobs. This appears to be a spurious lawsuit and is conducted pro se
(see attached).
3. Tower/Concrete. The arbitration has been cancelled with an expectation of
a future rescheduling. If we have new information it wili be discussed.
4. Julkowski. You received a pile of information on this 20-year matter on
July 31, 1998 {Various Matters). I have attached a letterwe just received on
the same issue. In speaking with Mr. Juikowski I am expecting he will be
scheduled as an open workshop item at your September 2, 1998 meeting
but I am looking for direction on the matter. While this is not yet an actual
lawsuit we are threatened with that action.

Gentlemen and Ms. Stransky:
Enclosed please find a copy of a letter I have sent to Mr.
Jacobs. Since Mr. Jacobs has not specified the exact dates
when he claims this alleged wrongful conduct occurred, I do
not want any of you to sign the Waiver of Service of the
Summons and Complaint in this matter since to do so stops the
running of the statute of limitations. As soon as he
specifies when these events occurred and I am convinced that
they are beyond the statute of limitations period, I will put
on a motion for dismissal. He may choose not to give me the
information rgarding the dates and just serve the Summons and
Complaint upon you just the way it presently exists. If he
does so, please notify me immediately and send to me a copy of
the Summons and Complaint you were served with specifying the

date you were served and the manner in which you were served with the
Summons and Complaint, i.e., was it handed to you personally or was
it left at your residence or by some other means. I will then take
the appropriate action to protect your interests. At the present
time, however, with him not having obtained your signature on that
Waiver of Service of the Summons and Complaint, he has not properly
commenced the action against you.
The attorney representing CBS and the Minneapolis paper is giving his
clients the same advice I am advising you. However, the attorney
representing KARE 11 has already had his clients sign the waiver and,
therefore, he is going to be putting on a motion to have the case
dismissed since the time frame for him to respond started once he had
his clients sign the Waiver. It will be interesting to see what
response Jacobs has to this other defendants' motion for dismissal.
Defending this lawsuit in the present posture is almost impossible and
that is why I will be putting on a motion to dismiss if, in fact, he
does serve the papers.

THAT YOII PREVIOIISLY RECEIVED SIIT RETAIN IT ONLY IN YOVR RECORDS.

Likewise, in all of your claims, which are all based on conspiracy,
you don't specify when this occurred. You do not set out what year
or month when this occurred. F�rthexmore, you do not specify what
conduct occurred which constitutes the conspiracy. You do not specify
which defendants participated and you do not set forth the specific
conduct of each of the defendants relative to this allegation of a
conspiracy.
Furthermore in paragraph 16, you make reference to a failure to
fulfill a contractual obligation, however, you don't even specify what
the contract is, or when the contract was entered into, or when the
breach of the contract occurred.
Certainly I cannot advise my clients to waive service of process
relative to a Complaint that is totally incomprehensible.
Please advise if you intend to supply us with the speci£ic information
I am requesting in this letter or whether you intend to proceed
forward with this Complaint in the manner in which it presently exists
as dated June 12, 1998.
